초록

Incoterms는 국제무역거래에서 사용되는 무역조건에 대한 통일된 해석을 제공하여 무역업자들의 원활한 국제무역 활동을 지원할 목적으로 1936년에 ICC에 의해서 제정되었으며, 제8차 개정인 Incoterms 2020이 내년 1월 1일 사용을 앞두고 있다.
본 연구는 Incoterms의 개정연혁과 특징을 살펴보고, Incoterms 2020의 주요 개정내용 및 실무상 유의점을 소개하는데 주안점을 두었다. 특히, Incoterms 2020가 무역관습으로 정착되기 위해서는 종전의 Incoterms 규칙 및 변형(variant)된 정형거래조건의 사용을 자제하고 규칙 내용대로 사용되어야 한다. 따라서 본 연구에서는 Incoterms 2020가 무역관습으로 정착되는데 걸림돌인 정형거래조건의 변형(variants)을 종합 정리하는 한편, 그 밖에 Incoterms의 사용에 관한 실무상 유의점을 제시하였다.

영어초록

Incoterms 2020, which will become effective from January 1, 2020, is not much amended on the surface, but it is excellent amendment in terms of stability of international trade customs. The purpose of this study is to introduce the amended contents of new incoterms and to emphasize considerations in practical use.
The main amendments of Incoterms 2020 are as follows; ① The DAT was changed to DPU and the arrangement order of the 'D' terms was DAP → DPU → DDP. ② The 10 articles(A1~A10, B1~B10) which each incoterms rule have been reorganized to understand easily. ③ The CIP's insurance cover level up from the minimum coverage(C or FPA) to maxium(A or A/R). ④ When the buyer wants bills of lading with an on-board notation in the FCA, the buyer will instruct its carrier to issue it, and the seller then to provide it to the buyer. ⑤ In the D-terms and the FCA, seller or buyer can arrange for carriage by own means of transport.
Practical considerations regarding the use of Incoterms 2020 are as follows; ① We found around 83 variants of Incoterms in the survey. It may be used without modification of Incoterms, but if it is inevitable, it is desirable to clearly state the purpose of the transformation in the contract. ② Incoterms has been revised every ten years since 1980. However, if we focus on the establishment of trade practices, we do not need to revise it every ten. ③ Finally, we highlight the correct notation of trade terms, and Incoterms does not only mean price terms, but that the core parties of Incoterms are sellers and buyers.
