미국 감사원의 제도적 특징과 우리나라에의 시사점 ― 감사원과 연방의회의 관계를 중심으로 ― (The institutional characteristics of the US GAO and its implications for Korea — Focusing on the relationship between the GAO and the Federal Congress —)

초록

미국 감사원은 ‘독립적 기관’, 또는 ‘행정부로부터 독립된 미국정부의 기관’으로 설명되고 있다. 미국 감사원은 스스로를 의회를 위하여 일하는 독립적이고 초당파적인 기관, 또는 의회 소속의 감시자로 소개한다. 미국 감사원은 스스로를 의회에 속한 행정기관으로 보고 있다. 그러나 미국 감사원은 여러 가지 점에서 의회에 완전히 소속된 기관으로 보는 것보다 의회를 위해 일하지만 본질적으로 ‘독립적’인 기관으로 보는 것이 적정하다.
미국 감사원장은 공공자금의 지출에 대하여 조사할 권한과 연방정부가 수행한 사업의 성과를 평가하는 권한을 갖는다. 성과평가에 있어 감사원장은 직권으로 평가를 개시할 수도 있고, 의회의 명령 또는 요청에 의하여 평가를 하는 경우도 있다. 상원 또는 하원이 평가를 명령하는 경우에는 평가를 하여야 하고, 그 프로그램이나 활동에 대하여 관할권을 가지고 있는 의회의 위원회가 평가를 요청하는 경우에도 사업평가를 수행하여야 한다.
미국 감사원의 가장 큰 특징은 독립성 유지를 위하여 감사원장의 신분을 강력하게 보장하고 있다는 점이다. 미국 감사원장은 대통령이 지명하고 상원의 자문과 동의를 얻어 임명한다. 즉, 의회와 대통령의 지명ㆍ동의절차를 거쳐야 한다. 후보자 추천을 위해서는 의회에 후보자추천위원회가 구성된다. 동 위원회는 하원의장, 상원임시의장, 상원과 하원에서의 다수당과 소수당의 원내대표, 상원 국토안보행정위원회 위원장과 간사, 하원 정부감시개혁위원회 위원장과 간사로 구성된다. 여기에는 미국 특유의 양당제와 양원제의 요소가 적절하게 반영되어 있다. 미국 감사원장은 임기 15년 동안 재직하고 어떠한 이유에서도 대통령에 의해 해임될 수 없고, 오로지 탄핵 또는 상ㆍ하원 공동의결에 의하여서만 해임될 수 있다. 미국 감사원과 의회의 관계는 「감사원 의회의정서」에 상세하게 규정되어 있다. 동 의회 의정서는 감사원이 의회를 위하여 감사, 정책검사, 정책평가, 정책분석, 조사를 하는데 있어 필요한 일반적 원칙을 규정하고 있다. 감사원장의 권한 중에서 사업평가권한은 의회의 명령, 요청 등을 요건으로 하므로 의회 의정서는 주로 사업평가에 대한 사항을 규정한다. 특히 감사원이 사업평가 업무에 착수함에 있어 우선순위결정의 기준, 의회의 명령이 있는 경우의 업무처리절차, 의회의 요청이 있는 경우의 고려사항 및 업무책임 등에 대하여 규율한다.
우리나라의 현행 제도는 감사원의 독립성을 보장하기에 필요한 대부분의 사항을 받아들이고 있다. 감사원의 소속 변경 논의는 지나치게 거시적이고 형식적인 논의일 수도 있다. 현행 제도 하에서 감사원의 독립성을 보다 강화하려면, 감사원과 국회와의 관계를 보다 긴밀하게 하는 것이 필요하다. 이를 위해서는 미국의 의회 의정서 등 다양한 제도를 통하여 시사점을 얻는 것이 필요하다.

U. S. Government Accountability Office is an independent establishment, or an instrumentality of the U. S. Government independent of the executive departments. GAO introduces itself as an independent, non-partisan agency supporting Congress, or as a Congressional watchdog. GAO sees itself as an legislative-branch agency. However, GAO works for the Congress rather than seeing it as an institution that is wholly affiliated with Congress, but it is appropriate to regard it as an essentially independent institution.
The Comptroller General has the authority to investigate use of public funds and to evaluate the performance of the federal government's programs. In the performance evaluation, the Comptroller General may initiate evaluation ex officio, or may be evaluated by an order or request of the Congress. If the Senate or House of Representatives orders an evaluation, an evaluation shall be made, and a committee of the council, which has jurisdiction over the program, shall conduct an evaluation of the project even if it is requested.
The most important feature of the GAO is that it strongly guarantees the status of the Comptroller General in order to maintain independence. The Comptroller General shall be appointed by the President with the advice and consent of the Senate. Candidate recommendation committees are formed in Congress. The committee consists of the House Speaker, the Senate Temporary Chairman, the President of the House and Senate and the House of Representatives in the House of Representatives and Minorities, the Chairman and Secretary of the Senate Homeland Security Administration Committee, and the Chairman and Secretary of the House Supervision and Reform Committee. There is a proper reflection of the United States' bicameral system and two-party system. The Comptroller General may serve for a period of fifteen years and shall not be dismissed by the President for any reason whatsoever, and may be dismissed only by impeachment or by a joint resolution of the Senate and the House of Representatives. The relationship between GAO and Congress is detailed in the Congressional Protocol. The Congressional Protocol stipulates the general principles required by GAO for auditing, policy inspection, policy evaluation, policy analysis and investigation for the Congress. Since the authority to evaluate the programs among the powers of the Comptroller General is a requirement for congressional orders, requests, etc., the Congressional Protocol prescribes mainly program evaluation matters. In particular, the GAO will regulate the criteria for prioritization, the procedures to be followed if there is an order by Congress, considerations and program responsibilities if requested by Congress.
The current system in our country accepts most of what is necessary to ensure the independence of the BAI. Discussions on the change of status of the BAI may be overly macroscopic and formal. To further strengthen the independence of the BAI under the current system, it is necessary to make the relationship between the BAI and the National Assembly more conciliatory. For this, it is necessary to obtain implications through various systems such as the US Congressional protocol.
