자율방범대 설치․운영에 관한 제정 법률안 비교분석 및 입법방향에 관한 연구 (Comparative Analysis on Legislative Bills and its Legislation Outlines regarding Installation and Operation of the Voluntary Crime Prevention Community)

초록

치안질서 유지와 범죄대응에는 경찰력만으로는 한계가 있다. 이러한 한계를 극복하기 위해 주민과의 동반자적 협력을 강조하는 새로운 패러다임이 지역사회경찰활동이며, 가장 중심적인 활동이 자율방범활동이라고 할 수 있다. 자율방범대는 전국에 4천여 개에 10여만 명이 활동하고 있지만 근거법이 마련되지 않아 지원과 관리가 매우 부실하게 운영되고 있다. 이에 17․18대 국회에서 제정법안이 발의되었지만 논의되다가 국회임기 만료로 자동폐기 되었고, 19대 국회에서도 7건이 발의되었지만 역시 자동폐기 될 가능성이 높아 보인다. 이에 발의된 7건의 제정법안들을 비교․분석하여 보다 효율적이고 바람직한 제정법안을 도출하였다.
첫째, 자율방범대의 조직․운영 단위는 읍․면․동 단위보다는 지구대․파출소 단위로 이루어져야 하며, 필요하다면 한 개의 파출소나 지구대에 두 개 이상의 자율방범대를 허용할 필요가 있다.
둘째, 자율방범대는 신고만으로 설립됨을 감안하여 대원의 결격사유는 명확하게 규정되어야 한다.
셋째, 활동범위는 범죄예방을 위한 순찰, 청소년 선도 및 보호, 기타 경찰이 지역안전을 위해 요청하는 활동으로 해야 한다.
넷째, 자율방범대원 위촉은 방범대장의 추천으로 경찰서장이 하고, 해촉은 결격사유가 발생하면 경찰서장이 의무적으로 해촉하는 것이 타당하다.
다섯째, 치안보조 업무의 특성인 위험성과 경찰관련성을 감안하여 자율방범대의 교육과 지도, 포상은 경찰이 주체가 되어야 하며, 다만 포상은 단체장도 가능하도록 하는 것이 자율방범대의 사기진작에 도움이 된다.
여섯째, 정치활동은 당연히 금지되어야 하며, 이러한 금지의무는 명시적으로 규정할 필요가 있다.
일곱째, 연합회나 중앙회 설립은 자율방범대가 정치적 이익집단화 할 가능성이 있기 때문에 설립을 허용하는 것은 재고되어야 한다.
여덟째, 예산지원 및 재해보상 등의 필요성은 인정되어 이에 대한 예산지원 근거 조항은 규정되어야 하지만, 현재와 같이 예산지원은 자치단체에서, 지도․관리는 경찰에서 하는 이원적 체계를 개선하여 일원화할 수 있는 방안을 찾아야 한다.

영어초록

There is a limit for maintenance of public order and crime response solely by police force. A new paradigm to accentuate collaborative cooperation to overcome such limit is community policing, and the most centered activity is voluntary crime prevention activity. There are over one hundred thousand voluntary crime prevention crews in over four thousand voluntary crime prevention teams, but since there is no legal basis, each voluntary crime prevention team faces difficulties in operation and management. Although the legislative enactment was initiated in the 17th and 18th congress, after few discussion, due to expiration of term of congress, it was automatically scrapped. There were seven bills were initiated in the 19th congress as well, but again, these seem to be automatically scrapped. Therefore, these seven initiated bills were compared and analyzed for extraction of more efficient and desirable legislative bill.
First, the structural and operational unit of voluntary crime prevention team shall be in patrol division or police substation instead of eup/myeon/dong (town/subdivision/district), and if required, two or more voluntary crime prevention teams shall be set in one police division or one police substation.
Second, considering that the voluntary crime prevention team is established only by report, reasons for disqualification of team crew shall be clearly regulated.
Third, the scope of activity shall be limited to patrol for crime prevention, guidance and protection of youth, and activities requested by other police for regional safety.
Fourth, appointment of voluntary crime prevention team shall be done by the chief of police, and release of appointment shall be done also by the chief of police if there are reasons for disqualification.
Fifth, considering risk and police-relevancy as characteristics of public order, training, instruction, and reward of voluntary crime prevention crew shall be held by police. Yet, availability of rewarding a crew by a local government head may become morale booster for voluntary crime prevention.
Sixth, any political activity by voluntary crime prevention shall be prohibited, and such prohibition shall be stated to be regulated.
Seventh, establishment of conference or central association of voluntary crime prevention shall be reconsidered as there is a possibility of formation of political interest group.
Eighth, necessities such as budget support and accident compensation shall be recognized, and the legal basis for such budget support shall be regulated. However, the conventional dual system of receiving budget support from local government and instruction and management from police shall be improved to be unified through a solution.
