일선공무원의 재량행위(裁量行爲) 원인에 관한 비교 연구: 복지공무원과 규제공무원을 중심으로 (A Comparative Analysis of the Causes of Street-level Bureaucrats’ Discretionary Acts: Between Welfare and Regulatory Bureaucrats)

초록

본 연구의 목적은 일선공무원의 재량행위 원인을 복지공무원과 규제공무원을 중심으로 비교 분석하려는 것이다.
이를 위하여 우선 일선공무원 재량행위의 개념, 장･단점, 원인 등과 관련한 이론적 논의를 행하고 관련 선행연구를고찰하였으며, 이를 토대로 일선공무원의 재량행위의 원인을 분석하기 위한 연구 틀을 설정하였다. 다음은 일선공무원의 재량행위 원인을 시군구의 복지공무원과 규제공무원에 대한 면접조사 결과를 토대로 심층 분석하였다. 원인변수는 업무환경 요인, 업무특성 요인, 법규 및 지침 요인, 조직특성 요인, 인적 요인이라는 다섯 가지를 선정하였다. 연구결과, 각 요인들이 일선공무원의 재량행위에 중요한 영향을 미침을 확인하였다. 그러나 각 원인변수에 따른 재량행위의 여부, 정도, 방식에서는 복지공무원과 규제공무원 간에 일정한 차이가 있었다. 대체로 복지공무원과규제공무원 모두 업무수행과정에서 재량의 여지는 크지만, 재량행위를 하는 데서 소극적이었다. 규제공무원의 경우가 더욱 그러하였다. 이는 이들이 내부감사 지적, 항의 및 민원제기, 단체장 및 상급자의 질책 등에 대해서 보다 민감하기 때문일 것이다. 그런데 재량행위는 오남용이 물론 문제이지만, 의도적 회피 내지는 지나친 소극성 역시 문제가 됨을 지적하였다. 마지막으로는 실증분석 부분에서 행해진 재량행위의 원인 및 실태를 종합적으로 토의하였다.

영어초록

The purpose of this article is to comparatively analyze the causes of street-level bureaucrats’ discretionary acts between welfare and regulatory bureaucrats. To this end, the article first conducted theoretical debates on the concept, merits and demerits, and causes of discretionary acts and then examined the previous studies on the discretionary acts of street-level bureaucrats.
The article established the analytical framework to guide empirical analyses in following chapters. The next chapter delved into the causes of street-level bureaucrats’ discretionary acts through the in-depth interview with the welfare and regulatory bureaucrats in city and municipal governments. Five influence factors of work environment, task characteristics, laws and rules, organization characteristics, and human factor are employed for the analysis of discretionary acts. As a result of investigation, this article confirmed each factor exerts important influences on the discretionary acts of street-level bureaucrats. However, there is significant difference between welfare and regulatory bureaucrats in terms of the level and method of discretionary acts for each influence factor. In general, although both welfare and regulatory bureaucrats have wide leeway of discretion in the process of performing their tasks, they are passive in exercising discretion. Regulatory bureaucrats are even more so, because they are more sensitive to internal inspection, protests, filing a complaint, and reprimand from superiors. This article pointed out that both the abuse (or misuse) and evasion (or excessively passive exercise) of discretionary acts can be undesirable. Final chapter conducted a comprehensive discussion on the causes and underling problems of the discretionary acts by street-level bureaucrats.
