공동주택 관리비의 투명성 제고방안에 관한 연구 (A Study for the Improvement of the Transparency in the Allocation and Execution of the Apartment Management Expenses)

초록

우리나라의 주거형태는 부족한 토지문제와 주택난 해소를 위하여 1970년대와 1980년대는 단독주택의 비중이 전체의 약 90%를 차지하였으나 1990년대 이후 주택공급 확대정책으로 아파트의 비중이 증가하면서 2010년에는 아파트가 주거유형별 구성비에서 59%의 비중을 차지하게 되었다.
아파트와 같은 공동주거 형태는 이웃과 공동으로 관리해야하는 공용부분이 발생됨에 따라 관리사무소를 통하여 전체 아파트 단지의 관리를 시행하고 각 세대별로 관리비 분담을 하는게 되며, 그 집행을 원활하게 하기 위하여 입주자 대표회를 구성하여 관리사무소 업무를 확인 결재하는 시스템이 도입되었다. 그러나 입주민과 입주자 대표의 전문성 부족 및 관리비 집행자들의 도덕성 결여 등으로 인하여 관리비의 투명성에 대한 문제가 계속적으로 야기되고 있는 실정이다.
이 논문은 입주주민이 납부하는 관리비 의 항목별 검토와 각 항목별 비용 산정방식과 분배방식을 검토하여 공정한 분배를 할 수 있는 방안을 제도적으로 그리고 실질적으로 찾고자 한다.

1. CONTENTS (1) RESEARCH OBJECTIVES Approximately 70% of the Korean people are living in the apartment, however lots of disputes between the dwellers are occurring due to the matter of transparency of the allocation and execution of the apartment management expenses. The reason is the lack of way assuring the transparency in distributing and implementing the cost. The maintenance system of the apartment is operated by the dwellers themselves with the maintenance company and they do not have enough specialty regarding the maintenance in terms of law, accounting and especially technology. Therefore, the purpose of this study is to find the problems of the apartment maintenance and to improve the maintenance system for the apartment in terms of law, social ethics and consciousness of participation.




(2) RESEARCH METHOD This study reviewed the literature and law related, and the interview and the questionnaire were performed directly to the maintenance manager, the representative of the dwellers and the dwellers in order to get the accurate response regarding the recognition of the maintenance cost how it was calculated and distributed.




(3) RESEARCH FINDINGS After reviewing the related law and literature and doing the interview with the people related with the apartment maintenance cost, this study could find that the participation system for the apartment maintenance should be improved and in order to realize the purpose of the law related, the law should be actualized. Thereby the law could be practised according to the real situation. Additionally, it was found that the representative of the dwellers needs to have the morality in order to serve his/her neighbours correctly.




2. RESULTS The purpose of maintenance cost is to maintain the apartment good and to bear the cost impartially. Therefore fiduciary duty is strictly required. However, due to the lack of moral values and a sense of responsibility, many irregularities have occurred and those concerned were disciplined for those irregularities. Besides, the law related is apart from the real situation and it was difficult to apply to the real situation. Conclusively we need to revise the law accordingly and to develop the way of the realization of the law efficiently and effectively. Lastly, as the law is the minimal morality, the persons related with the apartment maintenance management should be educated repeatedly to have the morality.
