미국 배심원 심리에 대한 연구와 국민참여재판에 시사점 (An Analysis of Jurors' Psychology in the U.S. and a Comparative Perspective on the Korean Jury Trial)

초록

형사재판에서 검사나 피고 측이 배심원의 심리를 이해하고 파악할 수 있으면 재판에서 유리한 고지를 점령하는 것과 같다. 배심원의 심리를 알 수 있으면 그들이 어떤 방식으로 사고하고, 평의과정에서 어떻게 논의하고, 어떤 평결에 도달할 것인지도 예측할 수 있다. 마찬가지로 미국의 민사 배심재판에서도 원고나 피고 측은 배심원들의 심리적 상태를 판단하고 예측할 수 있으면 자신에게 유리한 평결이 내려질 수 있도록 재판을 준비하고 진행해 나갈 수 있다. 더 나아가서 배심원단의 심리를 자신에게 유리한 방향으로 유도할 수도 있을 것이다.
배심원들이 각 재판에 임하여서 재판의 사안을 이해하고 사실관계를 파악, 해석하며 결정을 내릴 때 여러 가지 심리적 요소에 의해 영향을 받게 된다. 그 요소들은 인생 경험, 성향과 인지, 스키마, 사회적 스키마, 휴리스틱 사고방식/편견, 동기부여 인지, 가정과 추론, 기억력, 인구통계학적 특성 등이다. 그리고 배심원들의 구체적인 심리를 파악하거나 예측하는 방법으로 포커스 그룹 연구, 모의재판 연구, 배심원 질문서, 배심원 선정 구두 심문과 그림자 배심 연구가 있다. 포커스 그룹 연구, 모의재판 연구에서는 예정된 재판의 몇 주나 몇 달 전에 일반 시민들로 구성된 참가자들을 모집하고 그 들의 토의와 피드백을 통하여 실제 배심원단의 심리를 예측하고 이에 따라 적절한 주제와 주장/메시지를 개발하여 실제 재판에 준비한다.
배심원 선정 절차에서 배심원 질문서와 구두 심문을 통하여 배심원 후보자의 심리 상태에 대해 많은 정보를 얻을 수 있다. 배심원 질문서와 구두 심문에서는 개인적인 질문 뿐 아니라 인구통계학적 질문보다 더 심층적인 질문을 할 수 있기 때문이다. 그리고 그림자 배심원단을 구성하여 실제 재판과 동시에 재판을 방청하고 그들의 반응과 피드백을 받아서 실제 배심원들의 심리 상태를 예측하며, 필요시 설득 방법이나 기존 전략을 수정하기도 한다.
배심원의 심리를 자신에게 유리하게 유도하기 위한 기술적인 방법들 중에는 스토리텔링 기법이 있다. 이야기를 통해 자신의 주장과 메시지를 전달함으로써 배심원들이 자신에게 긍정적이거나 상대방에 대해 부정적인 성향이나 선입관을 갖도록 유도할 수 있다. 또는 초두 효과를 극대화하기 위해 재판 초반부에 배심원단에 긍정적인 인상을 남기는 것이 중요하다. 그리고 원고나 피고 측은 자신이 하고자 하는 주장이나 메시지를 하나의 주제로 간단, 명료하게 표현할 수 있을 때 승소나 항변의 성공 가능성이 높아진다. 이러한 주장/메시지를 재판 중에 여러 번 다양한 방법으로 반복하여서 배심원의 기억에 더 오랫동안 명확하게 남도록 해야 한다. 구두로만 전달되는 정보보다 구두와 시각적으로 전달된 정보가 장기기억으로 전환될 가능성이 높으므로 구두 변론에만 의존하지 말고, 시연도구를 이용하여 시각적, 청각적 효과를 이용하는 것이 바람직하다.
미국 배심원단에 비해서 우리나라 국민참여재판의 배심원단은 상대적으로 구성원의 다양성이 적다. 하지만 우리나라에서도 배심원 소환률의 향상을 예상하며 따라서 배심원단 구성원의 다양성도 높아질 것을 예상하며, 배심원 심리에 대한 심층적이고 다각도의 후속 연구가 필요해 질 것으로 보인다. 그리고 우리나라의 세계적인 IT 기술을 이용하고, 미국에서 적극적으로 사용되고 있는 포커스 그룹, 모의재판, 그림자 배심 연구를 적절히 사용하면 배심원들의 심리를 이해하고 예측하는데 많은 도움을 받을 수 있다고 본다.

영어초록

If a prosecutor or defense attorney can understand and figure out the psychological status of the jurors, he can have a tactical advantage in a criminal trial. With a clear understanding of jurors' minds, he can predict how jurors think, discuss, deliberate and reach a verdict. Likewise, a plaintiff or a defendant in a civil trial can prepare for and conduct a trial in order to win a favorable verdict if he can understand or predict the psychological standings of jurors. It would be even possible to lead the jurors to think in favor of your side.
Jurors are influenced by various psychological factors in understanding facts and issues and reaching a verdict. Those psychological factors include life experience, attitude, cognition, schema, social schema, heuristic thinking/bias, motivated cognition, assumption and inference, memory, and demographic characteristics.
There are several methods in understanding or predicting jurors' minds such as focus group study and mock trial study which can be done several weeks or months prior to the scheduled trial. Attorneys can have the study participants discuss, debate and give feedbacks about the given subjects and topics in order to be able to predict the psychological mindset of actual jurors, from which they can create a 'winning' theme and arguments for the trial.
Attorneys can acquire a lot of helpful information about potential jurors' minds during the jury selection process such as juror questionnaire and oral voir dire. Attorneys are often allowed to ask follow-up and in-depth questions which can be private in nature and more probing than demographic questions. Additionally, shadow jury, which observe the actual trial simultaneously, can assist the attorneys in predicting the actual jurors' minds by providing their psychological reactions and feedbacks as to the ongoing trial with which they can even correct and improve the existing trial strategies and tactics, if necessary.
Storytelling method is one of the technical methods in inducing jurors' minds favorably to your case. Through this method, jurors can be induced to have positive attitudes about you or negative ones against the opponent. Also, it is important to leave a strongly positive impression about your case at the beginning of trial in order to maximize primacy effect. And an ability to demonstrate your argument or message in a form of theme expressed in a simple and clear way would be essential in winning or defending successfully. The theme should be expressed repeatedly in various ways throughout the trial so that jurors can remember it longer and more clearly. Information delivered through visual as well as auditory means can be better transferred into long-term memory than through an oral means only. So it is desirable to use demonstrative aids with visual and auditory effects together rather than relying only on an oral representation.
The composition of jury members in Korea is less diverse than American jury members. However, with the expectation for the higher response rate of jury summons in Korea, the more diverse composition of jury members in terms of age, race, occupation, etc. is anticipated. Accordingly, it would be necessary to have a more in-depth studies concerning jury psychology in Korea. The state-of-the-arts IT technology of Korea can be well utilized in understanding and predicting juror psychology along with the active use of focus group study, mock trial study and shadow jury study.
