미군정 법률고문 퍼글러의 한국에서의 활동에 관한 연구 (A Study on the Activities of US Military Legal Adviser Charles Pergler in Korea from April, 1946 to September, 1948)

초록

본 연구는 중요성에도 불구하고 단일 연구주제로는 거의 연구되지 않았던 미군정 법률고문 퍼글러(Charles Pergler)에 관해 한국에서의 활동을 중심으로 기존의 연구들과 사료들을 총망라하여 1946년 4월부터 1948년 9월까지의 퍼글러의 한국에서의 활동과 역할에 관해 종합적으로 살펴보고자 하였다. 예컨대 미군정 법률고문들 중 제일 고위직이었던 퍼글러의 한국에서의 활동에 관해 재구성한 후 이를 바탕으로 지금까지도 많은 의문점들이 남아있는 귀속재산과 제헌헌법 연구에 기여하고자 하는 것이 본 연구의 목적이다.
본론에서는 퍼글러가 한국에 파견된 세 가지 이유를 제시하였다. 첫째, 퍼글러가 대륙법계열인 독일법과 영미법계열인 미국법을 모두 공부하여 대륙법체계를 채택하고 있었던 한국에 미국의 법을 이식하는데 적임자였다는 사실을 언급하였다. 둘째, 당시 미군정이 한국에서 좌우합작을 추진하면서 체코슬로바키아의 국가건설 모델에 주목하고 있었고 일본 주재 체코슬로바키아 공화국 대사로 소련 측과 포로 송환 교섭을 담당한 적이 있었고 정치적 동반자였던 가이다 장군이 김규식, 여운형 등과 교류한 적이 있었던 퍼글러가 좌우합작 관련 임무에도 적임자였음을 기술하였다. 셋째, 해방이라는 특수한 상황들을 경험해본 체코슬로바키아 출신 퍼글러가 독일 법률가 출신인 프랭켈과 함께 선택되었음을 지적하였다.
이와 함께, 귀속재산에 관한 홍진기의 논문과 연설집을 더하여 퍼글러의 한국에서의 활동과 역할의 의미에 대해 귀속재산의 처리와 제헌헌법의 제정 측면에서 새로운 해석과 가설들을 제시하였다. 결론에서는 퍼글러 관련 연구들의 활성화를 위해서는 1차 사료들의 발굴이 필요하며 기존 자료들에 대한 해제와 검토, 국제적인 공조를 통한 공동연구가 요망된다는 사실을 지적하였다.

영어초록

This study examined the work and roles of Charles Pergler, who served as the legal consultant of the U. S. Military Government in Korea, and was seldom a topic of research, in spite of his importance. For this, this study conducted a comprehensive analysis on previous studies and related historical data with focus on what Pergler had done in Korea from April 1946 until September 1948. The purpose of this study is to reconstruct the activities of Pergler, the most highest ranking legal adviser of the US Military government, in Korea. Then, it will contribute to the study of the vested property and constitution, still have a lot of questions.
This study identified three reasons to why Pergler was dispatched to Korea. First, this study found that Pergler studied both the law of Germany, which is a part of the continental legal system, and American law, a part of the common-law legal system, and was the right person to implement American law in Korea, which had adopted the continental legal system. Second, the U. S. military government was attempting a coalition of the left and right in Korea, and took interest in the nation-building model of Czechoslovakia. Pergler had served as the Czechoslovak First Republic ambassador to Japan and once took charge in negotiations over the repatriation of POW with the Soviets. His political companion, General Radola Gadja, also remarked on Pergler’s interactions with Kim Kyu-sik and Lyuh Woon-hyung, which made him the perfect candidate for the coalition mission between the left and right. Third, this paper showed that there was a possibility that Pergler, a Czech, was appointed with Ernst Fraenkel, a German lawyer, due to his unique experience of being liberated from colonialism.
This paper also examined research on Jin-gi Hong’s dissertation and collection of speeches to present new interpretations and hypotheses on the significance of Pergler’s work and roles in Korea, in terms of his handling of vested properties and the legislation of the first constitution of Korea. Finally, this study pointed out that new primary data should be found for further research on Pergler. This study further pointed out that reviewing and adding bibliographical notes on the existing data and joint research through international cooperation are necessary for future in-depth research on Pergler.
