독일연방감사원의 헌법적 의미 - 독일연방감사원에 의한 재정통제와 헌법원리 간 관계를 중심으로 - (Constitutional meaning of the German Federal Audit Office)

초록

독일 연방감사원에 의한 재정통제는 조세를 부과하여 재정수입을 마련하고, 예산을 의결하고, 이를 집행하는 과정에서 국민대표기관인 연방의회, 연방정부가 국민의 정치적 의사에 따라 재정수입을 마련하고, 집행하도록 통제하는 기능을 발휘함으로써 민주주의 원리가 제대로 실현되도록 보장하고 있다. 그러나 연방감사원의 조직과 구성 등 인적･물적 자원의 현실적인 한계 때문에, 다른 한편 연방의회 뿐만 아니라 연방정부로부터의 독립성 때문에, 연방감사원은 실무상 모든 예산집행을 감사하지 않고, 재량으로 감사범위와 감사정도를 정할 수 있다. 이는 다른 한편 감사의 효율성도 보장하는 것으로 이해할 수 있다.
연방감사원의 감사권한은 연방국가원리에서 도출되는 권한의 한계 때문에, 모든 연방예산집행을 감사하지 않는 재정통제의 한계가 있다. 이는 예산고권과 예산독립성과 자주성을 가지는 주(Land)의 국가적 성격을 보장하는 연방국가의 성격상 인정되는 것이다.
재정통제는 예산집행의 합법성을 심사함으로써 법치국가원리를 실현한다. 다만, 헌법상 독립성이 보장되는 기관에 대해서는 헌법보장의 측면에서 헌법기관의 독립성을 침해할 수 있는 엄격한 심사 또는 재정통제가 제한될 수 있다. 이런 독립기관에 대한 연방감사원의 감사는 일반적인 경우보다 완화되는 것을 볼 수 있는데, 이는 다른 국가기관의 헌법적 기능을 보장한다는 측면에서 법치국가원리의 실현이라고 할 수 있을 것이다.
연방감사원의 감사에 의한 재정통제는 효율성이나 경제성심사를 통해서, 국가재정을 가장 효율적으로 운영할 수 있도록 기여한다. 이는 한정된 재원으로 사회적 정의와 사회적 안정 및 실질적 평등을 이루려는 사회국가원리를 실현하는데 가능한 많은 재원을 투입할 수 있도록 돕는데, 이는 사회국가원리를 실현하는데 소극적인 기능을 하는 것이다.
우리 감사원도 국회가 정부의 예산집행을 통제하는데 있어서 효율적인 예산운영을 했는지 평가하는데 필요한 기본 자료를 제공함으로써 헌법상 민주적인 재정통제 기능을 한다. 또한 예산집행의 위법성을 판단함으로써 행정의 법치국가원리를 재정 면에서 실현하는데 기여하고, 예산운영에 대한 효율성을 평가함으로써 사회국가원리를 실현하는데 있어서, 현실적인 재정을 반영하여 효율적으로 사회국가원리가 실현되도록 돕는데 중요한 역할을 한다. 다만, 이러한 감사원의 헌법적 기능이 원활하게 실현되기 위해서는, 대통령으로 대표되는 정부뿐만 아니라 국회로부터도 독립성을 충분히 보장받아야 한다는 전제조건이 실현되어야 한다.

영어초록

Fiscal control by the German Federal Audit Office(BRH) is a major state affair. In the process of preparing fiscal revenues, voting on budgets, and executing them by imposing taxes, the Federal Assembly(Bundestag), the representative bodies of the people, and the federal government(Bundesregierung) exercise the function of controlling the preparation and execution of fiscal revenues according to the political will of the people, ensuring that democratic principles are properly realized. Due to the practical limitations of human and material resources, such as the organization and composition of the BRH, on the other hand, due to its independence from the Bundesregierung as well as the Bundestag, the BRH can determine the scope and degree of audit at its discretion without auditing all budget execution in practice. On the other hand, this can be understood as ensuring the efficiency of the audit.
The auditor's audit authority has limitations in fiscal control that does not audit all federal budget execution because of the limitations of the authority derived from federal state principles. This can be seen as natural due to the nature of the federal state that guarantees the national character of the states(Land) with budget independence. Since Articles 117 and 118 of the Korean Constitution guarantee the autonomy of local governments, the limitations of the audit authority can be considered for the part used for autonomous affairs with the support of the national budget-even in terms of guaranteeing the principle of vertical separation of powers and the local government system.
Fiscal control is a rule of law and realizes the rule of law by examining the legality of budget execution to ensure the legitimacy of administration. However, strict screening or financial control that may infringe on the independence of constitutional institutions in terms of constitutional security may be restricted for institutions that guarantee constitutional independence. The BRH's audit of these independent institutions is more relaxed than in general, which can be said to be the realization of the rule of law in terms of guaranteeing the constitutional function of other state agencies. However, the limitations of fiscal control due to the federal state principle and the rule of law do not immediately recognize the areas free from the exclusion or control of fiscal control. Financial control is not excluded, but the degree of control is reduced.
Fiscal control by the audit of the Federal Audit Office contributes to the most efficient operation of state finances through efficiency or economic evaluation. This helps to invest as much money as possible in realizing the social-state principle that seeks to achieve social justice, social stability, and practical equality with limited resources, which plays a passive role in realizing the social-state principle.
