민간경비 발전을 위한 공동주택 경비원 제도 개선방안 (A Study on the Improvement of Apartment Security System for the Development of Private Security)

초록

우리나라에서 민간경비산업은 공경비를 담당하는 경찰과 함께 사회질서유지 및 범죄예방 측면에서 치안의 중요한 부분을 담당하고 있다. 민간경비 산업도 경제성장과 더불어 발전을 거듭하고 있으나 질적인 면에서 미흡한 부분이 있는 것이 현실이다. 우리나라의 대부분에 경비업무를 수행하는 시설 경비원 중에서 공동주택 경비원에 대한 처우는 아직도 많이 열악하다. 2020년 「공동주택관리법」이 개정되어 청소, 분리수거, 관리사무소 업무 보조 등 관리업무가 공동주택 경비원이 해야 되는 일에 포함되어 시설 경비원임에도 공동주택에 근무한다는 이유로 합법적으로 경비업무 외에 관리업무가 추가되었다.
이 연구에서는 공동주택 경비원의 주요 문제인 업무 범위, 단기계약, 간접계약 등을 살펴보았으며 다음과 같은 개선방안을 제시하였다.
첫째, 공동주택 경비원에게만 적용되는 「공동주택관리법」 제65조의2는 삭제되어야 하며 공동주택 경비원도 시설 경비원이므로 「경비업법」이 적용되어 질서유지와 범죄예방 및 위험발생의 방지라는 본연의 업무에 치중하여야 할 것이고 관리업무는 관리사무소 직원이 수행하여야 한다. 둘째, 간접고용에 따른 갑질 방지를 위해 ‘근로계약의 당사자가 아니더라도 업무 내용과 수행과정 등에 대하여 상당한 지휘‧감독을 하는 사람 및 근로조건에 대하여 실질적‧구체적으로 영향력‧지배력을 미칠 수 있는 지위에 있는 사람’을 사용자에 포함시킨 「근로기준법」 개정안이 하루속히 통과되어 시행되어야 한다. 셋째, 단기계약 방지를 위해 지방자치단체의 경비원 고용유지 지원금을 확대 적용하여야 한다. 넷째, 경비원에 대한 불합리한 처우에 대처하기 위해 경비원의 이익을 대변하는 단체인 경비원협회의 활성화가 필요하다.
우리나라의 민간경비가 지속적으로 성장하기 위해서는 공동주택 경비원에 대한 불합리한 처우들이 개선되어야 할 것이다.

영어초록

In Korea, the private security industry, along with the police in charge of public security, plays an important part in maintaining social order and preventing crime. The private security industry is also developing along with economic growth, but the reality is that there are insufficient parts in terms of quality. Among the facility guards who perform most of the security work in Korea, the treatment of apartment security guards is still very poor. In 2020, the Apartment Housing Management Act was revised, and management tasks such as cleaning, separation collection, and assistance in management office work were included in the tasks of apartment security guards, and management tasks were legally added in addition to security tasks because they worked in apartment houses even though they were facility security guards.
In this study, the main problems of apartment security were the scope of work, short-term contracts, and indirect contracts, and the following improvement measures were suggested.
First, Article 65-2 of the Apartment Housing Management Act, which applies only to apartment security guards, should be deleted, and since apartment security guards are also facility security guards, the Security Business Act should be applied to focus on the maintenance of order, crime prevention, and risk prevention, and management should be performed by management office staff. Second, in order to prevent power abuse caused by indirect employment, the amendment to the Labor Standards Act, which includes "a person who conducts and supervises considerable work content and performance process even if he is not a party to the labor contract, and a person in a position to have substantial, specific control and influence over working conditions," should be passed and implemented as soon as possible. Third, in order to prevent short-term contracts, local governments should expand and apply subsidies for maintaining the employment of security guards. Fourth, it is necessary to revitalize the Guards Association, an organization representing the interests of guards, to cope with unreasonable treatment of guards.
In order for Korea's private security to continue to grow, unreasonable treatment of apartment security guards should be improved.
