초록

지방재정분권을 강화하기 위하여 2018년 3월 22일 발표된 정부의 개헌안에서는 지방의회가 법률에 위반되지 않은 범위에서 자치세를 신설할 수 있도록 하였다. 그러나 “자치세”의 의미가 분명하지 않고, 주민의 권리제한이나 의무부과에 대한 조례의 제정은 법률의 위임이 있는 경우에만 가능하다는 제123조 제1항과 “조세의 종목과 세율은 법률로 정한다”라는 제63조가 충돌하는 부분도 있다.
본 논문에서는 정부개헌안에 포함된 자치세와 관련된 법적 쟁점들을 분석ㆍ검토하여 보완방안을 제시하고, 정부개헌안이 지향하고 있는 지방분권 강화에 부합하는 과세자주권 확대방안을 모색하였다.
개헌안에서 제도적으로 보장하고 있는 자치세의 신설에 관하여는 그 절차를 전국적으로 통일시키고, 국가정책적인 차원에서 일정한 관리가 필요하므로 이에 관한 것을 법률로 제정할 필요가 있다. 법률은 지방세기본법이 아닌 「자치세의 도입절차 및 부과징수에 관한 법률」을 별도로 제정하는 것이 바람직하다. 아울러 지방자치법, 지방재정법 등의 개정도 필요하며, 나가가 과세자주권을 확대하고 그 운용을 활성화하기 위한 지방교부세법의 개정도 필요하다.
정부개헌안이 2018년 5월 24일 국회본회의에서 의결정족수 미달로 처리되지 못하고 종결되었는데, 향후에 다시 개헌이 논의될 경우에는 정부개헌안 제124조 제2항의 조문이 보완되어야 한다. 헌법 개정으로 “자치세조례주의”가 제도적으로 보장되더라도 지방교부세와 연계하여 인센티브를 제공함으로써 지방정부에서 적극적으로 자치세를 활용하도록 하여야 한다.

In order to solve the problem of tax autonomy and to strengthen the decentralization, the government's amendment proposal announced this year allows the local council to establish self - government tax not exceeding the law. However, Article 123, Paragraph 1, that the meaning of “self-governing tax” is not clear, and that the enactment of the ordinance imposing restrictions or obligations on the residents is possible only when there is delegation of the law, and There are also conflicts with the provisions of Article 63, “Tax shall be determined by law.” This study analyzes and examines the legal issues of the contents of the new self - governing tax included in the amendment proposal of the government and establishes a reasonable standard. and We will also seek to expand the sovereign rights of taxpayers in accordance with the strengthening of the decentralization that the government reform proposal is aiming at.
The procedure should be unified nationwide on the establishment and imposition of self-governing tax, which is systematically guaranteed by the Constitution. Although the Constitution guarantees this, from the standpoint of the nation as a whole, it is necessary to formulate a law on this matter because it requires certain management from a national policy standpoint. It is also necessary to revise the local autonomy law and the local fiscal law in relation to the introduction of the self-governing tax and the collection and collection procedure of the constitutionally amended constitutional amendment. It is also necessary to amend the Local Tax Act to expand taxation sovereignty and activate its operation.
If there is no plan for activation in connection with the local allocation tax, the local government will not actively participate in the creation and operation of self - governing tax. In the future, if the introduction of self-governing tax is systematically guaranteed by the Constitution, further education and other processes related to the members of the local council are needed so that the local council can actively use it.
