초록

조선업 등 제조업의 인력난은 매우 심각한 상태다. 이에 따라 정부는 외국인 인력정책을 개선하고 지원 방안을 마련하고 있다. 하지만, 외국인 근로자들의 임금 지급과 관련된 여러 가지 문제점이 나타나고 있다. 먼저, 동종 또는 유사한 업무를 수행함에도 사증의 종류 및 채용된 기업의 규모에 따라서 임금의 지급기준이 달라, 불합리한 임금 격차가 발생할 수 있다. 다음으로 현행 최저임금제도는 보편적인 노동기본권 보장을 위하여 국적을 이유로 한 차별을 금지하고 있지만, 이 때문에 외국인과 내국인 근로자의 능률이나 숙련도의 차이를 적절하게 반영하지 못하는 모순적인 상황이 발생하기도 한다.
외국인 근로자에 대한 인력정책과 제도는 산업 및 인구구조의 변화에 대응하기 위해서 근본적으로 전환될 필요가 있다. 조선업종의 외국인 근로자에 대한 체류자격 및 임금 지급기준에 관한 개선방안은 다음과 같다. 첫째, 조선업 사업장 내에서 E-7과 E-9 사증의 명확한 구분 적용이 필요하다. 둘째, E-9 외국인 근로자의 기량 향상을 전제로 이들을 체계적으로 E-7으로 전환하는 방안을 모색해야 한다. 셋째, 각종 특례 규정에 따라서 다양한 기준이 적용되고 있는 E-7 사증의 GNI 임금 기준은 통일될 필요가 있다. 넷째, 외국인 근로자의 숙박 및 식사 비용을 최저임금에 산입하는 방안이 필요하다.
향후 외국인 근로자에 대한 의존도는 더욱 커질 것으로 예상된다. 이에 따라 외국인 근로자에 대한 관리체계와 근로조건을 지속적으로 개선하는 노력이 필요하다. 이 중에서도 외국인 근로자의 체류자격과 임금 지급기준의 개선은 매우 시급하고 중요한 문제다.

영어초록

The manpower shortage in the manufacturing industry including shipbuilding is very serious. The government is improving the foreign manpower employment policy and preparing support measures. However, various problems related to the payment of wages for foreign workers are emerging. First, despite performing the same or similar type of work, foreign workers are subject to different standards to determine their wages, which vary depending on the type of visa and the size of their employer, which can lead to an unreasonable wage gap. Next, the current minimum wage system prohibits discrimination on the grounds of nationality in order to guarantee universal basic labor rights. However, for this reason, contradictory situations arise in which differences in efficiency or skill level between foreign and domestic workers are not properly reflected.
Policies and systems governing the use of foreign workers need to be fundamentally transformed to respond to changes in industrial and demographic structures. Ways to improve the system of status of stay and wage payment standards for foreign workers in the shipbuilding industry can be summarized as follows. First, it is necessary to apply a clear distinction between E-7 and E-9 visas within the shipbuilding business. Second, on the premise of foreign workers holding E-9 improving their skills, it is necessary to find a way to systematically convert their visa status to E-7. Third, the GNI wage standard for E-7 visa holders, which is currently applied differently according to various special provisions, needs to be unified. Fourth, it is necessary to factor the accommodation and meal expenses of foreign workers into calculating the minimum wage amounts.
In the future, Korea’s dependence on foreign workers is expected to increase. Accordingly, efforts to continuously improve the management system and working conditions for foreign workers are needed. Among them, the improvement of foreign workers’ residency status and wage payment standards is a very urgent and important task.
