정부조직법에 근거한 강력한 행정부의 대두와 대통령비서실의 역할: 제1공화국을 중심으로 (The Establishment of the Powerful Executive Branch and the Role of Presidential Office based on the Government Organization Law: the First Republic)

초록

20세기의 대통령중심제 국가들에서 의회권력의 약화와 행정부의 권력집중은 보편적으로 진행되어 사무엘 헌팅톤이 예견하였던 강력한 행정국가들이 등장하였다. 이는 오늘날 강력한 행정중심국가가 된 우리나라도 예외가 아니다. 그간의 선행 연구들은 이러한 행정부의 권력 강화와 행정수반으로서의 대통령의 권력집중의 과정을 주로 제3공화국부터 조명하였기 때문에 제1공화국과 제2공화국에 대한 연구는 찾아보기 어렵다. 본 연구는 국가정체성의 위기를 겪으며 건국과정을 완수하고 미약했던 경제기반마저도 괴멸시킨 6.25전쟁을 헤쳐 나온 제1공화국 기간 동안 대통령의 권력집중이 어떻게 진행되었는지, 그 과정에서 대통령비서실의 역할과 의의는 무엇이었는지, 정부조직법을 중심으로 고찰하고자 한다. 제1공화국의 시작은 강력한 대통령중심제 정부조직을 만들어내는 과정과는 거리가 멀었지만 시간이 가면서 이승만대통령은 제헌국회가 의도했던, 즉 주요한 대통령권한을 국무총리에게 모두 위임시키기를 원했던, 제도적 틀을 바꾸기 위하여 헌법 및 정부조직법의 개정을 추진하여 성공하게 되고 강력한 대통령중심제 정치체제의 기틀을 비로소 마련하게 된다. 이 과정에서 이승만대통령은 국회와의 관계를 중시하며 법률개정을 통한 대통령중심제의 제도화에 초점을 맞추었기 때문에 대통령비서실은 대통령의 지원보조기관으로서 간접적인 역할을 수행하는데 그 의의가 있었다고 평가할 수 있다. 따라서 제1공화국의 대통령비서실은 오늘날의 행정중심국가의 대통령비서실 조직과 같이 방대하지도 않았고 강력한 행정정치권력을 행사하지도 않았다.

영어초록

In the twentieth century, the state with the presidential political system has experienced the weakening of the legislative branch and the increasingly concentration of power into the executive branch. Korea, which has evolved to be a powerful executive-centered state, is not the exception to this phenomena. The prior studies have focused and reviewed from the Third Republic to illuminate the power transition to the executive branch and the presidential power concentration. The power transition and concentration during the First and the Second Republic have been overlooked by the related academic circles. This study elaborates from the First Republic with the emphasis on the Government Organization Laws in order to illuminate how the First Republic has achieved the presidential power concentration and the evolution of the powerful executive branch from the nation building process amongst the national identity crisis and the total destruction of the economic basis by the Korean War. Also, the role of the Presidential Office is reviewed together in the transition of the executive branch. In process of making the powerful presidential government organization during the First Republic, it is noticed that the Presidential Office had played a limited role only as the political support staff for president's efforts and political goal. Accordingly, its organizational size was not huge nor complex unlike today's presidential office. In addition, it is observed that President Singman Lee himself did not view the presidential office as the appropriate medium to exercise political power and supervise other executive organizations. He regarded that enhancing president's direct control over executive organizational strata is the foundation for the establishment of true executive-centered presidential political system.
