초록

산업사회로 발전한 한국에서 이제 안전은 양보할 수 없는 국가적 과제가 되었고모든 국민이 안전권을 누려야 한다는 생각은 지극히 당연하게 받아들여지게 되었다. 그럼에도 불구하고 기업활동으로 인해 발생하는 산업재해와 시민재해는 우리사회에 큰 충격을 주고 있다. 산업재해와 시민재해로부터 국민의 생명과 안전을 지키고자 중대재해처벌법이 제정되어 시행되고 있다.
중대재해처벌법은 사업 또는 사업장, 공중이용시설 및 공중교통수단을 운영하거나 인체에 해로운 원료나 제조물을 취급하면서 안전 ‧ 보건 조치의무를 위반하여 중대산업재해나 중대시민재해가 발생한 경우 해당 회사의 사업주, 경영책임자 그 밖에 관련 공무원, 법인 등을 처벌하는 법률이다. 즉 이를 통해 중대재해를 예방하고시민과 종사자의 생명과 신체를 보호하고자 한다.
산업안전보건법 체제 하에서는 산업재해가 발생한 사업장의 현장 근로자나 현장 관리자가 처벌을 받는다. 그렇지만 중대재해처벌법 체제 하에서는 중대재해가발생하는 경우 사전에 안전보건 조치를 제대로 수립하고 집행하지 못한 사업주, 회장 또는 경영책임자가 처벌받는다. 이러한 중대재해처벌법에 대해서 경제인 단체는 기업의 자유를 위축시킨다고 비판하고 있다.
지금 이 법률은 시행된 지 2년이 지났다. 아직 중대재해로 인한 사망사고가 현저히 줄어들었다고 볼 수는 없다. 그러나 기업들로 하여금 산업안전보건에 보다 더신경을 쓰도록 하는 효과는 확실히 드러나고 있다고 볼 수 있다.

영어초록

In South Korea, a highly industrialized country, safety has become a non-negotiable national issue. And the idea that all citizens should enjoy the right to safety has become an extremely valid idea. Nevertheless, industrial accidents and civic accidents caused by corporate activities have had a profound impact on our society. In order to protect the lives and safety of people from industrial and civic accidents, the Serious Accidents Punishments Act has been enacted and implemented. One of the most notable recent changes, especially in South Korea, is the Serious Accidents Punishment Act. This Act was enacted in 2021 and has been in effect since 2022.
The Serious Accidents Punishment Act is an Act that punishes business owners, a president of the company, responsible managerial persons in the event of a serious industrial accident or serious civic accident. The purpose of this Act is to prevent serious accidents and protect the lives and physical safety of citizens and workers by prescribing the punishment, etc. of business owners, responsible managing officers, public officials, and corporations that have caused casualties in violation of their duties to take safety and health measures while operating businesses or places of business, public-use facilities, or public transportation vehicles or handling materials or products harmful to human bodies.
Under the Occupational Safety and Health Act framework, the field workers or managers at the site of an industrial accident are punished. However, under the framework of the Serious Accidents Punishments Act, if an industrial or civic accident occurs, it is the top-decision makers like business owner, company president or responsible managerial persons failing to establish and implement proper safety and health measures beforehand who are punished. As to this Act, the Federation of Economic Organizations criticizes for suppressing corporate freedom.
The Act is now just two years old. I have not yet seen a significant decrease in death cases in serious accidents. However, it is clear that the Act is having an effect on companies to pay more attention to safety and health.
