안보 목적의 해외정보 온라인 수집을 위한 법제도 연구 (Legal Analysis on the Online Collection of Foreign Intelligence for National Security)

초록

암호통신과 글로벌 인터넷 등의 정보통신 기술의 발전에 따라서 국가안보를 위한 해외정보 수집활동의 패러다임이 전환되면서 인터넷을 활용한 온라인 수집이 현실적이고 효율적인 방안으로 등장하게 되었다.
온라인 수집은 해킹기술을 활용하여 대상자의 정보통신기기에 비밀리에 침투하여 정보를 수집하는 방법으로 해외정보 수집에 있어 최적화된 방안이라 평가할 수 있다. 일반적으로 정보수집 법제는 범죄수사 법제와는 다른 기준을 적용하고 있어, 해외정보 수집활동에 있어 온라인 수집기술을 적용하는 것은 충분히 합리적인 방법이 될 수 있다.
이미 주요 선진국들은 2000년부터 온라인 수집을 활용한 정보수집 기술을 도입하고 이를 허용하는 법제도를 재정비하고 있는 반면에, 우리는 사법관할권 밖인 해외에서의 정보수집 활동조차도 국내외 구분이 없는 인터넷을 활용한다는 이유로 통신비밀보호법, 정보통신망법 등과 같은 국내 현행법에 저촉되는 불합리한 문제점을 안고 있어 이에 대한 법제도 개선 등의 보완이 필요하다.
본 논문에서는 주요국의 온라인 수집과 연관된 해외정보 수집활동의 실태와 법제도를 살펴보고 이를 바탕으로 우리나라의 역외(해외에서) 해외정보 수집역량을 강화할 수 있는 개선안을 제시하고자 한다.
국가안보 차원의 해외정보 수집은 정당한 활동임에도 제도 미비로 불법 논란에 휩싸여 활동이 위축되는 현실을 고려하여 기술발전과 정보환경에 대한 이해를 반영할 수 있는 합리적인 법제도와 지침을 마련함으로써 적법절차를 준수하면서 원활하게 정보수집 활동을 할 수 있는 환경을 구축하여 국가의 해외정보 경쟁력을 보다 강화하여야 할 것이다.

영어초록

The development in cryptography and information communication has led the paradigm shift in foreign intelligence collection for the national security, which initiates the internet online collection known for the most effective and realistic intelligence activities in foreign intelligence history.




The online intelligence collection is defined as the way to access the target communication devices with clandestine infiltration such as hacking, and collect information without the users’ notification. At the same time, the current legal system in intelligence collection applies a procedural hurdle that is substantially lower than in criminal investigation. For this reason, the online collection is estimated as the most optimized method in the foreign intelligence.




It is commonly known that the developed countries have employed the online intelligence collection from 2000s, and reformed their legal systems to support these activities. However, the Korean laws such as ‘Protection of Communications Secrets Act’ and ‘Information Communications Network Act’ do not distinguish the home and foreign territory, so that the irrational and potential conflicts are involved even though the collection is conducted extra-territorially. This is the most important reason that reorganization in the current law system should be followed.




This note will delineate the current conditions and the legal system of the foreign intelligence activities in developed countries, and provide the suggestions to fortify our legal foundation in extra-territorial intelligence.




The foreign intelligence collection in national security is the legally acceptable activities. However, the lack of system has driven this topic to the controversial discussion of legality, and it results in the entire intelligence collection to be daunted. For this reason, the rational legal system and policy that can embrace the profound understanding in technological development and information environment must be established. Finally, the national competitiveness in foreign intelligence will be encouraged with the improved environment that the intelligence organizations can conduct intelligence activities with the legal procedure.
