초록

기존의 이민관련법을 통합한 기본법으로서 그리고 단일법 체계로서 이민법 제정안은 이민정책에 대하여 국가와 지방자치단체의 책무 등에 관한 기본적인 사항을 규정함으로써 이민사회를 정착하여 사회통합과 국가발전에 이바지함을 목적으로 하여야 할 것이다. 이를 위하여 우선적으로 법률적으로 이민사회 및 이민정책 등 관련 용어를 정의할 필요가 있으며, 이민정책의 기본이념을 다문화가족 및 재한외국인의 정책 참여 장려, 그들에 대한 차별의 방지, 전통 문화와 그들이 가진 각각의 문화를 함께 계승하여 발전시키는 것이어야 한다. 정부는 일반 행정의 모든 시스템의 일관성을 갖고 있는 기본계획과 시행계획을 갖고 있다. 즉 구체적으로 이를 집행하는 주체로서 정부는 이민정책과 관련된 기본계획을 5년마다 수립하고, 이민정책위원회의 심의를 거쳐 확정하도록 하여, 관계 중앙행정기관의 장은 기본계획에 따라 소관업무에 관하여 연도별 시행계획을 수립·시행하도록 하고, 지방자치단체의 장은 중앙행정기관의 장이 법령에 따라 위임한 사무에 관하여 지방자치단체의 연도별 시행계획을 수립·시행한다. 나아가 관계 중앙행정기관의 장은 다른 중앙행정기관의 기본계획 또는 시행계획이 그 중앙행정기관의 이행계획의 시행에 지장을 초래하거나 초래할 우려가 있다고 인정할 때에는 위임입법에 의하여 상호 협의·조정하도록 하고, 이 경우 중앙행정기관의 장은 그 협의·조정 사항에 관하여 이민정책위원회의 의견을 들을 수 있도록 해야 할 것이다. 국가와 지방단체에 두 행정주체가 다른 법령에 따라 수립하는 이민 행정계획과 정책이 이민정책의 기본이념을 바탕으로 하여 기본계획 및 시행계획과 조화를 이루도록 할 의무를 수행해야 할 것이다. 국가와 지방단체가 이민정책과 관련된 법령의 제정과 개정을 거듭하며, 중장기 행정계획을 수립하거나 변경하려는 때에는 이민정책위원회에 그 내용을 통보하고, 이민정책위원회는 이를 검토하여 그 검토결과를 관계 기관의 장에게 통보하도록 하며, 관계 기관의 장은 그 통보받은 검토결과를 타당하다고 인정되는 범위에서 관련 법령의 제정이나 개정을 통하여 중장기 이민 행정계획의 수립하거나 변경에 반영하도록 해야 할 것이다. 마찬가지로 이민정책에 관한 중요 사항을 심의하기 위하여 법무부 소속으로 이민정책위원회를 두며, 이민정책위원회에서 기본계획 및 시행계획 수립 및 추진, 관계 기관 간의 이민정책의 조정 및 지원에 관한 사항 등을 심의하도록 해야 할 것이다. 그리고 이민 관련 독립행정청으로서 이민청을 신설하여 이민행정의 일관성과 통일성을 갖춰 이민정책의 방향을 장기적으로 설정하여 추진해야 할 것이며, 이러한 과정에서 또한 정부가 이민사회에 관한 지식이나 정보를 보급하도록 하고, 이를 위해 이민정보망을 구축 및 운영할 수 있도록 하며, 특히 국가와 지방단체는 이민정책과 관련된 기본적인 조사를 통하여 연구 기반구축 및 교육 프로그램을 개발하고 관련된 홍보 업무를 수행할 수 있도록 하여야 할 것이다. 결국 이민법을 제정을 통하여 독립행정청의 이민청이 다른 국가기관과 지방단체를 협업 속에서 이민 및 그 가족을 비롯한 재한외국인에게 필요한 재정적이든 행정적 지원을 함으로써 헌법적 가치질서를 추구하며 사회통합을 이끌어 낼 수 있을 것이다.

영어초록

The enactment of immigration laws as a basic law integrating existing immigration-related laws and as a single legal system should aim to contribute to social integration and national development by establishing an immigration society by stipulating basic matters concerning the responsibilities of the state and local governments on immigration policies. It is necessary to first define related terms, such as immigration society and immigration policy, legally, and the basic ideology of immigration policy should be to encourage multicultural families and foreigners to participate in policies, prevent discrimination against them, and inherit and develop traditional cultures and their respective cultures together. The government has a basic plan and implementation plan that are consistent with all systems of general administration. As the subject of implementing it, the government shall formulate and implement an annual implementation plan related to immigration policy every five years and confirm it after deliberation by the Immigration Policy Committee. Furthermore, if the head of the relevant central administrative agency deems that the basic plan or implementation plan of another central administrative agency may interfere with or cause the implementation of the implementation plan of the central administrative agency, he/she shall consult and coordinate with each other by delegated legislation, and in this case, the head of the central administrative agency shall be able to hear the opinions of the Immigration Policy Committee on the matters of consultation and coordination. The state and local governments shall be obliged to ensure that immigration administrative plans and policies established by the two administrative entities under different laws and regulations are harmonized with basic plans and implementation plans based on the basic ideology of immigration policy. When the state and local governments intend to enact or amend mid- to long-term administrative plans, they shall notify the Immigration Policy Committee of the details thereof, and the Immigration Policy Committee shall review them and notify the head of the relevant agency of the review results, and the head of the relevant agency shall reflect the notified results of the review in the formulation or change of mid- to long-term immigration administrative plans through the enactment or revision of relevant laws and regulations to the extent that they are deemed reasonable. The Immigration Policy Committee should be established as a member of the Ministry of Justice to deliberate on important matters concerning immigration policy, and the Immigration Policy Committee should deliberate on the establishment and implementation of basic plans and implementation plans, as well as matters related to the coordination and support of immigration policies among related organizations. The Immigration Office should be established as an independent administrative agency for immigration to establish and implement long-term immigration policy directions with consistency and uniformity of immigration administration. In this process, the government should disseminate knowledge and information about immigration society and establish and operate immigration information networks. In particular, the state and local governments should develop research foundations and education programs through basic surveys related to immigration policies, and conduct related public relations tasks. The enactment of the Immigration Act will enable the independent administrative agency's immigration agency to seek constitutional value order and lead social integration by providing necessary financial and administrative support to immigrants and their families and foreigners living in Korea.
