초록

장기요양요원의 법적 지위를 규명하는 것은 장기요양보험제도의 지속가능성을 높이고, 장기요양급여의 질을 향상시키며, 지역사회 돌봄을 강화하는 데 있어 중요한 의미를 가진다. 장기요양요원을 둘러싼 여러 관계 중 수급자와의 관계에서는 역학관계가 일정하지 않다는 다중적 성격이 고려되어야 하고, 급여 제공 과정에서 돌봄을 필요로 하는 취약성을 지닌 수급자의 인권이 침해되는 일이 없어야 하며, 수급자에 의해 장기요양요원이 괴롭힘을 당하거나 권리를 침해 받는 일이 허용되거나 방치되어서는 아니 된다. 장기요양급여 제공 현장에서 마주치는 양 당사자인 수급자와 장기요양요원 중 어느 누구에 대한 보호를 소홀히 하거나 일방의 보호에만 치우친다면 장기요양보험 제도는 그 목적을 제대로 달성할 수 없기 때문이다.

영어초록

Among many players engaged in the long-term care insurance scheme, a long-term care worker provides his/her care service to the elderly at the forefront of the scheme and stands at the center of various relationships surrounding the scheme. With the belief that it would be important to review (i) a long-term care worker's legal relationships with other players within the long-term care insurance scheme and (ii) the legal status of long-term care workers in order to ensure the sustainable development of the long-term care insurance scheme, this study has reviewed a long-term care worker's relationship with his/her beneficiary.
To look into a long-term care worker's caregiving work to older persons, it is not sufficient to take a look at a care worker's service only from the perspective of protecting a long-term care worker as an employee in the relationship with a long-term care institution (the care worker's employer). We also have to consider a long-term care worker's complex relationship with his/her beneficiarywho needs to be taken care of by the care worker and thereby is at a vulnerable position, on the one hand, but who is also able to exercise the right to choose in regard to a long-term care worker and compels the care worker to do things beyond his/her scope of work, on the other hand.
In the course of providing benefits, the human rights of beneficiaries with vulnerabilities that require care shall not be violated, nor shall long-term care workers be allowed or neglected to be harassed or infringed on their rights by beneficiaries. This is because the long-term care insurance system cannot achieve its purpose properly if it neglects the protection of either beneficiary or long-term care worker who is the two parties to the site of providing long-term care benefits or is biased toward one-sided protection.
