유치권의 문제점과 개정 법률안에 대한 소고 (Study on Problems and the korean Civil Code Amendment Bill on the Right of Retention)

초록

유치권의 문제들에 대한 해결방안으로 제시된 개정 법률안은 임시적인 것이라 할 수 있었다. 종국적으로는 부동산유치권을 폐지해야 하는데, 현재 우리나라 여건상 곧 바로 폐지할 수는 없다. 따라서 미등기건물에 대해서만 예외적으로 인정하고, 기존의 유치권들에 대해서는 저당권설정청구권이라는 제도를 통해 그 충격을 완화하고자 한 것이다. 절충적인 방안으로서 최선의 선택이라 할 수 있다. 또한 인수주의에서 소멸주의로의 전환도 중요한 변화라 할 수 있다. 많은 변화를 모색한 개정 법률안에 대해 관점의 차이와 법리상 여러가지 비판들이 제기되었다. 이 개정 법률안도 일반 법률제도와 마찬가지로 양면의 칼날처럼 장단점을 지니고 있기 때문에 이익을 비교형량하여 결단해야 하는 입법정책적인 판단이 요구된다고 하겠다.
폐기된 개정 법률안에 대해 구체적인 분석과 함께 많은 비판들은 유용한 연구 성과라 할 수 있다. 기존 법률안과 이러한 비판들을 수용하여 새로운 법률안을 마련해야 할 시점이라 여겨진다. 그동안 많은 연구 성과들이 축적되어 있기 때문에, 이러한 것들을 활용한다면 20대 국회에서는 보다 합리적인 유치권으로 개정될 수 있으리라 여겨진다. 그러나 건설업계 등 이해관계자들의 반대도 적지 않기 때문에 가능한 한 모든 이해관계자들의 의견을 수렴하는 절차는 다시 거쳐야 할 것이다. 모든 이들을 만족시킬 개정안을 마련한다는 것은 지난한 과제라 여겨진다. 그러나 담보물권 제도가 왜곡 내지 무력화되는 현상을 좌시할 수 없는 것이기 때문에 결연한 입법적인 결단이 필요하다고 생각한다.

영어초록

The proposition presented as a solution to the problems of the right of retention was a tentative bill. Although, ultimately, the right to retention for immovable property should be abolished, it cannot be abolished immediately considering the circumstances of Korea. Therefore, while the unregistered immovable property is exceptionally recognized only to be abolished, the existing right of retention is intended to alleviate the impact through the system of claiming the right to demand the creation of mortgage. It is the best choice as an eclectic measure. The transition from the principle of acquisition to the principle of extinction is also an important change. There have been various criticisms in terms of differences in perspective and in the judiciary on the proposition, which have sought a lot of changes. This proposition has the advantages and disadvantages of the blades on both sides, like the general legal system, so it is necessary to make legislative policy judgments to decide profits by comparison.
Many criticisms, along with specific analysis on the proposition which was abolished in the 19th National Assembly), are useful research results. It is thought to be the right time to adopt a new legislative bill by accepting the legislative bill proposed and these criticisms. Since many research results have accumulated over the years, it is believed that the right of retention can be revised more rationally in the 20th National Assembly if we take advantage of these results. However, since there are so many oppositions from stakeholders such as the construction industry, the process of collecting opinions from all stakeholders as much as possible should be gone through again. It is considered very difficult to prepare a proposition to satisfy all of them. However, I think that it is necessary to make a decisive legislative decision because it cannot be tolerated and overlooked that the phenomenon in which the system of the right of retention is distorted or neutralized.
