공익신고와 취재원보호의 법적문제 (Legal issues of public interest reporting and reporter protection)

초록

취재원의 보호는 언론자유를 보호하기 위한 수단이며 취재원의 보호 없이 자유로운 정보의 유통은 기대할 수 없다. 또한 언론인의 직업적 의무와 양심이 전제된다면 취재원의 보호는 당연히 보장되어야 할 것이다. 이론적으로 취재원의 보호는 자유로운 언론취재를 보장하며 공익제보자의 보호와 더불어 권력기관에 대한 감시, 국민의 알 권리를 충족함으로써 민주의의 발전의 기초가 될 것이다. 이와 관련하여 신문윤리실천요강은 취재원의 안전이 위험하거나 부당하게 불이익을 받을 위험이 있는 경우 그 신원을 밝혀서는 안 된다고 규정하고 있다. 특히 범죄관련 보도는 제보자의 신상이 공개됨으로 인해 제보자의 2차 피해가능성이 있으므로 제보자의 신상에 대해서는 매우 철저히 보안이 요구되는 사항이다. 뿐만 아니라 공익신고자의 보호는 관련법에 의해 보호되고 있으며 이를 위반할 경우 처벌규정을 두고 있다.
취재원보호의 범위를 직업적이고 전문적인 언론기관과 기자에 한정하고 않고 자유로운 언론 과정에서 폭넓은 보호를 주장하는 견해도 있다. 물론 이는 좀 더 신중히 검토되어야 할 것이다. 취재원의 보호는 입법적으로 대응하는 것이 가장 효과적일 것이다. 이는 잠재적인 제보자와 언론기관 간에 그들의 예측가능성을 보장해 줄 수 있기 때문이다. 그러나 익명보도의 남용, 선정성, 정파성 등의 문제를 보이는 한국 언론의 특성상 취재원을 보호하기 위한 법률이 자칫 그들에게 특권을 누릴 자격에 대한 비판이 있는 것도 사실이다. 취재원에 대한 법령이 존재하지 않더라도 헌법상 보장된 언론의 자유를 통하여 사법행정기관은 취재원을 보호하기 위한 노력을 강구해야 할 것이다.

영어초록

The protection of reporters is a means to protect the freedom of the press, and the free circulation of information cannot be expected without the protection of the reporters. In addition, if the professional duty and conscience of a journalist are presupposed, the protection of reporters should be guaranteed. Theoretically, the protection of reporters guarantees free press coverage and, along with the protection of public interest whistle blowers, will serve as the basis for the development of democracy by monitoring authorities in power and satisfying the people's right to know. In this regard, the Code of Conduct for Journalism Ethics stipulates that the identity of a reporter should not be revealed if the safety of the reporter is in danger or there is a risk of being unfairly disadvantaged. In particular, crime-related reports require very thorough security for the identity of the informant as there is a possibility of secondary damage to the informant due to the disclosure of the identity of the informant. In addition, the protection of public interest whistle blowers is protected by the relevant laws, and there are penalties for violations.
There are also views claiming that the scope of protection of sources is not limited to professional and professional media organizations and journalists, but rather broad protection in the free press process. Of course, this will have to be considered more carefully. It would be most effective to take legal action for the protection of sources. This is because it can guarantee their predictability between potential informants and media agencies. However, due to the nature of the Korean media, which shows problems such as abuse of anonymous reporting, sensationalism, and partisanship, it is also true that the law to protect reporters is sometimes criticized for their right to enjoy privileges. Even if there is no law on reporters, judicial administration should make efforts to protect reporters through the freedom of speech guaranteed by the Constitution.
