초록

이 논문은 루만(N. Luhmann)의 체계이론적 관점에서 로비의 특징과 기능을 밝히기 위한 것이다. 로비는 다양한 이익집단이 공적 이익의 실현을 내세워 정치체계 내에서의 유리한 결정을 이끌기 위한 정치적 행위이다. 그러나 로비가 사회정의나 공정성을 실현하거나 도덕적 정치를 가능하게 한다는 발상은 지극히 비현실적인 것이다. 로비를 위한 이익집단의 행위 모두는 정치적인 것으로서 정치체계의 자기생산적 작동에 충실할 뿐이다.
각 이익집단이 여론과 공적 이익을 내세우며 다양한 전략을 구사하지만, 이익집단의 행위는 정치체계의 환경이나 체계에 귀속되며 철저히 정치체계의 작동원리를 따르게 된다. 이 논문에서는 루만의 여론, 공중, 정치적 공정성으로서의 도덕, 자기면제의 금지의 개념을 살펴보고, 이를 바탕으로 로비가 정치체계의 작동원리에 부합하는 최적화 프로그램으로서, 그리고 공정한 사회제도로서 갖는 의미를 고찰하였다. 또 민주주의 사회에서 로비의 근원이 되는 여론 및 공중의 참여가 갖는 한계점을 논의하였다.
로비는 몇 가지 이유를 근거로 공적이고 사회적이며 제도적인 것이 되어야 한다. 첫째, 로비는 사회적으로 중요한 모든 이슈가 공적 논의를 통해 사회적 합의로 나아가는 장(場)이 되어야 한다. 둘째, 집단의 로비 행위 자체가 정치체계의 환경으로 기능해 정치체계의 유지는 물론 도덕적으로 작동하도록 하고 정치자금이나 뇌물공여를 통해 공정성을 헤치는 행위는 사라져야 한다. 셋째, 어떤 사회도 이익집단 간의 갈등은 피해갈 수 없으며 이러한 갈등은 사회구성원의 이성적 자각에 의해 해결되어야 한다. 넷째, 체계에 의한 생활세계의 식민화로 정치적 권력, 행정체계, 자본 등에 의한 불합리하고 폐쇄적인 커뮤니케이션이 지배하는 상황에서의 로비는 합리적 의사소통 구조로 작동해야 한다.
사회적으로 쟁점이 되는 이슈가 공적으로 논의되고 각 이익집단이 추구하는 가치와 이익이 합리적 의사소통 체계를 통해 논의되며, 이상적인 법률 및 제도의 정착으로 이어진다면 로비는 사회적 자산이 될 수 있다. 조직은 로비를 통해 자신의 전략을 실행하고, 결과적으로 많은 이해관계자들과 이익을 공유하며, 결국은 공익에 기여하는 것을 최상의 가치로 받아들여야 한다.

영어초록

This thesis is to reveal the characteristics and functions of the lobby from the perspective of Luhmann's systemic theory. Lobbying is a political act to lead favorable decisions within the political system by advocating the realization of public interest by various interest groups. However, the idea that lobbying achieves social justice or fairness or enables moral politics is extremely unrealistic. All activities of interest groups for lobbying are political and only faithful to the autopoietic operation of the political system.
Although each interest group advocates public opinion and public interest and employs various strategies, the behavior of interest groups is attributed to the environment or system of the political system and thoroughly follows the operating principle of the political system. In this thesis, Luhmann's public opinion, the public, morality as political fairness, and the concept of prohibition of self-exemption are examined, and based on this, the meaning of lobbying as an optimization program that conforms to the operating principle of the political system and as a fair social system is examined. In addition, it examined the limitations of public opinion and public participation, which are the source of lobbying in a democratic society.
Lobbying should be public, social and institutional for several reasons. First, the lobby should be a venue for all socially important issues to reach a social consensus through public discussion. Second, group lobbying itself acts as an environment for the political system, so that the political system can be maintained and operated morally, and acts that undermine fairness through political funds or bribery must be eliminated. Third, no society can avoid conflicts between interest groups, and these conflicts must be resolved through the rational awareness of members of society. Fourth, in a situation dominated by irrational and closed communication by political power, administrative system, capital, etc. due to systemic colonization of the life world, lobbying should operate as a rational communication structure.
Lobbying can become a social asset if socially controversial issues are publicly discussed, values and interests pursued by each interest group are discussed through a rational communication system, and ideal laws and systems are established. Organizations must accept the highest value in implementing their strategy through lobbying, sharing interests with many stakeholders as a result, and eventually contributing to the public good.
