「국가정보원법」개정안과 국가안보 (Amendments to the 「National Intelligence Service Act」 and National Security)

초록

우리나라가 속한 한반도 지역은 주변 강대국들의 완충국(Buffer State)으로 전쟁, 테러 그리고 요인암살과 같은 국가안보의 위기는 지속적으로 발생하여왔으며, 한국(6.25)전쟁이후 북한은 대남적화통일을 목적으로 다양한 위협을 지속하고 있어 폭넓은 학술적 연구가 요구되나「국가정보원법」과 같이 이 법의 중요성과 본질과는 다르게 지나치게 정치적으로 해석하려는 분위기로 인해 학술적으로 심도는 연구주제로 다루어지지 않았다.
따라서 이 연구에서는 국가정보원과 국가안보에 관한 연구의 배경을 역사적, 현실적, 정치적으로 구분하여 살펴보고 우리 안보환경의 변화에 따른 주적의 개념을 탐색하였으며 이러한 안보환경 속에서 지금 우리에게 당면한 위협이 무엇인지 제시하고 우리 정보기관의 발달과정과 기능을 살펴보았다.
핵심적으로 현재 국회에서 논의중인 「국가정보원법」개정안 총14건을 살펴보고 이중 중점적으로 논의가 필요한 ➀국가정보원 대공수사권 경찰청 이관 ➁국내보안정보 수집 범위를 심도 있게 논의하여 현행법의 모순점을 제기하고 앞으로「국가정보원법」개정안의 입법방향을 제언하였다.
마지막으로 「국가정보원법」개정안의 실효적 개정이후 국가안보를 위한 국가정보원의 정책과 방향으로 ➀정보기관의 인사관리 시스템 마련 ➁전문 인력의 확충 ➂정보기관 공조 시스템 구축을 제시하였다.

영어초록

The Korean Peninsula region, where our country belongs, has been a buffer state for the neighboring powerful nations, and national security crises such as war, terrorism and assassination have continued. Though North Korea has continued various threats for the purpose of reunification through communizing South Korea after the Korean War (6.25) and extensive academic research has been required, it was never been addressed as a topic of an in-depth academic research unlike the importance and nature of the 「National Intelligence Service Act」 because of it, many times, receives a overly political interpretation Therefore, this study historically, realistically and politically examines the research backgrounds of the National Intelligence Service and the national security and explores the concept of main adversary according to the changes in our security environment, and what threats are facing us in this security environment are suggested along with the examination of development process and functions of our intelligence agency.
In essence, this study reviewed the 14 Amendments to the National Intelligence Service Act, which are currently being discussed by the National Assembly and proposed the legislative direction for the amendments to the National Intelligence Service Act by demonstrating contradictions of the current law in force through In-depth discussions of ➀Transferring the anticommunist investigative right of the National Intelligence Service to the National Police Agency and ➁Domestic Security Information Collection Range which need to be dealt with a higher priority Lastly, for the policy and direction of the National Intelligence Service to pursue national security after effective revision of the 「National Intelligence Service Act」, ➀ Implementing a human resource management system for the Intelligence Service ➁ Securing and expanding professional manpower and ➂Establishing a intelligence agency cooperation system were suggested.
