심해저활동과 관련한 보증국의 의무와 책임에 대한 국제해양법재판소의 권고적 의견 (Responsibilities and obligations of states sponsoring persons and entities with respect to activities in the Area)

초록

2011년 2월 1일 국제해양법재판소(“ITLOS”)의 해저분쟁재판부는 역사적으로 중요한 권고적 의견을 만장일치로 채택하였다. 권고적 의견이 요청된 질문은 심해저활동과 관련한 보증국의 의무와 책임에 관한 것이다. 보증국은 피보증 계약자가 해양법협약과 그 밖의 관련문서들상의 의무를 준수하도록 보장할 상당주의 의무를 부담하며, 이 의무는 결과의무가 아니라 행위의무이다. 그리고 보증국은 또한 자기 자신의 직접 의무도 부담하는데 이에는 특히 사전주의원칙 적용의무, 최적환경관리방안 적용의무 그리고 환경영향평가 의무 등이 있다. 이러한 직접 의무들은 또한 보증국의 상당주의 의무 준수와도 관련된 요소로서, 결과적으로 ITLOS는 상당주의 의무의 구성요소들을 제시하였다. 보증국이 부담하는 책임은 상당주의 의무위반으로부터 나오는 과실책임이며 엄격책임은 아니다. 따라서 피해배상의 공백이 발생할 수 있지만 보증국에게 잔여책임이 발생하지는 않는다. 다만 이 경우 신탁기금의 설립가능성이 제시되었다. 그리고 보증국은 자국의 의무를 이행하기 위해서 자국법체계 내에서 법령과 행정조치를 채택하여야 한다. 이러한 법령과 행정조치는 보증국이 자국 관할권에 속하는 자의 준수를 확보할 수 있도록 합리적으로 적절해야 한다. 재판부는 이 권고적 의견을 통해서 국제환경법상 중요한 원칙과 개념의 본질과 범위를 명확히 하고 나아가 국제환경법의 발전방향을 제시하였다.

영어초록

On 1 February 2011, the Seabed Disputes Chamber of the International Tribunal for the Law of the Sea (“ITLOS”) unanimously adopted a historic Advisory Opinion. The Advisory Opinion was about three questions regarding the responsibilities and obligations of States sponsoring persons and entities with respect to activities in the Area. First, a sponsoring State has an obligation to ensure that a sponsored contractor complies with the rules set out in the Law of the Sea Convention (1982) and related instruments. The sponsoring State’s obligation to ensure is an obligation of conduct and not of result, and an obligation of due diligence. The sponsoring State has also direct obligations independently of its due diligence obligation to ensure. These obligations include, inter alia, the obligation to apply a precautionary approach, the obligation to apply best environmental practices and the obligation to conduct environmental impact assessments. They can also be seen as a relevant factor in meeting the due diligence obligation to ensure and thus the Chamber suggested the constituent elements of the obligation of due diligence. Second, since the sponsoring State’s liability arises only from its failure to meet its obligation of due diligence, liability is fault-based, rather than strict. A gap in liability, therefore, may occur but the liability regime established by the Convention and in related instruments leaves no room for residual liability of the sponsoring State. Nevertheless, the Chamber recognized the need for a trust fund to compensate for the damage not covered. Third, the sponsoring State must adopt laws and regulations and take administrative measures within its legal system to fulfill its responsibility under the Convention. The laws and regulations, and administrative measures must be reasonably appropriate for securing compliance by persons under the jurisdiction of the sponsoring State. Through this Advisory Opinion did the Chamber confirm and clarify the nature or scope of relevant international legal norms or concepts, and suggested a pathway for the development of international environmental law.
