국정원과 경찰의 조직개편 방향에관한 연구- 양 기관 유사업무조정을 중심으로 - (A Study on the Direction of the Reorganization of the National Intelligence Service and National Police Agency - Focusing on coordination of similar work in both agencies-)

초록

해방이후 정부조직개편이 수십 차례 이루어졌지만 주로 일반 부처가 대상이었고 국정원, 경찰 등 소위 말하는 권력부처에 대한 합병, 분리 등의 개편은 거의 찾아보기 힘들다. 일부 이루어진 권력기관의 조직개편도 대개 내부조정에 불과하였다. 그러나 두 기관의 경우 서로 담당하는 기능이 중첩되는 경우가 적지 않기 때문에 함께 묶어 개편방안을 찾는 것이 예산의 효용성을 높이고 시너지 효과를 낼 수 있다는 점에서 합리적이라 할 것이다.
이에 따라 이들 조직의 개편 방안을 찾기 위해 먼저 양 기관을 둘러싸고 각계에서 논의되고 있는 개혁논쟁을 분석해 조직 구성상 문제점을 파악한데 이어 미국의 정보 및 경찰제도 연구를 통해 미국에서는 권한은 분산시키고 전문화를 추구하되 분산된 기관의 업무가 잘 통합되도록 제도적 장치를 마련하고 있으며 집중된 권한이 불가피할 경우 내외부 통제장치를 강화하고 있다는 시사점을 얻었다. 이러한 결과를 토대로 ①자치경찰제 도입과 국가경찰의 운영방향을 개선해 권한 분산과 정부조직 운영의 효율성을 촉진하고 ②양 조직이 함께 대응하고 있는 대공, 대테러 업무는 안보현실과 대테러 업무의 특성, 전문성, 기존 법제를 고려하여 국정원으로 통합하며 ③입법미비로 유명무실화된 정보업무의 통합기능 복원을 위해 국정원법 개정을 통해 국정원이 각급 정보기관에 대해 실질적인 기획조정이 가능토록 하는 한편 ④권력기관의 내외부 통제를 강화하기 위해 시민도 참여하는 정보감시위원회를 만들고 경찰위원회에 직원의 소청심사, 경찰청장 해임요구권 등을 부여함으로서 경찰을 실질적으로 통제할 수 있게 기능 및 조직을 개편하도록 제안하였다.
특히, 장기적 방안으로 자치경찰제가 정착되고 경찰과 검찰이 각각 수사와 기소를 담당하는 수사체재로 결정되는 즈음에 국정원의 국내조직과 국가경찰의 테러, 대공, 국제범죄, 방첩조직을 통합해 국내 정보 및 보안업무를 총괄하는 가칭 ‘국내보안청’ 신설을 제안하였다. 이는 특정 국가기관에 집중된 권한을 분산시키고 중복업무를 통합하여 조직의 생산성을 높이기 위한 방안이다. 그동안 국가안위를 위해 꼭 필요하지만 국정원에 권한이 집중될 수 있다는 논리에 밀려 무산된 바 있는 테러방지법, 비밀 관리 및 보호에 관한 법, 국가사이버위기관리법 제정에 유리한 환경으로 작용할 수 있을 것이다.
국가 안보와 사회안전은 한 치의 오차 없이 수행되어야 하므로 국정원과 경찰 조직이 정권교체시기마다 국민에게 보여주기식으로 개편되어서는 안되며 정보 및 수사환경의 변화 등 필요성이 제기될 때 마다 지속적으로 진행하고 항상 국민의 편에서 이루어 져야 할 것이다.

영어초록

After the liberation, there were dozens of times of government reorganization which the target was mainly general ministries. However, Reorganization of powerful agencies(so called) like National Intelligence Service and National Police Agency is difficult to find. Specially, merger and separation of them. Some of the reorganization in the institutions of power are only internal adjustment. However, there are many nested functions between two agency, therefore finding reorganization plan from both agencies can improve the efficiency of the budget and make synergies, which is reasonable.
As a result, for the first, I grips organizational problems of these agencies through analyzing the reform debates which are related with them to find ways for reorganization. And then, I got the suggestive ideas through research on intelligence community and police in the United States that it pursues specialized, decentralization of authority, well-integrated institutional arrangements to raise the decentralized agency's work efficiency, and strengthens the internal / external control device of them in case of inevitable concentrated authority. Based on these results, suggested as following ideas ① introduce the autonomous police system for decentralizing, and revamp of national police organization ② integrate anti-espionage, counter-terrorism work, which both organizations are controlling together, into the NIS by considering security realities and the characteristics of the counter-terrorism activity, expertise, and existing legislation, ③ NIS has planning and control authority for integration of the intelligence activity in Korea through the revision of NIS act, ④ created Intelligence Oversight Committee participating citizens and reorganize the Police Committee to check police work in high intensity by vesting strong authority including Commissioner General dismissal claim to strengthen internal and external control.
Especially, in a long term plan, I present to establish 'the Domestic Security Agency' as new tentative title, which conduct domestic intelligence and security activity as a whole, united NIS`s domestic organization with counter-terrorism, anti-NK espionage, international crime, counter-intelligence units of NPA. It will be created possibly when the autonomous police system is settled, and the police and prosecutors, each of which is responsible for the investigation and prosecution. This is the way to increase the productivity of the organization by integrating duplicated work of both organizations, and decentralizing authority which concentrated in a certain agency. The foundation will be favorable environment to enect Counter-Terrorism Act, Law for Management and Protection of Secret, Cyber Crisis Control Act which have been not legislated by reason of possibility, that NIS get concentrated authority.
