경비업의 공법적 논의 (A Discussion about Security Service Industry under Public Law)

초록

이 글은 공경비로서의 경찰과 대비할 때 사경비로서의 경비업이 헌법을 비롯한 공법상 어떤 배경에 기초하는지 알아보고, 이를 토대로 경비업의 공법적 성질을 논해보는데 그 목적이 있다. 이와 함께 경비업의 향후 방향이라는 관점에서 최근 경비업의 업무 범위의 확대와 치안 대책으로서의 위치화 등에 대하여도 다루고 있다.
공적 영역과 사적 영역, 즉 공과 사의 구분은 근대국가의 출발을 의미한다. 이에 의할 때 경찰권의 국가독점은 필연이다. 이 사고방식에 의할 때 국가의 경찰조직에 필적하는 사경찰이나 타인에 대한 실력행사를 목적으로 하는 조직의 존재는 상상할 수 없다. 이러한 조직을 공식적으로 인정한다는 것 자체가 바로 국가의 분열과 붕괴를 초래한다는 의미가 되기 때문이다. 이에 대하여 위험이나 안전, 치안 등 현대사회를 규정짓는 위험사회화 경향은 국가만에 의한 치안 내지 안전의 확보에는 한계가 있을 수밖에 없다는 것을 의미한다. 나아가 국가는 안전과 관련하여 헌법이 보장하는 기본권을 보장하는 범위 내에서만 행위 할 수 있다. 이에 공적 임무의 수행에 있어서 사적 행위주체와의 협력의 필요성이 현실적으로나 법적으로 대두되고, 이것이 바로 사경비로서의 경비업의 존재이유가 된다.
이러한 경비업은 공법적으로 두 가지 쟁점을 가지고 있다. 첫째는 경찰권의 국가독점을 중시하여 경비업은 민간의 영역에서 사인과 사인 사이의 계약 관계로 남겨 두는 현재의 형태로 유지하는 경우에 경비업무의 내용이 과연 공경비 업무의 어디까지 접근하느냐라는 문제이다. 두 번째는 최근 공공 부문의 효율성에 따라 그 추세가 되고 있는 경찰권의 민영화 문제로 이는 사경비로서의 경비업보다 한발 더 나아간 것으로 경찰권의 일부를 민간의 영역에 위탁하는 것이다.
근대국가의 출발은 공과 사의 구분을 의미하고 위험으로부터 개인의 재산과 생명을 보호하는 것은 국가의 임무 즉 공공영역에 해당하는 것으로 사적 영역은 될 수 없다. 그러한 의미에서 최근의 위험사회화에 의한 경비업의 필요성 증대는 있으나 그렇다고 하더라도 경찰권의 국가독점화는 유지되어야 하며, 설사 경비업에 길을 내준다고 하더라도 필요최소한도에 그쳐야 할 것이다. 경비업의 현실적 필요성을 인정하면서도 그 경계지점을 확정해나가는 것이 과제라고 할 수 있다.

영어초록

This study aims to examine what grounds of public law along with the Constitution security service industry as private security is based on in contrast to the police as public security, and discuss the characteristics of the business in terms of public law. From the perspective of future directions of security services, it also deals with recent expansion of security service operations and its establishment as a security measure.
A distinction between public and private matters means the starting point of a modern nation. In this light, it is inevitable that the police should have a monopoly position in a nation. Therefore, the existence of private police, comparable to the national police organization, or other units for the purpose of exercising power over people cannot be imagined because official recognition of such units itself might lead to disintegration and collision of a nation. Tendencies of risk socialization such as dangers safety, security and so on, which define a modern society, imply that assurance of security and safety only by a nation has its limits. Moreover, concerning security, the nation could practice its power under the endorsement of human rights guaranteed by the Constitution. In this sense, the need to cooperate with private organizations in performance of public tasks emerges in reality and in law, which is the reason why security business exists as private security.
The security service industry has two issues in terms of public law. The first issue is to what public security operations private security business can expand its work in case the present system restricts security services to the contractual relationship in the private sector due to the importance of a nation's monopoly of police authority. The second issue is the privatization of police authority, which is the recent trend for the effectiveness of public sectors. The policy goes one step further than security service business as private security and it entrusts some of police authority to private sectors.
The emergence of a modern nation entails the division of public and private matters, and the protection of property and life of an individual from dangers is the duty of a nation. In other words, it is not a private matter but a public one. In this sense, the need of security service industry because of the recent risk socialization is increasing but a nation's monopoly of police authority should be held. Also, the consignment given to security service business should stay to an absolute minimum. A challenge will be drawing a line between the boundaries while admitting the realistic needs of security service industry.
