초록

오늘날 우리나라는 점차 증가하는 국제혼인으로 인하여 다문화가정이 상당수에 이르고 있으며, 향후 더욱 급증할 것으로 예상된다. 이에 따라 국제이혼사건을 비롯하여 섭외적 요소를 지닌 아동의 양육비지급청구사건 및 국제적 부양료청구사건과 같은 다양하고도 복잡한 섭외가사사건의 발생이 빈번해질 것으로 보인다. 이처럼 국제적 요소를 지닌 부양관련 사안의 경우에는 각국의 입법 및 판례가 매우 상이하므로, 공통된 해결책으로서 부양관련 국제협약의 체결 및 가입이 촉구되어왔다.
그러나 우리나라는 국제적 부양문제와 관련된 그 어떠한 국제협약에도 가입하고 있지 않다. 따라서 본고에서는 국제적 아동양육 및 부양의무와 관련된 기존의 여러 협약들과의 유기적이고도 포괄적인 협력을 통해 복잡한 문제들을 해결하기 위하여 근래에 가장 유력하게 대두되고 있는 헤이그국제부양청구협약에의 가입가능성 여부를 적극 모색해보고 있다. 더욱이 동 협약은 그 구성 및 내용이 상당히 방대한 편이어서, 특히 본고에서는 동 협약에서 가장 핵심적인 역할을 수행하고 있는 중앙당국의 행정적 협력 및 기능을 중심으로 해석론을 전개하고 있다.
우선 동 협약의 배경 및 의의, 목적 및 적용범위, 구성 및 개요를 통해 이론적 기반을 마련하고 있다. 더 나아가 동 협약상 중앙당국의 행정적 협력 및 기능을 해석함에 있어서 행정적 협력의 필요성, 중앙당국의 지정･일반기능･특별기능･특별조치요청･비용을 중심으로 비교적 상세히 다루고 있다. 또한 동 협약에의 가입가능성을 논의함에 있어서 현행 국제사법상 부양규정에 관한 해석론과 동 협약 가입 및 이행을 위한 고려사항을 다각도로 살펴보고 있다.
실제로 우리나라가 헤이그국제부양청구협약에 가입하기 위해서는 무엇보다도 본고에서 다룬 내용을 기반으로 하여 더욱 총체적이고 유기적인 연구가 꾸준히 진행되어야 한다. 즉 동 협약에의 가입가능성 여부를 논의하기에 앞서 그 선행연구로서 동 협약의 구체적인 내용을 보다 체계적으로 해석하는 작업이 우선되어야 한다. 철저한 사전준비야말로 가입 후 동 협약을 시행함에 있어서도 중대한 시행착오를 줄일 수 있는 바탕이 될 것이다. 따라서 본고를 통해 동 협약에의 가입가능성 및 필요성을 재인식하는 계기가 되길 바라며, 본고에서 미처 다루지 못한 동 협약의 나머지 다른 부분에 관하여도 유용한 해석론적 접근을 계속 시도할 필요가 있다고 본다.

영어초록

Owing to the international marriage that gradually grows today in our country, a multi-cultural family is reaching a considerable number and is expected to be likely to rapidly rise further down the road. This is expected to lead to being frequent in the occurrence of diverse and complex international domestic lawsuits like a case on a maintenance claim for child custody and a case on an international recovery of the maintenance that have a foreign element including an international divorce case. In this way, an issue related to a support of having international element is very different in a legislation and a precedent of each country, thereby having been urged the conclusion and the admission to the international convention related to maintenance as a common solution.
However, our country is not joining any international treaty relevant to an international maintenance matter. Accordingly, this study is positively pursuing whether or not to have possibility of joining the Hague Convention on the International Recovery of Child Support and Other Forms of Family Maintenance that is emerging most potently these days in order to solve complex problems through the organic and comprehensive cooperation with many existing conventions pertaining to the international child support and maintenance obligations. Furthermore, the above-mentioned convention tends to be quite enormous in its compositions and contents. Hence, this study is particularly developing an analytical theory focusing on the administrative cooperation and function of the central authority that is playing the most essential role in the same convention.
First of all, the theoretical foundation is being arranged through background & significance, objective & application scope, and composition & overview of the same convention. Moreover, it is addressing relatively in detail focusing on the necessity of administrative cooperation, designation･general functions･specific functions･requests for specific measures･costs for the central authority in analyzing the administrative cooperation and function of the central authority in light of the identical convention. Also, in discussing the possibility of joining the same convention, it is examining about the analytical theory on the regulations of the maintenance in light of the current private international law and about the considerations for joining and fulfilling the identical convention from various angles.
In order for our country to realistically join the Hague Convention on the International Recovery of Child Support and Other Forms of Family Maintenance, a more general and organic research needs to be steadily progressed, above all, on the basis of the contents that were addressed in this study. In other words, prior to discussing whether or not to have possibility of belonging to the same convention, there is a need to be expedited a work that analyzes the specific contents of the identical convention more systematically as its previous research. The thoroughly advance preparation will be just the groundwork available for reducing important trial and error even in enforcing the same convention after joining. Accordingly, this study is expected to be an opportunity of newly understanding the possibility and necessity of joining the identical convention. Even the other remaining parts of the same convention, which failed to be addressed yet, are considered to be necessarily attempted a useful analytical approach on and on.
