개정 경비업법의 규제수단강화와 그 정책적 함의 (Enhanced Regulatory Method and Policy Implications of Security Industry Act Revision)

초록

경찰력(공경비)의 한계를 보조하기 위한 목적으로 민간경비제도가 도입되고, 이에 따라 근거법인「경비업법」에 의해 설립되는 민간경비업체는 안전 확보를 필요로 하는 수요자 및 사회적 요청에 따라 질서유지의 보조자로서 매우 중요한 역할을 수행하고 있다. 그러나 최근 집단민원현장에서의 경비원에 의한 폭력행위 등으로 경비업체에 대한 효율적 규제를 위한 제도정비와 관할경찰관서장의 감독권한 강화의 필요성이 제기되고, 이러한 문제가 심각한 사회문제로 파급되는 것에 상응하여 2014. 6. 8. 제도 개선을 위해 일부 개정된「경비업법」의 시행을 앞두고 있다.
이와 같은 경비업체의 집단민원현장에서의 불법적인 업무수행의 주된 원인은 관계법령을 무시하고 단기간의 고수익창출만을 목적으로 하는 업계의 부정적인 측면을 지적할 수도 있겠으나, 다른 한편으로는 경비업에 대한 국가의 규제와 감독이 의례적·형식적으로 이루어짐으로서 이와 같은 부정적인 결과를 초래하였다는 비판을 면하기 어렵다 할 것이다.
이에 대한 해결방안으로서 사회안전망 확보의 한 축을 담당하고 있는 민간경비업체를 국가가 규제자의 입장에서 뿐만 아니라 안내자 및 유도자의 입장에 위치하고 있다는 인식전환을 통하여 민간경비업체의 법령준수유도와 양질의 민간경비서비스를 제공할 수 있는 법적·제도적 밑받침을 마련함과 동시에 소관행정청인 관할경찰관서장의 책임행정을 통하여 민간경비제도의 정상적 운영을 위한 견고한 기반을 적극적으로 조성하여야 할 필요가 있다 할 것이다.
