미국의 ‘신 재산’ 이론에 대한 평가와 우리 법에의 시사점 (The evaluation of New Property theory in America and its implication to our law.)

초록

미국의 신 재산 이론은 찰스 라이크에 의해 주창되어 미 연방대법원 판례에 의해 채택된 이론이다. 라이크는 현대사회에서 정부급부의 중요성을 역설하며 공법상 권리를 재산권으로 인정함으로써 사회적 약자를 보호하는 복지제도가 작동하여야 한다고 하였다. 연방대법원은 복지수급권의 재산권성을 인정하고 수정 제5조 적법절차원칙을 적용함으로써 복지수혜의 중단에 사전청문절차가 반드시 행해져야 한다고 판결했다. 신 재산 이론은 연방대법원에서 골드버그 사건에서와 동일한 형태를 유지하지는 못하였고, 미국 내에도 많은 비판의 목소리가 있다. 비판의 핵심은 의회의 권한을 사법부가 대체한다는 것, 예산상의 제약이 있을 수밖에 없다는 것, 엄격한 절차를 준수하도록 함으로써 오히려 복지를 감소시킨다는 것 등이 될 수 있다.
우리나라의 경우 복지수급권은 헌법재판소가 독일 연방헌법재판소의 이론을 받아들임에 따라 일정한 요건을 갖추면 재산권성이 인정된다. 그러나 복지수급권이 재산권성을 가진다고 하여 자유권인 재산권과 동일한 효과가 발생하는 것으로 볼 수는 없다. 이 점은 미국에서 신 재산 이론이 재산권이라는 입장을 견지하지 못한 것과 비견되어 설명될 수 있을 것이다. 재산이 있음으로 말미암아 물질적 삶, 나아가 개인의 자유실현이 가능해질 수 있다.
아마도 신 재산 이론은 엄격한 권력분립의 원칙에 입각한 대통령제 국가인 우리나라에서, 사회권인 복지권에 자유권적 성격을 부여함으로써, 법원이 의회 입법에 대해 적절히 통제하고, 안정적인 복지시스템을 구축할 수 있는 기제로 작동할 수 있을 것이다.
본 논문은 신 재산 이론을 다양한 시각으로 정리하고, 미국 내에서의 평가와 공과를 되돌아보며, 우리나라에서 복지권에 재산권성을 부여하고 적용하는데 있어 어떤 시사점을 제공할 수 있는지를 탐구하고자 한다.

영어초록

The American New Property Theory is advocated by Charles Leich and adopted in the Supreme Court of United State. Leich emphasized the importance of government benefits in modern society and the welfare system to protect the socially weak should be operated recognizing this right in public law as one of the property right. By recognizing the property right nature of welfare entitlement and applying the due process principles of the Fifth Amendment, the Supreme Court ruled that pre-hearing procedure must be conducted should welfare benefits be stopped. The New Property Theory did not maintain the same form as in Goldberg case at the Supreme Court, and there were many criticism within the United State. At the heart of the criticism are that the judiciary replaces the authority of Congress, that there are budget constraints, and that it would rather reduce welfare by applying more rigorous procedures.
In case of Korea, the Constitutional Court recognized the welfare entitlement by accepting the theories of Germany Federal Constitutional Court. However, even if the welfare entitlement has the nature of property right, it can not be regarded as having the same effect as the property rights as a free right. This can be explained in comparison with the fact that the New Property Theory does not hold the same position of property right in the United State. The possession of property enables material life, and furthermore through which the freedom of individual can be realized. Perhaps the New Property Theory in Korea, a presidential state based on the principle of strict separation of powers, will be able to work as a mechanism for the court to appropriately control the legislation of the parliament and to build a stable welfare system by giving the free right nature to this social right, a welfare right.
By examining the New Property Theory in various perspectives and looking back at the evaluation, merits and demerits in the United States, this paper will explore what implications can be gained in adopting and applying the property right nature to welfare right in our country.
