국적취득조건부 선체용선의 법적 지위와 해사산업에 있어서 역할에 대한 연구 (A Study on the Legal status and Role of the Bareboat Charter of Hire Purchase in the Maritime Industry)

초록

1970년대 초반 국내 해운회사들은 국적취득조건부 선체용선제도를 활용하여 일본, 그리스, 홍콩 등으로부터 중고선박을 도입하여 해운진흥의 기반을 마련하였다. 이후 1980년대 해운산업 합리화와 국내 조선산업 부흥정책을 중고선 도입정책에서 신조선을 확보하여 자국 상선대를 확충하기 위한 정책으로 전환하면서 국적취득조건부 선체용선제도의 역할과 범위가 확대되었다. 그러나 일부 국내 해운회사들은 국적취득조건부 선체용선 선박에 대한 이중선급 입급 문제를 이유로 국적취득조건부 선체용선 선박을 선박안전법의 적용범주에서 제외해야 한다고 주장하였고, 최근 국회에서도 국적취득조건부 선체용선 선박의 세금 등에 관한 문제를 제기한 바 있다. 실제로 우리나라는 국적취득조건부 선체용선 제도를 활용하여 자국선대의 안전수준이 높이고 있음에도 불구하고, 앞선 주장들의 대부분은 국적취득조건부 선체용선 제도의 종합적인 해석이 아닌 자기중심의 단편적인 해석에 따른 유･불리에 기초한 것이 대부분이다. 왜냐하면 그 동안 국적취득조건부 선체용선제도에 대한 연구는 주로 핵심 당사자간의 책임관계, 계약 자체의 법적 성질, 현안별 쟁점 사항에 대한 해석 등으로 국한되었기 때문이다. 기존의 연구들은 국적취득조건부 선체용선 선박과 관련된 최근 일련의 다양한 사건사고 이후의 결과에 대한 법적 해석의 방향성을 제시하는 가이드 역할을 하고는 있지만, 실제로 해사산업에서 국적취득조건부 선체용선제도가 어떠한 진정한 역할을 하고 있는지에 대한 연구가 부족한 것은 사실이다.
따라서 이 연구는 국적취득조건부 선체용선제도의 연혁적 분석과 국내 해사산업계에 미친 영향분석 및 선박안전법 등 해사행정법과 관련한 다양한 법적 쟁점을 검토하고자 하였다. 더불어 이 연구는 국적취득조건부 선체용선의 선박안전법 적용과 관련하여, 동 제도가 국가해양력 강화 및 해사안전제고 측면 등을 종합적으로 고려하여 국가정책상 필요한 사항인지 여부를 판단하는데 유용한 기초자료를 제공함과 동시에 국적취득조건부 선체용선제도에 관한 향후의 정책방향과 새로운 해석론을 제시하였다.

영어초록

In the early 1970s, Korean shipping companies made the foundation for building the shipping industry by acquiring secondhand ships from Japan, Greece and Hong Kong using the Bareboat Charter of Hire Purchase System(BBCHP). In the 1980s, the role and scope of the BBCHP expanded as the Korean government shifted its policy of rationalizing and promoting the maritime industry from acquiring secondhand ships to securing new ships and expanding its own merchant fleet. However, some shipping companies insisted that BBCHP ships should be excluded from the scope of application of the Ship Safety Act, raising the issue of double registration of the BBCHP ships. Recently, the National Assembly also raised the issue of tax evasion and tax avoidance related to the BBCHP ships. Indeed, despite the fact that Korea has increased the safety level of its fleet by utilizing the BBCHP, most of these legal issues are based mostly on the pros and cons of individual case interpretation of the BBCHP rather than a comprehensive interpretation of the BBCHP system. This is because the study on the BBCHP has been largely limited to the relationship of responsibility among key stakeholder, the legal nature of contract itself, and the case by case interpretation. While previous studies have suggested as a guide for the direction of legal interpretation of the consequences of a series of recent incidents involving BBCHP ships, it is clear that there is a lack of research into what actual roles of the BBCHP system in the maritime industry.
Therefore, this study conducted chronological analysis relating to the BBCHP system, evaluated the impact of the system on the national shipping industry, and reviewed various legal issues related to the maritime administrative laws, such as the Ship Safety Act, etc. In addition, with regard to the application of the Ship Safety Act to the BBCHP ships, this study provided basic information necessary to determine whether the BBCHP system is necessary for national policy by comprehensively considering the aspects of strengthening the nation’s sea power and enhancing safety at sea. This study also presented future policy direction and a new theory of interpretation of the BBCHP system.
