난민법상 특정사회집단의 구성원 신분에 관한 연구 (A Study on Membership of a Particular Social Group in the Refugee Convention)

초록

특정사회집단의 구성원 신분을 이유로 한 박해는 난민 지위 인정 사유 중의 하나이다. 특정사회집단의 구성원이라는 용어는 인종, 종교, 국적, 정치적 의견 등 다른 4가지의 박해의 사유를 보완하는 정도로 좁게 해석되거나 모든 형태의 집단을 의미하는 것으로 상당히 넓게 해석될 수도 있다. 이 개념은 다양한 해석이 가능하며, 이러한 이유로 이 개념은 젠더, 성적 지향 등으로 인한 박해의 피해자를 보호하는 중요한 역할을 해 왔다.
대법원은 특정사회집단을 “집단의 구성원들이 선천적 특성, 바뀔 수 없는 공통적인 역사, 개인의 정체성 및 양심의 핵심을 구성하는 특성 또는 신앙으로서 이를 포기하도록 요구해서는 아니 될 부분을 공유하고 있고, 이들이 사회 환경 속에서 다른 집단과 다르다고 인식되고 있는 것”이라고 정의하고 있다.
미국의 BIA는 Acosta 사건에서 특정사회집단의 구성원 신분을 이유로 한 박해는 집단의 구성원들이 공통의 변경 불가능한 특성을 공유하는 개인에 대한 박해를 의미하며, 공통의 특성은 타고나거나 과거의 경험일 수도 있지만, 집단의 구성원들이 변경할 수 없거나 개인의 정체성 또는 양심에 근본적이어서 변경을 강요할 수는 없는 것이라고 설명하였다. 미국의 다른 판례 중에는 집단의 사회적 인식 가능성을 요구하기도 한다. 세계의 여러 나라의 판례는 Acosta 사건의 견해를 따르고 있는 것이 많다.
대법원판결은 다수의 외국 법원의 해석에서 벗어나지 않고 있지만 이 개념에 신앙을 포함하고 있는 것은 불필요한 것으로 보인다. 이 부분은 삭제하는 것이 타당한 것으로 보인다.

영어초록

Persecution on account of membership in a particular social group is one of the reasons for recognition of refugee status. The term “membership of a particular social group” could be interpreted narrowly as complementing other four reasons of persecution such as race, religion, nationality and political opinion, or quite broadly as involving any kind of groups. Open to various interpretation, this category has played an important role in protecting the victims of persecutions based on gender, sexual orientation, and so on.
The Supreme Court of the Republif of Korea recognizes “membership of a particular social group” as a group of individuals sharing an innate characteristic, an immutable common history, or a characteristic that forms individual’s identity, the core of conscience, or religion that is so fundamental to the identity or conscience of its members, and that cannot or should not be required to change, and are recognized as different from other groups in the social environment.” In the Acosta case, the Board of Immigration Appeals(BIA) of the U.S. interpreted the phrase “persecution on account of membership in a particular social group” to mean persecution that is directed toward an individual who is a member of a group of persons all of whom share a common, immutable characteristic. According to BIA, the shared characteristic might be innate or from past experience but it must be one that the members of the group either cannot change, or should not be required to change because it is fundamental to their individual identities or consciences. In other jurisdictions, social visibility of a group is further needed. In most countries across the world, the definition of membership of a particular social group seems to follow the one declared in the Acosta case.
The interpretation of the term “membership of a particular social group” by the Korean Supreme Court seems to be in accord with those of other jurisdictions, except that the former includes the word “religion.” The word appears to be redundant and, in my opinion, should be deleted.
