원전의 인허가 규제 관련 쟁점과 과제 - 울진 신한울 3·4호기 건설 중단 사례를 중심으로- (Issues and challenges on licensing nuclear power plants - Focusing on the Case of Suspension of Construction of Shinhanul Units 3 and 4 in Uljin -)

초록

원전 건설사업은 문재인정부의 탈원전정책으로 중대한 위기에 직면하였다. 신고리 5·6호기는 공론화위원회의 권고대로 건설을 재개하게 됐지만 울진 신한울 3·4호기와 영덕 천지 1·2호기 건설계획은 백지화됐다. 울진과 영덕 등 원전건설 예정지역과 주민들은 경기침체, 일자리 박탈, 재산권 침해 등으로 인한 불이익을 감내해야 했다. 문재인정부의 탈원전정책은 독일을 비롯한 일부 국가들의 에너지전환 흐름에 동참하기 위한 것으로 대통령선거 공약 형태로 제기된 것으로, 오랜 시간 유지되어 왔던 국가에너지정책의 근간을 변경한 일대 사건이며, 산업적, 에너지안보적 측면에서 바람직한가에 대해서는 논란이 있다.
러시아의 우크라이나 침공으로 러시아의 천연가스에 의존하며 에너지전환(탈원전, 탈석탄)을 선도했던 독일은 에너지안보면에서 중대한 약점을 노출하면서 원전재가동 여부를 둘러싸고 극심한 혼란을 겪고 있음은 우리에게 주는 시사점이 적지 않다고 생각한다. 최근의 대세는 탈원전이 아니라 원전의 안전한 활용으로 볼 수 있다. 우리나라는 에너지 부존자원이 절대적으로 부족하고 에너지의 95% 이상을 해외에서 수입하는 외국과의 전력망 연결이 어려운 에너지안보 환경에 놓여 있는 상황이다. 우리나라가 원전을 포기하게 되면 에너지 공급안정성을 확보할 수 없게 되고 이는 에너지안보 측면에서 심각한 문제를 야기하기 때문이다.
전력수급기본계획 수립시 발전사업자에게 의향서를 제출받아 발전 허가 여부를 사전심사한 후 전력수급기본계획에 반영하도록 하고 있다. 즉, 원자력발전소 건설 인허가절차에서 전력수급기본계획에 원전 신규건설이 반영되면, 한수원(주)이 건설기본계획을 수립하고, 환경영향평가를 실시한 뒤, 전원개발촉진법 제5조에 따른 전원개발사업실시계획승인 신청을 하고, 건설허기신청을 하여 원전 건설허가를 받는다. 이와 같은 법령 규정은 전력수급기본계획의 법적 구속력을 분명히 하고 있다는 견해도 있다.
서울행정법원은 2020.1.10. 선고 2018구합53344 판결(전력수급기본계획취소)에서 전력수급기본계획이 항고소송의 대상인 행정처분에 해당하지 않는다는 이유로 각하판결을 하였다. 8차 전력수급기본계획에 따른 건설 백지화 및 건설 중단은 원전 협력사, 원자력기자재 제조업체 및 납품업체, 원자력 방사선안전관리 용역업체, 원전 주변지역 상인 등 국민의 권리·의무에 직접적이고 구체적인 영향을 끼치는 것으로 볼 수 있다. 생각건대, 전력수급기본계획은 전기사업에 관한 각종 계획을 수립하기 위한 행정기관의 내부적인 지침으로서 행정기관만을 적용대상으로 하는 것이 원칙이지만, 제8차 전력수급기본계획의 경우에는 계획이 수립된 것만으로 곧바로 개인의 권리·의무관계에 구체적인 영향을 미친다고 볼 수 있으므로 처분성을 인정하는 것이 옳다고 본다. 특히 전력수급기본계획 중 “3. 발전설비계획 및 주요 송전ㆍ변전설비계획에 관한 사항”은 사업자에게 구속력이 있다고 보아야 한다. 판례도 비구속적 행정계획이나 행정지침이라도 국민의 권리·의무에 직접적으로 영향을 끼치는 경우에는 항고소송의 대상이 될 여지가 있다고 보고 있다.
신한울 3·4호기 건설 재개의 핵심은 환경영향평가라고 할 수 있다. 신한울 3·4호기는 2016년 환경영향평가를 받았지만 문재인정부의 탈원전정책으로 건설이 중단되면서 평가 시효는 2021년 8월 종료됐다. 그러므로 법적으로 환경영향평가를 다시 실시하는 것이 타당하다. 원칙대로라면 환경영향평가를 원점에서 다시 진행하는 게 맞지만, 신한울 3·4호기의 경우에는 정부의 건설 중단 결정으로 모든 절차가 중지되었으므로 귀책사유가 정부에 있고 사업자에 있는 것이 아니다. 그리고 환경영향평가는 해당 사업이 환경에 미치는 영향을 미리 조사ㆍ예측ㆍ평가하여 해로운 환경영향을 피하거나 제거 또는 감소시킬 수 있는 방안을 마련하는 것이기 때문에 신한울 1·2호기와 신한울 3·4호기가 동일한 부지에서 건설되는 점을 감안하면 해당 사업이 환경에 미치는 영향도 사실상 거의 동일하다고 볼 수 있기 때문에 환경영향평가의 목적에 부합한다고 볼 여지가 있다고 생각한다. 다만, 기간 단축이 허용된다고 하더라도 사회갈등시설인 원전이 본질적으로 내포하는 위험성 및 대립되는 주민수용성을 고려하여 환경영향평가법의 취지에 부합하도록 적극적으로 노력하여야 할 것이다. 입법론적으로는 환경영향평가법에 제32조의2(재협의의 예외)를 신설하여 신한울 3·4호기와 같이 사업 중단사유가 정부책임이 명확하고 사업자의 귀책사유가 아닌 경우 그리고 동일 부지에 동일한 사업의 환경영향평가가 이미 이루어져 활용가능한 경우에는 재협의의 예외를 인정하는 방안을 검토할 필요가 있다.

