경찰공무원 복무선서 개선방안 연구 (Study on the Improvement of The Service Oath for Korean Police Officers)

초록

현행 「국가공무원법」상 경찰공무원은 법관·검사·군인·국가정보원직원 등과 함께 ‘특정직공무원’에 속한다. ‘특정직공무원’은 담당 직무가 특수하기 때문에 그에 필요한 자격이나 복무규율 등에서 특수성을 인정할 필요가 있다. 따라서 ‘특정직공무원’은 연구·기술 및 일반 행정을 담당하는 ‘일반직공무원’과 따로 구분되며 개별법이 우선적으로 적용된다.
특히 경찰공무원은 제복착용 및 무기를 소지하고 물리력을 행사할 수 있고, 경찰권 행사는 주로 명령적·권력적 강제작용이기 때문에 항상 인권 침해의 우려가 있다. 따라서 경찰권은 그 직무수행에 필요 최소한도 내에서 행사 되어야 하며 절대 남용되어서는 안된다, 이와 같이 ‘특정직공무원’인 경찰공무원은 그 신분·임무·근무조건 및 책임성의 측면에서‘일반직공무원’과 다른 특수성이 있는 것이다.
그런데 경찰공무원은‘특정직공무원’임에도 불구하고,‘복무선서’의 내용은 지난 37년간 ‘일반직공무원’과 동일하다. 이에 비해 다른‘특정직공무원’인 법관·검사·군인·국가정보원직원등의 경우에는 이미 수년전부터 해당 기관의 직무 특성에 맞는 별도의 ‘복무선서’를 제정하여 시행중이다. 미국·영국·일본 등 외국경찰의 ‘복무선서’에도 그 직무특성에 적합한 용어가 사용되고 있다.
한편 2020년 2월 「형사소송법」이 개정되어 사법경찰관은 종전에 검사의 ‘보조기관’에서 이제‘1차적 수사 종결권’을 가진 ‘수사의 주체’가 되었다. 따라서 오늘날 한국 경찰은 법적·현실적으로 대폭 변화한 조직의 위상에 걸맞게 종전보다 한 차원 높은 수준의 치안서비스를 국민들에게 제공해야 할 역사적 전환기에 와 있는 것이다. 이러한 대 변혁기를 맞이한 한국경찰이 국민의 신뢰를 받는 조직으로 탈바꿈하기 위해서는 여러 가지 법적·제도적 혁신대책을 적극 발굴·추진해야 한다. 또한 경찰공무원 개개인의 윤리의식 고양을 위한 상징적 개선 대책도 요구된다. 그런 맥락에서 본 논문에서는 이번 기회에 현행 경찰공무원‘복무선서’의 내용을 대폭 개선해야 할 필요성을 검토하고 그 대안을 모색하였다.
새로운 경찰공무원‘복무선서’에는 오늘날 한국 경찰이 추구해야 하는 핵심가치와 국민의 요구가 충분히 반영되어야 한다. 경찰의 핵심가치는 「경찰공무원복무규정, 「경찰청범죄수사규칙」등 관련법령과‘경찰헌장’,‘인권경찰 다짐문’등에 포함되어 있으므로 이를 고려하고, 미국·영국·일본 등 외국 경찰의 ‘복무선서’내용도 참고하는 게 바람직하다.
아울러 경찰공무원‘복무선서’개선방안 추진 과정에는 관련 법령 검토와 함께 자체 시안에 대한 전문가들의 자문을 거친 후 최종적으로는 대국민 공청회 등을 통하여 절차적 정당성을 반드시 확보해야 할 필요가 있다.
그러므로 경찰청에서는 한국경찰의 면모를 쇄신시킬 수 있는 법적·제도적인 혁신 방안을 지속적으로 추진해 나가되, 무엇보다 현행 경찰공무원 ‘복무선서’의 혁신적인 개선방안을 적극 모색해 주기를 재안하는 바이다.

영어초록

Under the current National Public Officials Act, Police officers belong to 'specific public officials' along with judges, prosecutors, soldiers, and National Intelligence Service employees. Since the duties of the ‘specific public official’ are special, it is necessary to recognize the specificity in the qualifications and service regulations necessary for them. Therefore, 'specific public officials' are different from 'general public officials' who are in charge of research, technology and general administration, and the specially designed individual laws are applied first.
In particular, Police officers wear uniforms and weapons and exercise physical force, and police rights are mainly ordered and power-forced, so there has been the concerns about human rights violations all the time. Therefore, Police authority should be exercised at least in the minimum necessity for the performance of its duties and should not be abused. In this way, Police officers who are 'specific public officials ' have special characteristics of the job different from 'general public officials' in terms of their status, duties, working conditions and accountability.
However, despite the fact that police officers are 'specific public officials', the contents of 'service oath' have been the same as 'general public officials' for the past 37 years. In contrast, judges, prosecutors, soldiers, and National Intelligence Service employees, who are other "specific public officials," have already enacted and implemented their own separate "service oath" that matches the characteristics of the agency's duties several years ago. Terms that match the characteristics of the job are also used in the service oath of foreign police such as the United States, the United Kingdom, and Japan.
Meanwhile, the Criminal Procedure Act was revised in the February 2020, and the judicial police officer became the subject of the investigation with the right to terminate the primary investigation from the status 'auxiliary agency' of the prosecutor. Therefore, today, Korean police are in a historical transition period to provide a level of security service to the people, which is higher than before, in line with the status of the organization that has changed legally and realistically. In order for the Korean police to transform into the organization that is trusted by the people, various legal and institutional innovation measures should be actively explored and promoted. Also, symbolic improval measures are required to raise the ethical consciousness of police officers. In this context, this study reviewed the necessity of greatly improving the current police officer' service oath' and sought an alternative.
The new police officer' Service oath' should fully reflect the core values ​​and the needs of the people that Korean police should pursue today. The core value of the police is included in the related laws such as the Police Officer Service Regulations, the Police Agency Crime Investigation Regulations, and the Police Charter and the Human Rights Police Commitment. Therefore, it is desirable to consider the above laws and refer to the contents of service oath of foreign police such as the United States, the United Kingdom and Japan. In addition, in the process of promoting the new police officer' ’service oath', it is strongly recommended to review the related laws and consult with experts on its own drafts, and finally to secure procedural legitimacy through public hearings.
The Korean National Police Agency is suggested to continue to promote legal and institutional innovation measures that can renew the status of the Korean police, but most of all, it is expected to actively seek ways to dramatically improve the contents of the current police officer' service oath'.
