초록

오늘날 1인 미디어 시대로 불릴만큼 다양한 경로를 통해 미디어를 접할 수 있는 경로는 다양해졌고, 상대적으로 매스미디어의 역할은 축소되고 있는 반면, 거대한 알고리즘의 체계 속에서 미디어는 보다 밀접한 맞춤형 서비스로 특화되어 다양해 지고 있다. 한편 현대사회는 알고리즘에 의해 조합되는 사회라 부를 수 있다고 할 수 있고, 이는 곧 알고리즘 독재로 이어질 가능성을 의미한다는 점에서 헌법적 문제에 대한 고찰이 요구된다.
헌법은 변화하는 시대에 맞추어 끊임없이 발전해왔고, 알고리즘 시대에도 이에 맞는 규범적 틀을 제시할 필요가 있다. 공학적 관점에서 접근하던 알고리즘이 미치는 사회적 영향력을 고려할 때 쉽게 접근할 수 있고, 이해하기 쉬운 정보를 제공받을 권리 또한 반드시 국민이 인식해야 할 권리이다.
Access권과 알권리는 일반적으로 접근할 수 있는 정보를 받아들이고 받아들인 정보를 취사･선택할 수 있고, 의사형성 및 여론형성에 필요한 정보를 적극적으로 수집할 수 있는 권리를 의미한다. 과거 매스 미디어 중심의 여론 형성 체계가 새로운 변화를 맞아 국민의 정보욕구를 충족시켜주고 이를 통하여 소극적 지위에 머무르고 있던 국민이 주권자의 입장에서 적극적으로 정보전달체계에 개입할 수 있도록 변화되는 중심에 바로 Access권 및 알권리의 역할이 있다고 본다.
국민은 선택의 여지없이 알고리즘이 걸러낸 정보만을 습득하고, 맞춤형 정보라는 기분좋은 단어로 포장되어 다가온 존재에 대해 여과없이 만족한다. 그러나 이러한 맞춤형 정보는 곧 민주주의의 본질적 전제라고 할 수 있는 다원주의에 대한 침해가 될 수 있는 소지는 분명하다.
나아가 현대 사회에서 이미 널리 활용되고 있는 알고리즘이 아무런 검증없이 국민의 정보접근을 방해하거나 알권리까지 훼손하지 않는지 검토하고 이를 검증할 필요가 있다고 판단된다. 책임은 없이 국민을 정보의 주체자가 하는 단순한 정보 제공자의 지위로 격하시킬 우려가 다분하고 주어진 정보에 만족하게 하는 기능을 하는 것이 알고리즘이 아닌지 검토할 시점이기도 하다.

Today, the channels through which media can be accessed through various channels have been diversified enough to be called the era of single-person media, and the role of mass media is relatively reduced. On the other hand, we live in a system of huge algorithms, and it can be said that modern society can be called a society that is combined by algorithms, which means the possibility of leading to an algorithmic dictatorship.
The constitution has been constantly evolving in line with the changing times, and it is necessary to remove the normative framework that fits the algorithm even in the age of algorithms. Considering the social impact of algorithms approached from an engineering perspective, the right to be provided with easily accessible and easy-to-understand information is also a right that the public must recognize.
The right to access and the right to know mean the right to accept generally accessible information, to cook and select the germinated information, and to actively collect information necessary to form opinions and opinions. Access right to the center of change so that the public opinion formation system centered on mass media in the past meets the new change and meets the people's information needs, and through this, the people who have been in a passive position can actively intervene in the information delivery system from the point of view of the sovereign I think there is a role of right to the Access and right to know.
People have no choice but to acquire only the information filtered by the algorithm, and are unfiltered and satisfied with the existence that has come wrapped up in the pleasant word of customized information. However, it is clear that such customized information could infringe on pluralism, which is an essential premise of democracy.
Furthermore, it is judged that it is necessary to review and verify whether exposure to distorted information due to algorithm bias does not undermine the people's right to know. There is a high risk of downgrading the public to the status of a simple information provider that the subject of information does, and it is also a time to examine whether the algorithm functions to satisfy the given information.
