경찰서 여성전용 유치실의 인권 개선을 위한 정책과제 (Policy Agenda for Improvement of Human Rights about Women's Detention Facilities in the Police Stations)

초록

경찰청은 지난 2005년 6월부터 전국 5개 경찰서에 시범적으로 운영한 여성전용 유치실의 문제점을 토대로 여성전용 유치실 확대운영 계획을 수립 및 발표하였는데 그 4가지 개선 계획, 즉 (1) 여성전용 유치실 지정 및 구분 개선 계획 (2) 여성전용 유치실 내 화장실에 대한 개선 계획 (3) 여성전용 유치실 환경 개선 계획 (4) 여성 유치인 인권보장 강화를 위한 개선 계획 등이 여성전용 유치실에 유치된 여성 유치인에게 어떻게 인식되고 있는가를 경북지방경찰청에 소속된 상주, 경산, 구미 경찰서 여성전용 유치실에 유치된 여성 유치인을 대상으로 직접 인터뷰를 실시하여 그 정책적인 함의를 분석해 보고 개선책을 제시하는 것이 본 논문의 목적이다. 이와 같은 절차와 방법으로 다음과 같은 연구 결론을 도출하였다.
첫째, 여성 유치인과 남성 유치인의 분리 유치에 그친 현재의 단일 유치장 시설이 아니라 선진국처럼 여성․남성․장애인․소년범 등의 피의자를 차별하여 유치할 수 있는 다수의 유치장 시설의 확충하여 운영하는 것이 바람직하며 여성 유치인의 성적 수치심과 고충을 최소화하기 위해서 여성 유치인보호관의 배치를 관내 모든 경찰서 유치장에 배치하여야 할 것이다.
둘째, 유치실 내 화장실 관련 시설은 항상 청결을 유지할 수 있도록 관리를 철저히 해야 하며 에티켓 벨의 설치는 여성 유치인의 용변 시 성적 수치심을 최소화하는데 효과적인 것으로 판단되므로 지속적인 관리를 통해 좀 더 효율적인 사용을 유도하여야 할 것이다.
셋째, 유치실 내 냉․난방 시설은 주기적으로 점검하여 원활한 작동이 이루어지도록 하고 유치실 내 조명은 지나치게 인공조명에 의존하기 보다는 자연채광 등 인권친화적인 조명을 확보하도록 하며 외부의 공기가 유치실 내부로 순환할 수 있도록 유치실 내부에 적절한 수의 창문을 확보하여야 할 것이다. 또한 유치장 실내면적을 충분히 고려하여 공기청정기나 환풍기 시설을 확충하여야 할 것이다.
넷째, 관식의 질을 향상시키기 위해서는 예산의 확보가 절실하며 모포와 침구 등은 정기적인 세탁을 통해 항상 청결을 유지할 수 있도록 조치해야 할 것이다. 또한 여성 유치인의 경우 남성 유치인에 비해 상대적으로 남성 유치보호관에 대한 심적인 부담을 가질 수 있으므로 유치인보호관의 직무교육 등을 강화하여 여성 유치인에 대해서는 좀 더 친절하고 상냥하게 응대할 수 있도록 하여야 할 것이며 여성 경찰관에 의한 신체검사는 인권침해의 소지가 높은 정밀검사를 지양하고, 표피검사나 간이검사로 대체하여야 할 것이다.

영어초록

In this study, we observe the following 4 plans for improving the conditions of detention houses for women based on the problems with the pilot operation of the same institutes at the national 5 police offices conducted by the National Police Agency since the last June, 2005. The four improvement plans are on (1) appointing and dividing the detention houses for women (2) the restroom conditions in those institutes; (3) their environments (4) securing and reinforcing the rights of inmates. The study aims to identify the political implications of these plans and suggest better approaches to relevant issues by conducting personal interview on the woman inmates at the detention houses in Sangju, Gyengsan and Gumi police offices in the jurisdiction of Gyeongbuk Provincial Police Agency in order to find out how those inmates perceive these plans.
We reached following conclusions as a result of applying these procedures and methods. First, it might be desirable to add a number of prisons to the existing ones for the purpose of raising the current level of system divided between male and female to the next level differentiated between the detention houses for women, men, the disabled and youthful offenders the way administrated in advanced countries. In addition, we need to deploy guards to every detention house of the police station to protect female inmates partly in an effort to minimize their sexual embarrassments and dilemmas.
Second, the facilities related with the restroom in detention institutes must be maintained clean for more thorough management; in addition, the installation, and consistent management and efficient use of etiquette bell in the restroom is estimated to be effective for minimizing the abashment of those inmates.
Third, we need to check periodically the cooling and warming systems to be appropriately operated while securing enough windows to receive natural light facilitating a human-right-friendly lighting as well as ventilate the outside air into the houses; the floor spaces should be taken into consideration when supplementing the air purifiers or ventilation systems.
Last, we urgently need to secure the budget to support those improvement tasks. The blankets, bed clothes, clothes for physical check-up, etc., must be washed regularly for continuous sanitary management. Besides, the systems including for training associated with the guards' duties of inmates need to be reinforced so that the guards respond to the female inmates who are fragile in the nature of gender compared to the male counterpart in a more amiable and friendly manner; the physical check-ups by woman police officers should be avoided in terms of any close examinations which have a high possibility to infringe the human right, rather enforcing cuticle or other simplified tests.
