조세쟁송제도 개정방향에 대한 시론: 행정소송법 개정(안)의 주요내용을 중심으로 (The Study of Tax Litigation System Reform:In Reference to the Revised Bill of Administrative Litigation Law)

초록

조세행정법 분야는 전통적으로 행정법의 가장 전형적인 권력적 행정작용으로 인식되어 왔으며, 일반행정법 이론이 공유되며, 행정쟁송분야의 법령은 조세행정분야에도 중대한 영향을 미친다. 이 글에서는 2013년도 행정소송법 개정안의 쟁점을 중심으로 납세자의 권리구제 강화차원에서 조세쟁송의 개정방향에 대해서 살펴보았다.
행정소송법 개정안의 원고적격 확대방향이 조세 관련 소송에서도 적용된다면 일정한 이해관계 있는 제3자의 소송의 제기가 가능할 수 있다. 행정소송법개정안의 원고적격확대는 조세관련소송의 원고적격 확대에도 직ㆍ간접적인 영향을 미칠 것으로 본다.
또한 행정소송법 개정되어 의무이행소송이 조세분야에서 제기되면 거부처분에 대해 보다 적극적인 구제가 가능해질 것이며, 거부처분의 범위를 재고할 필요가 있다. 그리고 현재 도입되지 않은 가처분제도가 행정소송에 도입되면 특히 환급결정과 관련해서 주요한 구제방법으로 사용될 수 있을 것이다.
행정소송법 개정안이 통과되면 종래 활성화되지 못한 당사자소송이 보다 강조되어 이해조절적 분쟁해결을 향한 행정소송법 발전에도 많은 기여를 할 것으로 본다. 이번 개정안에는 포함되지 못하였으나 명문으로 조세불복에 조정이나 화해제도를 도입하는 방안이 모색될 필요가 있다. 한편 행정심판법과 국세기본법 간에도 심판의 유형, 재조사결정 등 권리구제의 준사법화 강화의 관점에서 그 범위와 근거규정이 명확하게 제시되어야 한다.
행정소송법의 전면적인 개정은 행정법각론에 해당하는 조세쟁송제도에도 주요한 영향을 미칠 것이 예상된다. 국민의 권리구제강화의 관점에서 조세쟁송제도에 대한 개정방향에 대해서 행정법적 연구가 보다 활성화되어야 할 것이다.

영어초록

It has been traditionally considered the most typical and powerful as the action in the field of tax administration. As the common theory of administration is influenced on laws and regulations of tax administrative dispute, it would be also significant on the field of tax administration. In this paper, I would focus on the key issues of administrative litigation revised items of 2013, and examine the direction for the improvement of tax disputes resolution system to strengthen th taxpayers’ right.
If the trend of expanding to ‘standing to sue’ is applied to tax litigation, it can be increased the ratio to filing a lawsuit of the third party more than before. It is seemed for the expanding to ‘standing to sue’ of the revised bill of administrative litigation law to have an important bearing on the tax litigation system reform.
And if ‘lawsuit of duty performance’ is acted in the field of tax litigation, it can be promotive to the aggressive relief from the refusal disposition. The scope of the refusal disposition should be reconsidered.
If provisional disposition system is introduced, it is possible to be the primary remedy in connection with the determination of the refund.
And, if administrative litigation law amendment passes, party suit that was not activated traditionally would be emphasized more, and contributed significantly to the development of administrative litigation method for understanding regulatory dispute resolution.
It has not been included in the draft revision of this time, but there is a need to plan to introduce a settlement system and the adjustment of the tax appeal. On the other hand, in relations of the basic law of national tax and the administrative appeals law, the grounds specified range of the types of trial decision, ‘reinvestigation decision’ and so on, must be clearly presented within the framework of the constable legal review of the right relief
