장애인권리보장법(안)과 탈시설 정책 입법방안 (The Disabilities Rights Act(Bill) and Legislation for the Policy of Deinstitution)

초록

장애인의 탈시설-거주전환 정책은 장애인에게 온전한 시민으로서의 성원권을 회복하고 지역공동체에서 자립적 생활을 위한 전제요건으로 헌법상 긴급성과 중대성이 인정되는 현안의 과제이다. 탈시설-자립적 생활의보장은 장애인권리보장법안의 핵심적 내용이며 목적 그 자체이다. 장애인권리보장법안의 규율 내용 중 장애인 탈시설-거주전환 지원에 관한 규율내용을 분석하여 입법방향과 보완적 입법과제를 제안하였다. 장애인권리보장법안들은 규율체계와 관련하여 장애인복지법 제정 당시와는 달리 다수의 장애인법제가 시행되고 있는 입법상황을 고려하지 않고 광범위한 복지조치를 규정하여 체계적합성 문제와 규범의 실효성을 약화시키고 있다.
체계적합성을 확보하면서도 장애인권리보장법 제정 목적을 달성하기 위해서는 장애인권리보장법은 장애인의 권리와 시책에 관한 기본법으로 제정하고, 기본법에서 정하는 장애인의 권리와 정책은 이를 구체화하는 집행법으로 정비하는 기본법-집행법의 체계가 효과적인 입법전략임을 제안하였다. 한편 장애인 탈시설 정책의 헌법적 현안과제성과 지역공동체에서의 자립적 생활보장의 요건을 모두 충족시키기 위해서는 일반법의 형식이 아니라 특별법적 규율로 입법화되어야 한다. 이와 함께 장애인복지시설로서 거주시설을 폐지하고 탈시설-자립적 생활을 저해하는 법령을 일괄 정비하여야 한다. 장애인차별금지법을 개정하여 부당한 시설화를 장애인차별로 규정하고 복지서비스의 합리적 변경권을 규정할 필요가 있다. 이는 국가 탈시설-자립적 생활지원 계획의 수립과 이행에 대한 법원의 형성적 개입 가능성을 높여 효과적인 탈시설 정책을 추진하게 한다. 거주시설에서 장애인은 존엄한 삶과는 동떨어진 인간의 존엄과 가치를 무색하게 할 정도로 삶의 주체성을 상실하고 있다. 거주시설에서의 장애인의 삶은 우리 공동체가장애인에게 가하는 해악이며 학대이다.

영어초록

The deinstitution-residence transforming policy for persons with disabilities is to restore citizenship to people with disabilities and is a prerequisite for independent living in communities. This is an urgent and important constitutional task. The guarantee of deinstitution -independent living is a core content of the Bill of the Disability Rights Act and the legislative purpose itself. In this paper, the contents of the regulations on the support of deinstitution-residential transition are analyzed and the legislative direction and tasks to be complemented have been proposed. The Bills of the Disabilities Rights Act prescribes many welfare measures, which raises the issue of system suitability and weakens the effectiveness of the norm. In order to meet the systematic suitability and to realize its enactment, the Disabilities Rights Act was enacted as a basic law for the rights and welfare of persons with disabilities. In addition, the rights and policies of persons with disabilities provided for in the Basic Law should be enacted as an enforcement law embodying them. This basic law-enforcement system is an effective legislative strategy. On the other hand, in order to satisfy both the constitutional issues and the requirements for independent living guarantee in communities, the deinstitutionindependent living policy for the disabled should be legislated by the rules of special law, not general law. At the same time, it is necessary to abolish residential facilities and to eliminate all laws and policies that hinder deinstitution-independent living. In addition, the anti-discrimination law of persons with disabilities should be amended to define unfair institutional discrimination and to make reasonable changes to welfare services. This increases the possibility that courts can intervene in the formulation and implementation of national deindependence-independent living support plans, which will lead to effective deinstitution policy. In residential facilities, people with disabilities do not live dignified lives, and they lose the most important life identity in human dignity and values. The lives of people with disabilities in residential facilities are harm and abuse by our community.
