공동주택 경비업무에 대한 검토 -경비업법 제7조 제5항과 관련하여- (A study on the services of security guards in Multi-Family Housing -About Article 7 Clause 5 of the Security Business Act-)

초록

본 연구는 공동주택 경비업무의 제도적 배경에 대한 논의를 통해 한계점을 도출하고 규범적 체계에서 발전방향을 모색하고자 하였다.
「경비업법」에 따르면, 경비업자는 소속 경비원에게 허가받은 경비업무의 범위를 벗어난 업무에 종사하지 못하도록 하여야 하고, 이를 위반하면 시·도경찰청장이 법정 절차에 따라 경비업자의 경비업 허가를 취소한다. 법제처는 경비업무를 도급받은 경비업자 소속 공동주택 경비원에게 재활용 쓰레기 분리작업에 종사할 수 없다고 행정해석하였고, 이와 관련하여 행정심판위원회와 행정법원에서도 일관되게 경비업자 소속 공동주택 경비원의 택배관리, 제초 및 전지작업 보조, 쓰레기 분리수거 등의 작업을 경비업무에서 벗어난 업무로 인정하고 있다.
공동주택 경비업무의 제도적 한계점을 살펴보면, 경찰청이 경비업자 의무 위반에 대하여 개정 「공동주택관리법」의 시행까지 「경비업법」 적용을 유예시킨 점은 법률의 효력을 공동(空洞)화 시키게 된다. 또한 「공동주택관리법」에 따른 시ㆍ도지사 ‘공동주택관리규약 준칙’의 경비업무 규정은 ‘일반조항 형식의 모호성, 경비업무 주체의 미구분, 경비업무를 벗어난 경비원 업무 규정의 존재’에 대한 문제점이 있다. 그리고 공동주택 경비업무의 감독기관이 이원화됨에 따라 기관 책임의 전가를 통해 소극행정으로 연계될 수 있다.
따라서, 공동주택 경비업무의 발전 방향은 다음과 같다. 첫째, 「경비업법」 제24조에 따라 경찰기관장은 법령에서 부여된 지도·감독 및 명령권을 정상적으로 행사하고, 공동주택의 위험발생을 방지하는 업무에 대한 구체적인 가이드라인을 설정할 필요가 있다. 둘째, 「공동주택관리법」의 소관 부처인 국토교통부는 공동주택 경비원의 업무와 이와 관련된 부수적 관리업무에 대한 실태를 조사하여, 공동주택 경비업무의 근거를 구체적으로 마련하여야 한다. 셋째, 공동주택 경비업무에 대한 감독기관이 이원화됨에 따라 「경비업법」의 특별법적 지위를 갖는 「공동주택관리법」을 우선적으로 적용하여 그 위반 여부를 판단하는 단계적 유권해석 체계를 구축하여야 한다.

영어초록

This study attempted to derive the limitations of the security service of the multi-family housing security guards through discussion on the institutional background of the multi-family housing security service, and to seek the development direction of the security service of the multi-family housing in the normative system.
A security business operator under the 「SECURITY SERVICES INDUSTRY ACT」 assigns an obligation to his/her security guards not to engage in duties outside the scope of the permitted security business, and if this is violated, the commissioner of the Metropolitan Police Department, who is the licensee, will revoke the security business license in accordance with the procedures of the relevant laws.
Ministry of Government Legislation interpreted the administrative interpretation that the security contractor, who was contracted for security work, could not engage in the separation of recycled waste to the security guard of the multi-family housing. In this regard, the Administrative Appeals Committee and the Administrative Court have consistently acknowledged the illegality of carrying out tasks beyond the scope of security services such as courier management, weeding and battery work assistance, and garbage separation to the multi-family housing security guards.
According to the institutional limitations of the multi-family housing security service, The fact that the National Police Agency, which is the department in charge of the 「SECURITY SERVICES INDUSTRY ACT」, delays the application of the law until the enforcement of the revised 「MULTI-FAMILY HOUSING MANAGEMENT ACT」 for violations of the obligations of security companies, will be removed from the legal effect without any grounded regulations. The security service regulations of the Mayor/Do Governor's ‘standing rules for the management rules’ under 「MULTI-FAMILY HOUSING MANAGEMENT ACT」 have problems with ‘ambiguous security business regulations in the form of general provisions, undifferentiation of the security business entity, and the existence of regulations for performing duties other than security business’. As the supervisory agency for the security of apartment houses is dualized, it can be linked to the passive administration of oversight of agency responsibility.
Therefore, the following opinion was suggested as a desirable development direction for the security work of the multi-family housing. First, pursuant to Article 24 of the 「SECURITY SERVICES INDUSTRY ACT」, the head of a police agency is required to normally exercise guidance, supervision, and command rights granted by the law, and to present specific guidelines on tasks to prevent the occurrence of danger in the multi-family housing. Second, the Ministry of Land, Infrastructure and Transport, which is a department under the jurisdiction of 「MULTI-FAMILY HOUSING MANAGEMENT ACT」, should investigate the business conditions of the apartment security guards and related affairs, and prepare the basis for the duties of the multi-family housing security guards in detail.
Third, as the supervisory authority for apartment housing expenses has been divided, it is necessary to establish a system to determine whether the violation is violated by applying the 「MULTI-FAMILY HOUSING MANAGEMENT ACT」, which has a special legal status in the 「SECURITY SERVICES INDUSTRY ACT」.
