프랑스 상소심 제도의 유래와 특징 (Origin and Characteristics of Appellate Trial System in France)

초록

파기법원이 탄생한 배경에는 법령해석에 관한 왕과 파리고등법원 사이의다툼이 있다. 왕은 왕대로 자신이 생각하는 법이 있었고, 파리고등법원은 파리고등법원대로 왕의 법이 프랑스의 법과 맞는지 판단할 의무가 있다고 생각했다. 쉽게 말하면, 무엇이 법인가에 대한 다툼이 있었고, 그 다툼을 해결할 방도로 왕이 파리고등법원 위에 올려놓은 법원이 바로 파기법원이었다.
파기법원은 좋든 싫든 파리고등법원 위에 올려 세워진 법원이다. 다만 이제 와서 달라진 점 하나는 파기법원은 왕명을 받드는 것도 아니고 혁명가의뜻을 받드는 것도 아니고 입법의회나 총통의 뜻을 받드는 것도 아니라는 점이다. 국민의 뜻을 받들 뿐이고, 법과 정의를 받들 뿐이다. 파기법원은 형식적으로 법무부장관의 지휘를 받지만 그것은 파기법원이국가기구 중 하나라는 것 외에는 다른 의미는 없다. 파기법원은 고등법원위에 서서 프랑스의 법이 궁극적으로 어떤 말을 하고 있는지를 판단할 최종적인 책임을 진다. 따라서 고등법원과 핑퐁게임을 하고 있어서는 안 된다.
무엇이 법인가에 대한 최종 해석권자로서 법률의 헌법 위반에 대한 1차적심사권자로서 스스로의 위치를 굳건히 해야 한다.

In the background that la cour de cassation (Court of Cassation) cameinto existence, there are disputes between the king and the Parlementof Paris (the Paris High Court) with regard to construction of the laws.
There existed the laws thought by the king himself while the Parlementof Paris (the Paris High Court) thought in its own way that it had theobligation to determine whether or not the king’s laws accorded with thelaws of France. Easy to say, there were disputes over what the lawswere, and the court placed over the Parlement of Paris (the Paris HighCourt) by the king as a means to resolve the disputes was nothing otherthan la cour de cassation (Court of Cassation).
Whether it is desired or not, la cour de cassation (Court of Cassation) isa court established as being placed over the Parlement of Paris (theParis High Court). However, one thing that has changed today is that lacour de cassation (Court of Cassation) does not obey a command of theking, nor follow the will of a revolutionist, nor follow the will of eitherlegislative assembly or the president (le Caudillo). It only complies withthe will of people and only follows the laws and justice.Although la cour de cassation (Court of Cassation) is superintendedformally by the Minister of Justice, there is no meaning other than thatla cour de cassation (Court of Cassation) is one of the state organizations.
La cour de cassation (Court of Cassation) being placed over the Parlementof Paris (the Paris High Court) has the final responsibility to determinewhat the laws of France say ultimately. So, it should not be forgettablethat la cour de cassation (Court of Cassation) plays a ping-pong game withthe Parlement of Paris (the Paris High Court). La cour de cassation (Courtof Cassation) should make its own position firm and solid as a final authority with the right to construe what the laws are and also as aprimary authority with the right to examine the violation of laws againstthe constitution.
