국제사회 안에서 가톨릭 교회: 국제법상의 주체로서 성좌 (The Catholic Church in the International Community: The Holy See as the Subject of the International Law)

초록

이 세상에는 불교, 이슬람교, 유교, 기독교 등 다양한 종교들이 있고 인류의 많은 사람들이 이런 종교에 속해 신앙생활을 한다. 이런 종교들 가운데 가톨릭교회는 국제사회에서 그 사명수행을 위해 개별 신자들을 통해서 활동하기도 하지만 국제법상의 주체인 성좌를 통하여 국가나 다양한 국제기구에서 활동한다.
가톨릭교회가 국제 사회에서 활동할 때 실질적 활동 주체는 성좌이다. 한국에서는 많은 이들에게 이 용어보다는 로마 교황청, 혹은 바티칸 시국 등의 표현이 더 익숙하며, 교회는 바티칸이라는 국가의 지위로서 국제사회에서 활동하고 있다고 이해되는 실정이다. 물론 국제사회에서 바티칸이라는 작은 영토를 점유하고 있는 국가가 존재하는 것은 사실이지만, 가톨릭교회가 활동하는데 있어서 바티칸 시국의 역할은 도구적 의미를 가지며, 실질적 차원에서는 성좌라고 하는 주체가 가톨릭교회를 대표하여 활동한다.
국제법 주체는 국제법이 부여한 권리와 의무가 규정된 자로서, 독립된 주권을 행사하면서 그 권리와 의무를 행사할 권리 능력을 지닌 자를 뜻한다. 이런 국제법상 주체는 법인격을 향유하면서 국제 관계 속에서 권리를 누리고 의무를 이행한다.
이 논문은 바로 가톨릭교회가 국제사회에서 활동할 때 국제법상의 한 주체로서 성좌에 대한 연구다. 바티칸 시국은 교회와 성좌의 자유롭고 독립적인 활동의 자유를 위해 라테란 조약을 통하여 탄생된 영토를 점유한 국가다. 성좌는 많은 국가들과 외교관계를 맺고 있고 다양한 국제기구에 참여하거나 협약을 체결하는데 항상 가톨릭교회의 중앙기구처럼 활동하고 있다.
이런 복잡한 개념들과 관계들을 연구할 필요가 있다. 이를 위해 먼저 가톨릭교회가 세상과 맺는 관계를 살피고 그 다음 그 실질적 활동 주체로서 성좌의 본질과 함께 도구적 성격을 지닌 바티칸 시국에 대해서 살펴보고자 한다.

영어초록

There are a variety of religions in the world including Buddhism, Islam, Confucianism, and Christianity and many of human beings are members of such religious communities in which they practice their faith. Among these religions, the Catholic Church acts not only through individual believers to fulfill the mission in the global community but also through the Holy See, which is a subject of international law, in countries or diverse international organizations.
When the Catholic Church acts in the international community, the real actor is the Holy See. Many Koreans are more familiar with the terms of Roman Curia or the Vatican City State than with the Holy See, and the Church is perceived to act with the status of State called Vatican in the global community. Of course, the fact is that the territorial microstate of Vatican exists in the global community but the Vatican City State plays only instrumental functions in Catholic Church’s activities, while effectively the Holy See acts on behalf of the Catholic Church as a Sovereign subject.
The subject of international law possess the rights and obligations bestowed by the international law and the ability to exercise independent sovereignty while they enjoy their rights and fulfill their obligations. These international legal entities enjoy legal personality as they exercise their rights and carry out their obligations in international relations.
This paper is a study on the Holy See as a subject of international law when the Catholic Church acts on the global stage. The Vatican City State is a territorial state created by the Lateran Treaty which had been signed to make sure that the Church and the Holy See are independent and free to act. The Holy See has diplomatic relations with many countries and the Holy See always plays the role of a central organization for the Church by participating in diverse international organizations or signing agreements.
Research on these complex concepts and relations is needed. To this end, I want to begin with the Catholic Church’s role in the international community and then find out the nature of the Holy See as a subject of international law as well as the fact that the Vatican City State is a state with instrumental functions for the Catholic Church and Holy See.
