생체인식 기술의 발전에 따른 기본권 보장에 관한 고찰 (Considerations on the protection of fundamental rights in accordance with the development of biometric technology)

초록

생체인식(biometrics) 기술은 지문, 홍채, 얼굴, 음성 등 인간의 신체 부위 등을 인식해서 본인 인증을 하는 기술로, 현재 출입국심사･전자여권･근태관리･민원서류 발급 업무 등 오프라인에서의 신원확인을 위한 중요한 수단으로 사용되고 있으며, 특히, 포스트 코로나 19에 접어들면서 스마트폰을 이용한 모바일 지급결제 및 인터넷 전자상거래･전자투표･화상회의 및 원격수업 등 사이버 활동이 급증함에 따라 온라인상에서의 비대면 인증수단으로 활용도가 더욱 증가하고 있다.
그러나 최근 생체정보가 유출되거나 위조 및 변조되는 사례가 증가하면서 여러 우려도 함께 공존(共存)한다. ‘생체정보(biometrics data)’는 그 자체로 개인 식별이 가능하며 변경이 불가능하다는 특성, 즉 유일성 및 불변성으로 인하여 다른 개인정보보다 유출 및 오･남용 시 그 피해 규모나 사회적인 파급효과가 크다. 특히, 지금의 생체인식 기술은 인공지능에 기반하여 다양한 분야에서 효율적으로 개인을 식별･분류하고 판단하는 데 이용되고 있다. 공공장소에서 불특정 다수를 대상으로 한 실시간 얼굴인식(face recognition) 기술은 사생활의 비밀과 자유, 집회 및 결사의 자유 등 기본권 침해의 가능성도 내포한다. 더욱이 이러한 정보들은 CCTV, 위치기반 서비스를 탑재한 모바일 앱, 온라인 플랫폼과 미디어 등 다양한 정보통신기술 등과 결합하여 국가의 광범위한 감시망 구축과 정보수집에 이용되기도 한다. 설령 국가가 이를 감시 목적으로 사용하지 않더라도 생체인식 기술의 활용 그 자체만으로도 감시에 준하는 효과가 발생할 수 있으며, 종국적으로는 권력자의 영향력이 높아지는 현상, 즉 권력의 확대 현상이 나타날 수 있다. 인공지능에 의한 감시는 이를 의도하였든 혹은 의도하지 않았든 국민의 기본권은 물론 민주주의에 중대한 영향을 미칠 수 있다.
인공지능은 단순한 기술이 아니라 국가의 경제 성장과 국민 삶의 질을 좌우하는 핵심 동력이 될 수 있으므로 인공지능 발전과 신뢰 기반 조성을 위한 구체적인 규율 체계가 필요하다. 인공지능의 경로의존성이 불가피한 만큼 규제와 이를 위한 입법의 필요성을 부인할 수는 없다. 그러나 현시점에서 중요한 것은 생체인식 기술에 대한 규제 여부를 다투는 것이 아니라, 규제는 하되 이러한 규제가 향후 생체인식 기술의 발전에 있어서 어떠한 영향을 미칠 것인가에 대한 면밀한 검토 후, 균형점을 찾아가는 것이다. 제도가 기술의 발전 속도를 따라가지 못하면, 기술은 그 가치를 충분하게 발휘할 수 없다. 이제 구체적인 논의를 시작하여 향후 정보 주체의 권리보호를 강화할 수 있도록 생체인식정보에 관한 합리적인 규율 체계를 마련해야 할 시점이다.

영어초록

Biometrics is a technology that recognizes human body parts such as fingerprints, iris, face, and voice to authenticate oneself. It is currently used as an important means for offline identification such as immigration, electronic passport, attendance management, and civil petition documents. In particular, as cyber activities such as mobile payment using smartphones and Internet e-commerce, e-voting, video conferencing, and remote classes increase rapidly in post-COVID-19, its use as a non-face-to-face authentication method online is expected to increase.
However, as the number of cases of leakage, counterfeiting, and falsification of biometric information increases in recent years, various concerns coexist. Biometrics data has a greater ripple effect in the case of leakage, misuse, or abuse than other personal information due to the characteristics that individual identification by itself is possible and cannot be changed, that is, uniqueness and immutability. Real-time face recognition technology for a large number of unspecified people in public also implies the possibility of infringement of basic rights such as the secret and freedom of privacy, and freedom of assembly and association. Moreover, such information is sometimes used to build a wide range of national monitoring networks and collect information in combination with various information and communication technologies such as CCTV, mobile apps with location-based services, and online platforms and media. Even if the state does not use it for monitoring purposes, the use of biometric technology itself may have an effect equivalent to monitoring, and eventually, a phenomenon in which the influence of the powerful increases, that is, the expansion of power may occur. Monitoring by artificial intelligence, whether intended or not, can affect democracy as well as the basic rights of the people.
As such, artificial intelligence is not just a technology but a key driving force that determines the economic growth of the country and the quality of life of the people, and a discipline system is needed to develop artificial intelligence and create a foundation for trust. The need for regulation and legislation cannot be denied as the path dependence of artificial intelligence is inevitable. However, the important thing at this point is not to dispute whether or not to regulate biometric technology, but to regulate it, but to find a balance point after a close review of how these regulations will affect the future development of biometric technology. If the system does not keep up with the pace of technological development, technology cannot fully demonstrate its value. It is time to start a detailed discussion and establish a more rational discipline system for biometric information so that the protection of the rights of information subjects can be strengthened in the future.
