북한의 「해외동포권익옹호법」에 대한 논고: 권리보장을 중심으로 (A study on North Korea’s “Overseas Compatriots Rights Protection Act”: Focusing on rights guarantee)

초록

동 법령의 입법 배경은, 첫째, 북한의 입장에서 동 법령이 절실히 필요한 시점이다. 둘째, 북한은 해외동포와의 관계에 대한 규범적인 함의가 공식적으로 필요하다. 셋째, 동 법령은 김정은시대의 입법 경향과도 일치한다. 넷째, 동 법령은 북한이 가입한 국제조약과 다소 부합한다. 동 법령의 의의는, 하나는 북한이 해외동포에 대해 독립적으로 명시한 최초의 법령이다. 다른 하나는 북한 이 동 법령을 통해 ‘권익옹호’라는 가치의 기준과 척도, 내용을 공식화했다.


본 연구 목적은 북한이 2022년 2월 제정한 「해외동포권익옹호법」의 권리보장 부문을 분석하는 것이다. 연구의 분석대상은 동 법령의 ① 사회정치, ② 문화, ③ 경제 세 분야의 권익옹호를 중심으로 분석하였다. 연구방법은 동 법령의 조문을 중심으로 질적연구방법을 하였다.


분석결과, 형식적 차원에서 「해외동포권익옹호법」은 기존의 법령과 뚜렷한 차이점이 발생하지 않는다. 내용적 차원에서 첫째, 세 가지 원칙을 제시하였다. 둘째, 적용대상에서 해외동포와 단체를 포괄했다. 셋째, 상대국과 마찰할 경우 국제협정을 우선한다.


세 가지 권익옹호의 경우 첫째, 사회정치적 권익옹호의 경우 국적과 혼인을 비롯한 법적 관계, (피)선거권, 사회정치 활동, 해외동포와 단체의 교류, 해외조선공민보호, 이동권, 귀국 동포와 장기체류 동포 보호, 사유 재산과 신소청원권 보장 등을 열거하였다. 둘째, 문화적 권익옹호의 경우 ① 교육, ② 문화, ③ 보건, ④ 과학 분야를 열거하였다. 셋째, 경제적 권익옹호의 경우 해외동포의 기업 창설과 운영 허용, 경제협력 우대 조치, 기업권 침해행위 금지이다.

영어초록

The legislative background of this law is: First, from North Korea's perspective, this law is desperately needed. Second, North Korea officially needs normative implications for relations with overseas compatriots. Third, this law is consistent with the legislative trends of the Kim Jong-un era. Fourth, this law is somewhat consistent with international treaties to which North Korea has acceded. The significance of this law is that it is the first law that North Korea independently specified regarding overseas Koreans. On the other hand, North Korea formalized the standards, scale, and content of the value of ‘rights and interests protection’ through this law.


The purpose of this study is to analyze the rights guarantee section of the “Act on the Protection of Rights of Overseas Koreans” enacted by North Korea in February 2022. The object of analysis is the protection of rights and interests in the three areas of this law: ① social politics, ② culture, and ③ economy. The research method was a qualitative research method focusing on the provisions of this law.


As a result of the analysis, at the formal level, the Act on the Protection of Rights of Overseas Koreans does not differ from existing laws. First, at the content level, three principles were presented. Second, the scope of application included overseas compatriots and organizations. Third, in case of conflict with the other country, international agreements take priority.


In the case of three types of rights defense, first, in the case of socio-political rights defense, legal relationships including nationality and marriage, (right to) vote, social and political activities, exchanges between overseas compatriots and organizations, protection of overseas Korean citizens, right to movement, and long-term stay with returning compatriots. Protection of compatriots, guarantee of private property and right to file complaints, etc. were listed. Second, in the case of cultural rights advocacy, the following fields were listed: ① education, ② culture, ③ health, and ④ science. Third, in the case of economic rights protection, it allows overseas Koreans to create and operate businesses, provides preferential treatment for economic cooperation, and prohibits violations of corporate rights.
