초록

본 연구는 경기도지정문화재 주변 현상변경 신청안에 대하여 불․허가 처분의 과정과 유형을 객관적으로 분석하여 현상변경허가 심의결과의 경향과 문제점 및 특성을 도출함으로써 현상변경허가 심의 결정에 있어 기초적 자료를 제시하는 것을 목적으로 한다.
2009년 경기도문화재위원회 심의에 상정된 248개의 안건 중 3회 이상 상정된 15건의 신청안을 연구대상으로 하였다. 문화재현상변경허가 심의 결과를 허가, 불허가, 재심으로 분류하여 처리결과 및 사유와 보완사항을 분석하고, 신청안의 신청 내용과 해당 문화재의 현상변경허가 처리기준안과의 비교를 통해 처리결과를 분석하며, 문화재와 현상변경허가 신청지의 이격거리 및 신청용도 별 결과처리 분석을 통해 결론을 도출하였다.
연구결과로는 첫째, 허가결정 처리는 다양한 시설의 신청이 특징으로 층수가 낮을수록 허가의 결과가 많았고, 문화재가 건축물인 경우는 신청 건물의 한옥양식 등 입면보완 후 허가결정이 되었으며, 신청지 부근의 기 건축물 유무가 허가결정의 주된 사유였다. 둘째, 불허가결정 처리의 경우 신청 시설은 근린생활시설이 많았고 대규모의 건설이 대부분이며, 1차 상정 결과에서부터 최종결정까지 결과의 변화가 적었고, 건축물로 인한 문화재 주변 경관 저해가 대부분의 불허가 사유였다. 셋째, 재심의결정 처리의 경우 도시개발사업 등 대형 개발사업에 있어 건축물의 높이 및 층수 변화는 큰 영향을 미치지 않았고, 무엇보다 기준안의 존재 유무가 결과 결정에 있어 큰 작용을 하였으며. 재심의 사유는 현장조사 후 재심의가 대부분이었다. 넷째, 현상변경허가 처리기준안이 존재하는 경우는 결과가 허가 또는 불허가 처리결정되었고, 처리기준안 상 두 구역에 걸쳐져 있는 신청지는 두 구역 중 좀 더 엄격한 쪽의 처리기준안이 적용되었으며, 신청지와 문화재와의 이격거리가 멀어질수록 불허가 및 재심의 결정이 적었으며, 허가 결정에는 영향을 미치지 않았다.
