국내외 아동보호전문기관과 노인보호전문기관의 운영체계 고찰을 통한 개선방안 연구 (Domestic and foreign child protection organizations and senior protection organizations Research on improvement plans through operating system review)

초록

최근 인권에 대한 사회적 인지도가 높아져 모든 분야에서 인권이 존중되고 인권의식이 증진되는 움직임이 일어나고 있다. 1세대 인권으로 개인의 자유를 중심으로 하는 시민적·정치적 권리, 2세대 인권으로 평등과 관계되는 경제·사회·문화적 권리, 3세대 인권으로는 인류를 하나로 묶어주는 연대권으로 대표되는 인간다운 생활을 할 권리에 대하여 표명하고 있다. 그러나 가정 내에서 혹은 시설에서 발생되는 사회적 약자인 아동과 노인에게 가해지는 학대는 인권침해의 극명한 형태로 나타난다. 특히 최근 COVID-19라는 팬더믹으로 인해 가정에서 발생하고 있는 아동학대와 노인학대 관련한 사례는 역기능적인 가족의 경우 학대의 양상으로 기능하여, 과거에는 볼 수 없던 학대 발생률 증가와 잔인함으로 나타나고 있는 실정이다. 본 연구는 비인권적인 학대상황에 대응하여 아동과 노인의 인권을 옹호하는 업무를 전담하고 있는 우리나라의 아동보호전문기관과 노인보호전문기관의 현행 법·제도에 기반 한 운영체계에 대하여 검토하고 아동과 노인의 보호에 있어 자리매김하고 있는 외국의 개입 절차와 운영체계 등에 대하여 고찰하였다. 이 과정을 통해 아동과 노인이 학대로부터 벗어나 보호받고, 인권을 바탕으로 한 인간다운 삶을 유지하기 위해 위기상황에 개입하고 있는 우리나라의 아동보호전문기관과 노인보호전문기관의 개입과정의 문제점을 살펴보고 개선방안을 제시하였다. 아동학대와 노인학대와 관련하여 우리나라의 아동보호전문기관과 노인보호전문기관의 개입과정에서 학대피해의 대상인 아동과 노인이 보호되지 못하는 운영체계의 문제점을 확인하였다.「아동학대범죄의 처벌 등에 관한 특례법」의 개정으로 2020년부터 아동학대전담공무원이 신고접수, 현장조사, 사례판정에 이르기까지 업무를 담당하게 되었는데, 법적으로 판단하는 범죄의 범위와 아동학대로 판단하는 학대의 범위가 다르기 때문에 학대행위자에게 상담과 교육 등을 의무적으로 받게 하는 명령을 내리는데 한계가 있다는 것을 확인하였다. 또한 피해노인에 대한 인권을 옹호하고자 설립된 노인보호전문기관 역시 법·제도의 미비로 기능과 역할을 다하지 못하게 되는 것을 확인할 수 있었다. 아동보호전문기관의 경우 증거가 없더라도 아동학대로 의심되어 신고접수가 되면 아동에 대한 분리보호를 통해 학대로부터 아동을 보호하는 적극적인 개입 방안을 고려해야 하는 것으로 나타났으며 노인보호전문기관의 경우 업무 특성상 공공부문에서 맡아 운영해야 하는 것이 바람직한 것으로 나타났다. 즉 공공영역에서 학대에 대해 조사하고 지도·감독에 이르는 과정을 거치는 것이 피해노인을 보호하고, 인권을 증진시키는데 효과적일 것이다. 더불어 우리나라의 아동보호전문기관과 노인보호전문기관 상담원들의 업무량이 미국과 비교하여 3배 이상 많은 것으로 나타났다. 이것은 업무의 질과도 관련이 있는데, 대상자에게 질적으로 좀 더 깊은 관계를 맺거나 충분한 서비스를 제공하고 양질의 상담을 위해서는 상담원의 증원과 재배치가 필요한 것으로 나타났다.

영어초록

In recent years, as the social awareness of human rights has increased, there is a movement in which human rights are respected and human rights awareness is raised in all fields. Human life represented by civil and political rights centered on individual freedom as the first generation human rights, economic, social and cultural rights related to equality as the second generation human rights, and the solidarity right that unites humanity as the third generation human rights. Are expressing their right to do business. However, abuse inflicted on socially underprivileged children and the elderly in the home or in the facility appears as a stark form of human rights violations. In particular, cases related to child abuse and elder abuse occurring in the home due to the recent pandemic of COVID-19 function as a pattern of abuse in the case of dysfunctional families, resulting in an increase in the incidence of abuse and cruelty that were not seen in the past.
This study examines the operating system based on the current laws and systems of Korea's Child Protection Agency agencies and senior protection agencies, which are dedicated to defending the human rights of children and the elderly in response to non-human rights abuses. This study examined foreign intervention procedures and operating systems, which are taking place in the protection of the elderly and the elderly. Through this process, children and the elderly are protected from abuse, and the problems of the intervention process of the Child Protection Agency agencies and the aged protection agencies in Korea, which are intervening in crisis situations in order to maintain a human life based on human rights, are examined. Reported and suggested improvement plans.
Regarding child abuse and elder abuse, the problem of the operating system in which children and the elderly who are victims of abuse are not protected during the intervention process of the child protection agency and the elderly protection agency in Korea was confirmed. With the amendment of the Act on Special Cases, from 2020, public officials in charge of child abuse have been in charge of tasks ranging from filing reports, on-site investigations, and case judgment. It was confirmed that there is a limit to giving orders to obligatory counseling and education to actors. In addition, it was confirmed that the agency specializing in protection of the elderly, established to defend the human rights of the victims, was also unable to fulfill its functions and roles due to the lack of laws and systems.
In the case of a Child Protection Agency institution, even if there is no evidence, when a report is received due to suspected child abuse, it has been shown that active intervention measures to protect the child from abuse through separate protection of the child should be considered. It turns out that it is desirable to be operated by the public sector due to its characteristics. In other words, investigating abuse in the public domain and going through a process leading to guidance and supervision will be effective in protecting the victims and promoting human rights. In addition, it was found that the workload of counselors of Child Protection Agency agencies and senior protection agencies in Korea was more than three times larger than that of the United States. This is also related to the quality of work, and it was found that more and more counselors were needed to establish a deeper relationship or provide sufficient services to the target subject, and to provide quality counseling.
