새로운 양형환경에서 양형조사제도의 정착방안에 관한 연구 (A Study on the Settlement Scheme of Sentencing Investigation in New Sentencing System)

초록

국민의 사법부에 대한 불신풍조를 해소하기 위해 법관이 재판에 참고할 수 있는 구체적이고 객관적인 양형기준을 설정하도록 하는 양형기준제도가 2009년 7월 1부터 시행되고 있다. 합당하고 적정한 형이 선고되게 하기 위해서 보다 정확하고 상세한 양형자료의 제출과 합리적인 검증이 전제되어야 하는데 양형조사제도가 이러한 양형에 대한 불만을 해소하는데 도움이 될 것이다. 양형조사제도란 양형에 필요한 범죄인의 인격과 환경에 대한 정확한 자료를 충분히 조사함으로써 가장 합리적 형사제재 수단을 선택하여 양형의 적정성을 모색하고, 객관적이고 구체적인 양형의 결정은 향후 형 집행 단계에서 개개인에 적합한 형 집행을 위한 기초 자료로 활용하고자 하는 것을 말한다. 양형조사제도의 합리적인 방안을 마련하기 위해 외국의 양형조사제도에 대해 살펴보면, 영미법계에서 양형에 관한 조사는 유죄인정 절차와 양형절차가 분리 되어 있어서 대부분 판결전조사제도를 활용하여 보호관찰관이 조사하고, 대륙법계에서 양형에 관한 조사는 유죄인정 절차와 양형 절차가 분리되어 있지 않아 판결전조사 뿐만 아니라 사법보조제도 등 독자적인 제도를 마련하여 시행한다. 양형기준제가 그 목적을 효과적으로 달성하기 위하여 양형조사의 방법과 절차에 관한 명확한 법적 근거를 형사소송법에 마련하는 것이 바람직할 것이다. 먼저 양형조사의 주체를 누가 할 것인지에 관하여 현재 시행되고 있는 법원 소속으로 하여 담당하는 방안과 보호관찰관이 담당하는 방안이 고려될 수 있다. 조사의 공정성과 객관성을 가지기 위해 조사관이 조사한 결과물을 법정에 제출하여 양형심리를 하는 과정에서 양 당사자의 의견을 들은 후에 재판장이 독립하여 양형에 반영하는 방법으로 이루어지기 때문에 재판부, 검찰 등으로부터 독립적이면서 조사과정에서 전문지식을 잘 활용하여 업무를 수행할 수 있는 보호관찰관이 하는 것이 바람직하다고 할 것이다. 양형의 불공정을 개선하여 국민의 법감정에 맞는 합리적인 양형판단을 하기 위하여 양형조사의 주체에 관한 내용뿐만 아니라 올바른 양형판단을 위한 양형조사의 방법 등에 관하여 관심을 가질 필요가 있다. 이에 양형조사의 시기 및 방법에 대하여 양형의 공정성과 효율성의 측면에서 바람직한 정착방안도 제시하였다. 이와 같이 양형조사제도를 합리적으로 운용함으로써 양형의 공정성과 신뢰도를 높이게 되어 국민들의 사법 신뢰를 높이는 계기가 될 것이고, 또한 선진사법의 기틀을 갖추는데 일조하게 될 것이다.

영어초록

In order to eliminate the wave of distrust of the people for the judiciarybranch, the sentencing guidelines system which enables the judge to select thespecific and objective sentencing guidelines that can be referenced for the trialhas been enforced as of July 1st 2009. In order to pronounce an appropriate andreasonable sentencing, it should be on the premise of a submission of moreaccurate and detailed sentencing documents with a reasonable verification, andthe sentencing investigation system should be helpful in resolving the complaintsfor such sentencing. The sentencing investigation system means, a sufficientinvestigation of an accurate documents on the character and the environment ofan offender which are required for sentencing in order to seek the adequacy ofsentencing by selecting the most reasonable means of criminal sanctions and thedecision on the objective and specific sentencing can be utilized as basicdocuments for the execution of a sentence that are appropriate for the eachindividual during the future sentencing phase. Looking at the sentencinginvestigation system of other countries in order to find a reasonable plan for thesentencing investigation system, the related investigation on the sentencing in thelegal system of England and America shows a separate procedures for a plea ofguilty and sentencing, therefore it was mostly investigated by the probationofficers utilizing the pretrial investigation system, however the investigation onthe sentencing in the continental legal system does not separate the proceduresfor a plea of guilty and sentencing therefore not only for pretrial investigationbut for the judicial protection system, an independent system is established andcarried out. For the sentencing guidelines to effectively achieve its objectives, itwould be desirable to establish a clear legal basis for the methods andprocedures of the sentencing investigation on the criminal procedure law. First, to determine who will be in charge of the sentencing investigation, two ways canbe considered; the court where it's currently being implemented or the probationofficers. In the course of the sentencing hearing, the investigator submits theexamined results to the court in order to have the fairness and objectivity of theinvestigation and after hearing the opinion from the each party, the judge willthen reflect the results to the sentencing independently therefore it is deemedappropriate to be performed by the probation officers who is able to utilize theexpertise during the course of the investigation independently from court and theprosecutor. By improving the unfair sentencing to make the reasonable sentencingjudgement that is appropriate to meet the feelings of law of the people, not onlyon the issues related to the subject of the sentencing investigation but anattention should be paid on the method of sentencing investigation, proceduresand evaluation which are required for proper sentencing. Therefore, by looking atprevious amendments to the existing criminal procedure law, many problems andsupplement points were investigated. And for the period and subject of thesentencing investigation, methods and procedures for the sentencing investigation,alternatives in terms of fairness and efficiency of the sentencing was proposed.
Thus, by operating the sentencing investigation system rationally, it will increasethe fairness and reliability of the sentencing which will be a chance to increasethe confidence of the people for justice and will serve as a foundation for anadvanced jurisdiction.
