육상여객운송업 분야 외국인 근로자 도입한계 및 제도개선에 관한 연구 : 버스운전기사를 중심으로 (A Study on the Limit of the Introduction of Foreign Workers in the Land Transport Service Industry and Improvement of the System : Focused on Bus Driver)

초록

본 연구는 단순 노무 분야는 고용허가제를 통하여 외국인 근로자의 도입이 허용되고 있고, 전문직인 항공기 조종사와 선장 등은 전문직업(E-5) 취업사증으로 국내 취업이 허용되고 있음에도, 육상여객운송업 분야 버스 운전기사 직종에는 외국인 인력의 도입이 불가한 현실적 문제와 개선방안에 대하여 분석해보고자 한다. 고용허가제의 대 전제는 산업현장의 일손부족 해소와 국내 일자리 보호이다. 2018년 12월말 현재 약 55만 명의 외국인근로자가 고용허가제로 입국하여 산업현장의 일손부족문제를 해결해주고 있지만, 한편 외국인 근로자의 도입이 국내 노동시장을 잠식하고 있다는 우려도 제기되고 있다. 우리나라 외국인력 도입제도는 전문인력과 비전문인력으로 이원화 되어있고, 도입 허용분야는 전문직․숙련기능 인력에 대해서는 직종중심으로, 저 숙련 외국인 근로자에 대해서는 업종중심으로 도입허용분야를 결정하고 있다. 육상여객운송업의 경우 특례고용허가제 상 외국인 근로자 도입허용 업종으로 분류되어 있으나 단순 노무 분야인 하역, 적재 부분에만 허용되고, 버스운전 기사 직종은 도입이 허용되지 않는 것은 버스운전직은 전문직과 비전문직의 중간인 ‘준 전문직’으로 분류되어 국내 노동시장에 미치는 영향이 크기 때문이다. 그러나 국내외 연구결과를 보면 외국인력의 도입이 내국인 일자리 잠식에 대부분 영향이 없거나 오히려 내국인의 고용률을 높이는 긍정적 영향도 있는 것으로 연구되고 있다. 세계화와 산업구조의 변화, 저출산, 고령화, 고학력화로 우리나라의 외국인력 수요는 지속적으로 증가할 전망이다. 따라서 세계화 시대에 맞는 기업의 경쟁력 강화와 산업현장의 효율적인 인력수급을 위해서는 노동시장에서 외국인 활용을 극대화하는 종합적이고 체계적인 정책으로의 전환이 필요하다. 따라서 버스운전기사를 포함한 준 전문직에도 엄격한 노동테스트와 최소인원 할당제, 체류 기간 연장 불허 등의 조건으로 외국인력 도입을 확대 시행해 볼 필요가 있다.

영어초록

In this study, the introduction of foreign workers through the Employment Permit System was allowed for the simple labor field, For professions such as aircraft pilots or captains were allowed to work in Korea as a specialized job visa(E-5) I would like to analyze the practical problem and the improvement plan that can not introduce foreign manpower to bus driver occupation job. The premise of the Employment Permit System is to eliminate shortage of workers in the industrial field and to protect domestic jobs.
As of the end of November 2018, about 550,000 foreign workers (about 900,000 including illegal immigrants) entered the country through the Employment Permit System to solve the labor shortage problem in the industrial field. There is also concern that the influx of foreign workers is encroaching on Korean jobs. foreign workers introduction system is divided into professional manpower and nonprofessional manpower. The permissible area of ​​acceptance is determined by job type for professional manpower and skilled manpower.
In the case of land passenger transportation industry, it is classified as an industry that permits the introduction of foreign workers under the Special Employment Permit System. However, this field is only allowed for unloading and loading parts of simple labor field. Bus drivers are not allowed to to be employed.
Because they are classified as 'quasi-professional' and have a large impact on the domestic labor market. However, domestic and foreign research shows that the introduction of foreign workers has little impact on the occupation of Korean workers, or it has a positive effect on raising the employment rate of Koreans.
Due to globalization, changes in industrial structure, low fertility rate, aging population, and high educational attainment, demand for foreign workers in Korea is expected to increase steadily Therefore, in order to enhance competitiveness of companies in the era of globalization, and to efficiently supply manpower to industrial sites, it is necessary to shift to a comprehensive and systematic policy maximizing the utilization of foreigners in the labor market.
Therefore, it is necessary to expand the introduction of foreign labor force on condition that strict labor test, minimum quota system, and extension of stay period are not allowed even for the semi-professionals including bus drivers.
