자치경찰제법(안)상 자치단체장의 자치권한 행사 제한과 관련된 쟁점 (Issues Concerning the Restriction of Local Government Governor's Right Under the Current Autonomous Police Law Proposal)

초록

이 연구는 정부가 입법추진 중인 「국가경찰과 자치경찰의 조직 및 운영에 관한 법률」(안) 상 헌법 및 지방자치법이 규정한 자치단체장의 권한과 역할을 제한할 우려가 있는 쟁점을 분석하고 그 개선방향을 제시하고자 하였다.
헌법 및 지방자치법상 자치단체장의 권한은 지방자치단체 대표권, 행정권, 직원임면권, 재정권, 지방의회 견제권, 규칙제정권, 재의권, 주민투표회부권 등이다. 이를 바탕으로 「국가경찰과 자치경찰의 조직 및 운영에 관한 법률」(안)상 자치단체장의 권한의 제한 또는 침해 관련 쟁점을 다음과 같이 정리할 수 있다.
첫째, 자치단체장의 자치경찰대표로서의 지위를 부여하지 않았다. 둘째, 자치단체장의 자치경찰본부 및 자치경찰대에 대한 지휘감독권 행사를 제한하고 있다. 셋째, 자치단체장의 경찰위원회 위원 임용권 행사가 제한되고 있다. 넷째, 자치단체장의 자치경찰공무원에 대한 임용권 행사가 제한되고 있다. 다섯째, 자치단체장의 자치경찰 수사사무에 대한 지휘감독권이 배제되고 있다. 여섯째, 자치단체장의 자치경찰 무기사용에 대한 지휘감독권 행사가 제한되고 있다. 일곱째, 자치단체장의 재의요구권 행사를 제한하고 있다.
이와 같은 문제점이 개선되지 않는다면 자치경찰은 국가경찰과 상호협력 및 대등한 파트너 관계가 아니라 국가경찰사무를 이관 받아 수행하는 국가경찰의 지휘감독, 즉 예속적 혹은 대행적 관계가 될 것이다. 따라서 이 연구는 자치단체장의 권한을 침해하지 않으면서 동시에 자치경찰제의 도입취지를 살릴 수 있도록 위 자치경찰제법안의 보완방향을 제시하였다.

영어초록

This study examined whether the autonomous police proposal restricts the authority and role of the local government governor under the Constitution and Local Autonomy Law, and suggests the improvement direction. Under the constitution and local autonomy law, the local government governor include the right of represent the local government, the right of administration, the right of hire employees, the right of finance, the right of local assembly correspondence, the right of enact rules, right of reconsideration request, and right of the referendum to vote. Based on this, the contents of restricting the authority of the local government governor under the Act on the Organization and Operation of National Police and Autonomous Police are as follows. First, it does not give the position of self-governing police representative of the local government governor. Second, it restricts the exercise of the command supervision of the local government governor to the autonomous police headquarters and the autonomous police. Third, the right to hire members of the autonomous police committee of the local government governor is restricted. Fourth, the exercise of the right of appointment of self-governing police officers by the local government governor is restricted. Fifth, The authority to supervise the autonomous police investigations of the local government governor is limited. Sixth, the local government governor restricts the exercise of the command supervision over the use of weapons by the autonomous police. Seventh, it limits the right of self-righteousness of the local government governor.
If these problems are not improved, the autonomous police will not be a cooperative and equal relationship with the state police, but will be a command and supervisory relationship of the state police who carries out the state police affairs. Therefore, in order to supplement the authority of the local government governor, and to further promote the intention of introducing the autonomous police system, talks and discussions between the National Assembly, the governing party, and academia are needed.
