공공기록물법 개정안 비평: 2024년도 정부입법안을 중심으로 (Review of Policy and Practical Implications of the Amendment to the Public Records Act: Focusing on the 2024 Government Draft Legislation)

초록

본 연구는 2024년 8월 정부 입법예고안으로 제출된 「공공기록물 관리에 관한 법률」 개정안을 놓고 공공기록물 관리체계에 미치는 조항을 대상으로 기록관리계 전반과 각급 기관, 기록관에 미칠 영향을 검토한다. 개정안의 영향은 정책적 측면과 실무적 측면으로 나눌 수 있는데 정책적 측면은 업무에 즉각적으로 미치는 영향은 적으나 큰 틀에서 점진적인 변화를 초래하는 반면, 실무적 측면은 업무에 즉각적으로 미치는 영향이 높으며 단기적으로 장애와 업무 부담을 유발할 수 있는 부분이다.
먼저 정책적 측면의 영향이 예측되는 조항은 「국가기록물법」으로의 법률의 제명 변경, 민간기록물·국외기록물·데이터형기록물의 개념 신설, 각급 학교와 지자체 예산투입 비율이 적은 공공기관을 대상으로 한 준공공기관 개념 도입, 중앙기록물관리기관 명칭을 국가기록원으로 대체, 기록물관리기관 개념의 공공/민간 이분화 및 민간기록물관리중점기관 지정제도 신설이다. 다음으로 실무적 측면의 영향이 예측되는 조항은 전자화기록물 원본 대체 인정, 정보공개 접수 범위 한정, 소속(산하)기관에 대한 기록관리 실태점검·평가권 부여, 기록물 재편철 및 보존기간 하향 분류제도 신설, 기록물 평가심의위원회의 민간위원 비중 확대이다.
연구를 통해 이번 개정안을 검토하여 한계점을 도출하고 간략한 제안을 하는 것이 입법 여부와 관계없이 차후 국가기록원이 추진하려는 공공기록관리 정책의 방향을 가늠할 수 있고 분야별로 보다 깊은 분석과 대안을 후속연구로 이어질 수 있음에 의의를 둔다.

영어초록

This study examines the impact of the proposed amendments to the Public Records Act, submitted as a government bill in August 2024, with a focus on the provisions affecting the public records management system. The analysis considers the implications for the overall records management sector as well as individual institutions and archives. The effects of the proposed amendments are categorized into policy and practical aspects. Policy aspects are expected to bring gradual and overarching changes with minimal immediate impact on operations, while practical aspects are likely to introduce immediate challenges and increase workload in the short term.
Provisions with anticipated policy implications include the renaming of the Act to the National Records Act, the introduction of concepts such as non-governmental records, overseas records, and data-type records, the inclusion of quasi-public institutions with limited budgets (schools and certain local government entities), the renaming of central archives to the National Archives of Korea, the bifurcation of public and non-governmental archival institutions, and the establishment of a system for designating specialized records centers for managing non-governmental records.
Provisions with anticipated practical implications include recognizing digital records as originals, limiting the scope of information access requests, granting supervisory agencies the authority to inspect and evaluate the records management practices of subordinate agencies, introducing a system for reclassification and reduction of retention periods for records, and increasing the proportion of civilian members in records appraisal committees.
This study aims to identify the limitations of the proposed amendments and provide brief recommendations. Regardless of whether the bill is enacted, the findings hold significance in guiding the direction of public records management policies pursued by the National Archives of Korea and serve as a foundation for in-depth analysis and the development of alternative measures in subsequent research.
