민영소년원의 합리적 설치 방안에 관한 논의 (Discussion on the rational establishment of private juvenile detention centers)

초록

소년법은 국가가 곧 부모라는 ‘국친사상’의 이념아래 처벌위주의 법률규정이 아닌 교육, 개선, 치료, 보호에 중점을 두고 보호처분을 명문화하고 있다. 즉, 소년들이 육체적･정신적으로 성인들에 비해 성숙하지 못한 점을 인정해 성인들과 다른 처우를 명문화하고 있는 것이다. 그중 10가지의 보호처분 중 소년원송치 처분은 8호(1개월 이내의 소년원 송치), 9호(단기 소년원 송치), 10호(장기 소년원 송치)처분으로서 그 기간에 따라 구분해 법률규정에 명시하고 있다.
그러나 이러한 소년원송치 처분들은 국가가 운영하는 소년원시설에 소년들을 수용해 그들을 교육하고 개선시켜 사회로 복귀시키는 것을 가장 중요한 목적으로 인식하고 있다. 하지만 소년들은 성인들에 비해 자신이 행한 행위에 빠른 반성이 이루어질 수 있고, 어떠한 교육과 어떠한 치료를 받느냐에 따라 사회복귀 후 일반 시민으로서 성실한 삶을 살아가게 할 수 있다. 즉, 소년들은 처벌이 아닌 교육을 통한 교화와 개선을 통해 사회복귀가 이루어질 수 있도록 해야 한다. 그러나 교육에 있어서도 소년들에게 실질적인 효과가 발생할 수 있는 교육과 치료 즉, 질적 교육 및 치료가 이루어져야만 실효성을 담보할 수 있다. 이를 위한 방안이 민영소년원 설치라고 할 수 있다.
국영소년원은 국가가 운영하는 시설처우이기 때문에 시설이 갖는 문제점, 소년처우에 대한 문제점 등 여러 문제들이 상존해 있다. 따라서 이러한 문제들을 해결하기 위해 국가가 아닌 민간 인력들에 의한 소년원의 설치가 요구된다. 이러한 소년원의 설치는 그동안 국가에 의해 운영되어온 소년원이 가진 다양한 문제들을 해결하지 않고서는 설치가 이루어진다고 하더라도 합리적인 운영이 될 수 없을 것이다.
그러므로 국영소년원이 가진 문제들을 소년원송치 처분의 다양한 현황분석을 통해 도출해낼 필요성이 있다. 특히, 소년원 수용기간 동안 소년들의 인권보호 문제, 교과교육과정 및 교사인력 문제, 직업교육과정 및 전문 인력 충원 문제, 소년들의 정신병력 및 치료 그리고 치료를 위한 전문 의료 민영소년원 설치 등 다양한 부분들에 대한 논의와 해결방안들을 민영소년원의 합리적 설치를 통해 해결하는 것을 목적으로 삼으려고 한다.

영어초록

The Juvenile Act. states protective measures that focus on education, improvement, treatment, and protection of juvenile offenders rather than punishment-oriented legal provisions, based on ‘Parens patriae(parent patriot)’ which means that nation is a parent. In other words, it acknowledges that juveniles are physically and mentally less mature than adults, therefore the act explicitly states that they are treated differently from adult offenders. Among the 10 protective measures, the juvenile detention center disposition is divided into the disposal No. 8(juvenile detention center disposition within 1 month), No. 9(short-term juvenile detention center disposition), and No. 10(long-term juvenile detention center disposition), and is specified in the legal provisions according to the period.
However, these juvenile detention center dispositions recognize that the most important purpose is make juvenile offenders get in public juvenile detention facilities, educate, improve, and help them return to society. They can quickly reflect on their wrongdoing rather than adults, and depending on what type of education and treatment they receive, they can easily live as ordinary citizens after returning to society. In other words, they should be rehabilitated and improved through education rather than punishment, so that they can be reintegrated into society. For sure, it is necessary to provide education and treatment with effectiveness for them. The establishment of private juvenile detention centers can be considered as a solution.
Since general juvenile detention centers are public facilities, there are some problems such as inadequate facilities and standardized treatment which may not fit every one. Therefore, in order to solve these problems, the establishment of juvenile detention centers by private sectors is expletively required. Even if such private juvenile detention centers are established, they cannot be operated rationally without resolving various problems that public juvenile detention centers have had so far.
Therefore, it is necessary to derive the problems of public juvenile detention centers through various analyses of the current status of them. In particular, the purpose this study is to discuss and resolve various issues through the rational establishment of private juvenile detention centers dealing with the protection of the human rights of juveniles during their detention, the curriculum and teaching staff, the vocational education courses and the recruitment of professional personnel, the mental history and treatment of juveniles, the establishment of private juvenile detention centers for specialized medical treatment, and so on.
