선거구제도에 관한 새로운 試論 ― 소위 도농복합선거구제의 수용가능성 논의 ― (A Study on Commentary on the new electoral district system ― The possibility of the so-called Urban & Rural Complex election district ―)

초록

대한민국은 국민의 대표를 선택하는 데 있어 국회의 경우 소선거구 다수대표제를 채택하고 있다. 그리고 지방의회에는 중선거구제를 가미하고 있다. 그러면서 이러한 선거구제도하에서 각 선거구의 투표가치에 평등원칙 위반이 꾸준한 헌법적 쟁점이 되어왔다.
우리나라는 헌법 제11조 제1항, 제24조, 제41조 제1항에서 평등선거 원칙을 선언하고 있다. 이러한 평등선거의 원칙은 투표의 성과가치의 평등도 요구하고 있다. 따라서 선거구획정에서는 이 평등선거의 원칙에 비추어 ①선거구의 인구편차가 지나치게 심한 경우, ②선거구획정의 자의적인 경우 위헌이 될 수 있다.
따라서 대한민국은 이러한 평등선거 원칙과 국회의원선거에서 소선거구 다수대표제를 채택하고 있기 때문에, 선거구에 따라 인구의 유동에 의해 통․폐합되거나 해당 공직선거법 선거구획정표가 헌법재판소로부터 평등선거 원칙 위반으로 결정되기도 하였다. 즉, 도시로의 인구집중으로 농어촌의 인구가 줄어들면 선거구는 끊임없이 재조정을 해야 하는데, 여기에는 도․농간의 대표성의 차이 등을 반영할 여지는 없다. 미국에서 단일선거구제가 다수의 지지를 받는 다수대표 외에 비중 있는 다른 후보자는 실질적으로 유권자를 대표하는 다음 순위 대표의 원내진입을 막는다는 헌법적인 문제의식이 헌법적 쟁송으로 다투어진 바가 있다.
외국에서도 소선거구 다수대표제만을 고수하지 않고 중대선거구를 다양하게 적용하고 있는 나라가 많고, 우리 지방의회 의원 선거에서도 중선거구를 일부 수용하고 있다. 선거구획정에는 1차적인 기준인 인구 외에도 2차적인 기준으로서 주민의 생활경제권과 행정구역, 지세․교통 등 생활권, 기존 선거구 현황 및 향후 조정 가능성이 고려될 수 있어야 한다. 이러한 논의의 하나로 정치권에서는 일찍이 도농복합선거구제의 필요성이 제기 되어왔다. 이미 정치학계에서는 소선거제구가 지역주의를 고착화해서 영남과 호남에서 각기 지역 기반을 둔 정당의 대표 1인만이 의원으로 당선되는 현실에 대하여 오랫동안 비판해왔다.
우리나라에서는 인종차별과 같은 헌법적인 차별이 사회에 만연하고 있지는 않지만, 도시와 농어촌의 사회적 격차는 날이 갈수록 심각해지고 있다. 따라서 선거구획정에서 헌법상 평등의 원칙을 지키고 자의적인 선거구획정을 방지하는 범위 안에서 새로운 선거구 제도에 대한 모색도 의미가 있다고 생각한다. 그 중에, 지역적인 대표성에 차이가 없는 대도시에는 중․대선거구제를 도입하고, 농어촌의 경우 해당 지역의 특색을 고려할 수 있는 소선거구제의 복합적 채용도 헌법의 허용범위에서 고려해 볼 만한 것 같다.
다만 이러한 복합선거구제도가 평등선거의 원칙에 반하지 않도록 하면서도, 선거구가 늘지 않도록 하는 고려가 있어야 하며, 게리맨더링의 사전 차단이 선행되어야 함은 물론이다. 현행 선거제도가 정말 국민의 의사를 반영하여 대표를 선출하는데 충실한지 재검토하고 국민의 의사를 가장 잘 반영할 수 있는 새로운 제도적인 구상은 계속되어야 할 것이다.

영어초록

The Korean legislative body uses a single-member electorate constituency system. However, for the rural legislative, it uses multi-seat constituency system. The use of these districting systems based on their respective populations has led to a constitutional debate regarding their equality under a one-person, one-vote system.
In recent years, because of an influx of people into the cities, rural provincial electoral districts are being integrated into larger districts. Because the representatives must serve their constituencies, several problems arise from the redistricting process that expands their district boundaries and voter base to include the surrounding rural populations.
Article 11 (1), Article 24, and Article 41 (1) of the Korean Constitution declare the principles of equality in the electoral process. This principle also ensures the equal worth of every vote. In light of these principles, it may be unconstitutional to redistrict considering ① the high deviation of the population and ② arbitrary redistricting, also known as gerrymandering. Based on these principles of equality, the Republic of Korea has opted for a small electoral majority representation system, and has begun to integrate rural electoral districts according to the flow of population.
In other words, due to the constant increase in the population in cities and the decrease in the population of rural provinces, congressional districts need to constantly readjust their representational weights according to the change in population. However, that is not necessarily happening in the current situation.
In the United States, the use of gerrymandering in redrawing electoral district boundaries has led to a power grab, where the dominant representatives are able to effectively block opposition candidates from getting elected.
Many foreign countries do not adhere to the small electoral majority representation system, and Korea has also partially adopted a medium constituency in local council elections,Redistricting should be carried out with consideration not only to the primary standard of population, but also secondary standards based on local economics and administration concerns including topography, traffic, the existing electoral district and future potential for change.
As part of these discussions, some politicians have insisted on using Urban and Rural Complex electoral district types, based on the populations they represent. Discrimination and racism are not rampant in this society but the socio-economic gap between urban and rural areas is widening day by day. The political hardening of regionalism is felt more and more keenly between urban and rural areas as time goes on. Therefore, it’s important to adhere to the constitutional principles of equality and to avoid arbitrary redistricting for political gain (gerrymandering). Using the different types of the so-called Urban and Rural Complex election districts, Korea can accommodate its changing populations in a fair and balanced way.
However, it should be noted that this complex constituency system not be contrary to the principles of equality; the electoral system should reflect the will of the people, but we should be cautious not to create too many new districts, or allow anyone to manipulate the district boundaries for an unfair political advantage.
