북한 급변 시 중국의 개입에 대한 법적 고찰 (An Legal Analysis on Chinese Intervention Regarding North Korean Collapse)

초록

최근 북한의 지속적인 핵개발로 인해 UN안전보장이사회의 결의안 2321호가 채택되어, 북한의 주요 수출품 중 하나인 석탄수출에 대한 제재가 본격화 될 예정이다. 미국에서 트럼프가 대통령으로 당선되고 이에 따른 대북 강경안이 예상되며, 북한의 핵실험에 따른 주변국 안보위협으로 인해 북한에 대한 선제공격설 등이 제기되고 있다. 이러한 외부적 변인으로 인해 북한에서는 경제적 난관과 상대적 박탈감, 군부의 이탈로 인한 ‘아랍의 봄’과 같은 급변사태가 발생할 수 있다.
북한 급변사태 발생 시, 중국은 한반도가 베이징과 근거리에 위치해있고, 북한이 중국 본토 진출의 통로가 된다는 전략적 이유로 인해 북한 지역에 대한 개입을 진행할 것이다. 중국의 북한 개입의 근거는, 한미연합군의 개입에 대한 중조 우호 협조 및 호상원조에 관한 조약에 근거한 집단적 자위권의 행사, 북한과 경제적․지리적 위치(안보)에 근거하고 UN안전보장이사회의 승인을 받은 인도적 개입, UN총회 결의에 따른 평화유지활동에 따른 개입이다.
하지만 한미연합군의 북한 침투 자체를 무력사용이라 간주할 수 없고, 무엇보다 ICJ판결에 따른다면 상당한 수준의 무력사용이 전제되지 않는 한 중국의 자위권 행사는 그 실효성이 문제된다. 또한, 중국이 자국의 재산과 국민을 보호하기 위해 인도적 개입을 하려면 UN안전보장이사회의 승인이 필요하고, 승인을 받지 않는다 하더라도 인도적 개입은 자체로서 국가주권을 침해하는 행위이기에, 인간안보 측면에서 국체공동체의 보호책임(R2P)으로 나아가야 한다는 점에서 한계가 있다.
중국이 UN평화유지군으로 북한에 침투할 경우, 북한 체제 이행기 후 한국 정부의 고유명제인 민족통일과 관련 국가들의 책임규명을 위해, 적극적으로 한국군을 UN평화유지군으로 북한에 파병해야 할 것이다. 중국과 한국 어느 한쪽이 주도하는 것이 아니라 양국이 북한 문제에 대한 당사자국으로서 균형을 가지고 질서유지가 이루어질 때, 통일한국의 구성과 함께 차후 북한인권 유린에 대한 과거사 청산과 배상이 실현될 수 있다.

영어초록

Due to North Korea’s continued nuclear tests, the U.N. Security Council approved resolution 2321, which is expected to impose sanctions on North Korean coal exports, one of Pyongyang’s main trade goods. Newly elected U.S. President Trump is expected to take a hawkish stance towards Pyongyang. Moreover, North Korea’s nuclear tests proved to be a significant security threat to neighboring countries and aroused discussions regarding preemptive strikes against North Korea. Such variables in international environment may bring about a sudden shift in power similar to that of Arab spring, amplified by economic hardship, feelings of deprivation, and desertion of the military.
If such an event is to occur, China would surely intervene in North Korea for two reasons: the Korean peninsula is located right next to Beijing, and a collapsed North Korea would provide passageway for external forces to move into Chinese territory. China’s reasons for its intervention in North Korea are nominally legitimate. It is an act of collective self defense against U.S. - Korean allied forces’ intervention based on Sino-North Korean Mutual Aid and Cooperation Friendship Treaty(中朝友好合作互助条约). It is also an act of humanitarian engagement based on China’s economic and geographical adjacency to North Korea and approved by the U.N. Security Council. It is also the U.N. Peacekeeping Operation(PKO) based on the resolution approved by the U.N. general assembly.
Yet, since it is difficult to define U.S. - Korean combined forces’ advance into North Korean territory as a use of military force against China, the legitimacy of China’s rights of self defense is questionable unless, according to ICJ rulings, a significant level of military force had been exercised. Moreover, China would require the U.N. Security Council’s approval if China is to exercise humanitarian engagement in order to protect its people and national property. Even when it is not approved, the act of humanitarian engagement is in itself a violation of national sovereignty and is limited to international community’s Responsibility to protect(R2P) actions in the aspect of human security.
If China is to infiltrate North Korea under the name of the U.N. peacekeeping forces, Korea should also dispatch ROK armed forces to North Korea as the U.N. peacekeeping forces in order to achieve national unity, the Korean government’s mission statement, during North Korea’s transitional period and also to hold responsibility to countries involved in the process. A truly united Korea can be formed when China and Korea stand equally responsible and work together to maintain order in North Korea. Only then can compensations and settlements be made for the human rights violations caused within North Korea.