영어초록

The nuclear power plant construction project faced a major crisis due to the Moon Jae-in government's nuclear power plant policy. Construction of Shin-Kori Units 5 and 6 was resumed as recommended by the Public Deliberation Committee, but plans to build Shin-Hanul Units 3 and 4 in Uljin and Cheonji Units 1 and 2 in Yeongdeok were nullified. As a result, residents of areas scheduled for nuclear power plant construction, such as Uljin and Yeongdeok, had to endure disadvantages due to economic downturn, job loss, and infringement of property rights. The Moon Jae-in government's policy of nuclear power plant was raised in the form of a presidential election pledge to join the energy conversion trend of some countries, including Germany. This was a big event that changed the basis of the national energy policy that had been maintained for a long time, and caused controversy over whether it was desirable or not in terms of industrial and energy security.
Korea is a country with absolutely insufficient endowed energy resources, where it is importing more than 95% of its energy from abroad, and where it is difficult to connect to the power grid with foreign countries. If Korea gives up nuclear power, it will not be able to secure a stable energy supply. It can cause serious problems in terms of energy security.
Permission for nuclear power plant construction is related to the Basic Plan for Electricity Demand and Supply(BPEDS). Establishing the BPEDS, K-Water gets intent documents from power producer, and reviews whether or not to permit generation, then, it is reflected in the BPEDS.
In other words, when a new nuclear power plant construction is reflected to the BPEDS in the licensing proceedings for construction of nuclear power plants. K-water establishes a basic construction plan, conducts an environmental impact assessment, and then applies for approval of the power source development project execution plan in accordance with Article 5 of the Power Source Development Promotion Act, finally receives a construction permit of the nuclear power plant.
Seoul Administrative Court dismissed the appel because BPEDS was not the object of the appeal under the administrative disposition in the Decision 2018Guhap53344 Decided January 10, 2020. In the case of the 8th BPEDS, it is reasonable to admit its disposability because it can affect specifically individual rights and obligations immediately by just the plan was established.
In principle, the BPEDS is an internal guideline for administrative agencies to establish various plans for electricity business, and is applicable only to administrative agencies. However, the cancellation of construction and suspension of construction according to the 8th BPEDS can be seen directly and concretely to affect the rights and obligations of the people, such as nuclear power plant partners, nuclear equipment manufacturers and suppliers, nuclear radiation safety management service companies, and merchants in the vicinity of nuclear power plants.
The point to resuming the construction of Shin Hanul Units 3 and 4 is the environmental impact assessment. Shin Hanul Units 3 and 4 received an environmental impact assessment in 2016, but the evaluation period ended in August 2021 as its construction was halted due to the Moon Jae-in government's policy of nuclear power plant. Therefore, it is legally appropriate to conduct the environmental impact assessment again. In principle, it is correct to proceed with the environmental assessment again from the beginning. However, in the case of Shin Hanul Units 3 and 4, all procedures were suspended due to the government's decision to suspend construction, so there attribute a fault to the government. In addition, environmental impact assessment is to prepare measures to avoid, eliminate or reduce harmful environmental impacts by investigating, predicting, and evaluating the impact of the project on the environment in advance. Considering that Shin Hanul Units 1 and 2 and Shin Hanul Units 3 and 4 are built on the same site, the impact of the project on the environment is almost the same, so the purposes of the environmental impact assessment on both sides are also met.
From a legislative point of view, it is necessary to review a plan to recognize exceptions to renegotiation by newly establishing Article 32-2 (exception to renegotiation) in the Environmental Impact Assessment Act, if the reason for the project suspension is clearly the government's responsibility such as Shinhanul Units 3 and 4, and if the environmental impact assessment has already been done on the same site and can be used for the same project.
