초록

이 연구에서는 현행 법령에 벗어나지 않는 범위에서‘자유발행형 인정도서’라는 이름으로 기존 인정도서의 범주에 묶여있는 교과용도서 제도를 본격적인 자유발행도서 도입을 위한 교과용 도서 관련 법령 개정 방안을 모색하는 데 연구의 목적을 두고 있다. 연구의 주요 내용 및 결과는 다음과 같다. 첫째, 「초․중등교육법」 제29조에 있는 국정·검정·인정 도서라는 용어를 자율형과 심사형 도서로 조문을 수정하여야 하며, “~사용하여야 한다.”로 명기된 강행규정 또한 임의규정으로 바꾸어야 한다. 둘째, 「교과용도서에 관한 규정」 제2조에 국정도서, 검정도서, 인정도서에 대하여 정의한 4호. 5호, 6호를 자율형 도서와 심사형 도서에 대한 정의로 새롭게 내려야 한다. 셋째, 「교과용도서에 관한 규정」 제26조에 심사형 도서의 수정권자로 교육부장관, 자율형 도서의 수정권자로 당해 교육감을 명시하고, 아울러 교과용도서의 질 관리에 관한 항을 새롭게 신설할 필요가 있다.

영어초록

The textbook policy based on national management has played an important role in promoting equal opportunities and stabilizing the foundation and quality of education through systematic development and a stable supply of textbooks. However, government-initiated textbooks have disadvantages regarding uniformity of teaching, control of knowledge, and difficulty in responding flexibly to changes in the external environment. Therefore, it is necessary to improve the current government-designated, government-authorized, and government-approved publication systems to enhance autonomy, creativity, democracy, etc. Ultimately, a restructured system needs to be institutionalized through the readjustment and improvement of relevant statutes. Key findings are as follows.
First, for policies for enhancing the autonomy of textbooks and introducing a free-publication system, the relevant statutes need to be accompanied by revisions. To institutionalize the method of restructuring the publication system presented, a complete revision of Article 29 of the Elementary and Secondary Education Act is inevitable. The terms such as government-designated, authorized, and approved should be amended with the concept of free-publishing and screening-type. The enforcement of regulations stipulated must also be amended with expressions such as '~must be'. Second, the current "Regulations on Textbook" under the Presidential Decree consists of eight chapters and 41 articles, ranging from the general provisions of Chapter 1 to the delegation of Chapter 8. In Article 2, the definition of government-designated, authorized, and approved textbooks should be deleted, and amended as free-publication and screening type textbooks. Third, it is necessary to consider legalizing the educational system, focusing on the textbook system's primary and key points, delegated by the Elementary and Secondary Education Act.
