유치원 교원에 대한 징계와 법적 구제에 관한 기초 연구 (A basic study on the disciplinary action against a kindergarten teacher and its related legal remedy)

초록

본 연구는 유아교육 발전의 핵심적 요소인 유치원 교원의 신분보장을 위하여 교원에 대한 징계와 법적 구제를 알아보려는 것을 목적으로 한다. 본 연구는 먼저 유치원 교원의 징계와 법적 구제에 관한 기본법리를 알아본다. 그 후 이를 기초로 유치원 교원의 징계와 법적 구제에 관한 법원을 찾는다. 찾은 법원을 입법해석, 헌법재판소의 결정과 대법원 판례 등 사법해석, 교원소청심사위원회의 결정과 실무례를 중심으로 한 행정해석 내지 준사법해석, 학리해석을 통해 정리하고 유치원 교원의 관점에서 해석한다. 나아가 유치원 교원의 신분보장을 위해 유치원 교원의 징계와 관련하여 향후 입법화가 필요한 부분이 있다면 적극적으로 살펴본다. 연구결과 제시된 결론은 다음과 같다.
첫째, 유치원 교원의 징계에 관한 규정은 복잡하게 산재되어 있다. 일반 공무원과 교원은 명백히 구별됨에도 불구하고 징계사유가 공무원의 징계사유와 동일하여 기계적 적용은 부당한 결과를 가져올 수 있다. 그러므로 교원의 지위에 관한 기본법이 제정되어야 한다. 둘째, 징계사유가 추상적이다. 엄격한 해석원리를 통해 징계사유는 제한적으로 해석되어야 한다. 셋째, 유치원 교원의 표현의 자유, 교원의 교육의 자유와 관련된 징계사유는 제한적으로 해석되어야 한다. 넷째, 유치원 교원의 정치적 활동은 ILO-UNESCO 교원의 지위에 관한 권고와 같이 폭넓게 인정되어야 한다. 다섯째, ‘사립학교 교원의 공무원성’은 향후 교원의 지위에 관한 기본법의 제정에 반영되어야 한다.

영어초록

This study examines the disciplinary action against a kindergarten teacher and its related legal remedy in order to protect the guarantee of status of kindergarten teacher, which is regarded as a crucial factor in the advancement of the education. This study first discusses principle related to disciplinary action against a kindergarten teacher and its related legal remedy. Based on the discussed principle, it identifies the laws related to disciplinary action against a kindergarten teacher and its related legal remedy;  then, it analyzes and interprets the laws through legislative interpretation, judicial interpretation including constitutional court decision, Supreme Court decision, and etc., administrative interpretation or quasi-judicial interpretation based upon decisions made by appeal commission teachers and real-world practices, and academic researches. Furthermore, if there is necessity to legalize some actions in regard to protect the kindergarten teacher’s right, this study proactively pursues how to implement them. Through this study, conclusions are the followings:First, regulations for the disciplinary action against a kindergarten teacher are not clearly defined. Despite of the obvious distinction in between public officials and public teachers, the same grounds for disciplinary action could be applied automatically. Then, this application could be unfair for teachers. Hence, it is necessary to establish the framework act on status of teacher. Second, grounds for the disciplinary action are abstract. The grounds need to be interpreted limitedly through strict application of the rule. Third, the ground of disciplinary action against kindergarten teacher regarding the freedom of expression and the freedom of education should be interpreted restrictively. Fourth, a political activity of a kindergarten teacher needs to be accepted broadly as shown in the ILO-UNESCO recommendation concerning the Status of Teachers. Fifth, the need for regarding teachers in private school as public officials should be apply to the framework act on status of teacher.
